Personally, posts that provide logic, facts and accept circumstantial evidence to be as clear and as proof-worthy as DNA do "it" for me. Enjoy the ride....

RZ was deemed not credible due to all the photos and flyers and other publicity. See Temporary custody order in the sticky files, under findings of fact and conclusions of law.

Regarding if RZ is a credible witness or not, when I was reading her statement last night, this caught my attention:
She sees NC jogging on sat., observes the search around Lochmere Lake on Sun, and calls the police to leave a message. She then says in a sworn affadavit, that on several subsequent weekends, police were stationed on Lochmere Drive asking questions about the missing jogger, handing out fliers, and she volunteered again that she saw nc jogging, and mentioned police did not call her back. Then she says that at one point after the body was discovered on a weekday, she was stoped by another road block, and she explained yet again that she had seen nc.

So, a few observations:
-perhaps the writing is misleading
-what is ZD's sense of time and memory if she remembers missing fliers being handed out for several subsequent weekends for a missing, not murdered jogger
-after these weekends, are we to presume she is just finding out that nc was found? and if that is the case, was she really so certain that this was the person, when she lived in lochmere, and somehow missed the body's discovery for several weeks
(you would think if she really thought she saw her, then she would be a bit consumed with the idea of something terrible happening to her)

since we have not heard her speak, IMO, i think there is sufficient reason to believe she may not be very reliable

Thanks PSA. I've been reading for a while.

I will admit to being a tough juror for the prosecution. They will have to prove guilt. Their witnesses get no special 'weighting' just because they're testifying for the state. I've seen PD & Prosecutors lie (under oath) and railroad innocent people.

One more thing before I have to run for a little while, IIRC, DD testified that at the party on fri eve, she and nc looked out the window occassionally to see all the lights off in the house, and assumed everyone was asleep, including bc. i am wondering, was this usual for him to be awake, because we now know he was awake between 10 and 12 pm on the computer, and if so, why were no lights on? would his office window be visible from across the street? if she assumed he was asleep for awhile because of the lights, then perhaps he really was able to ambush her when she came home....just my thoughts.

hope i am making sense! i am new here, though i have been following the board for awhile, and this case is a puzzle!!

I can't go there right now to check it, or I'll lose my place here again. But I thought I read that we couldn't use the names of minors or use the names of others in a negative way?? But can we not even just use the names of witnesses, adult witnesses, to keep them straight in discussions? I get so confused as to what is and is not permissible when simply discussing. Not name calling or deroggatory remarks, just discussing. :banghead:

I don't think you can use full names of any innocent witnesses (some have gotten yelled out because of spelling out HM's name, for example).
