I actually see that stipulation as ridiculous. Once back in Canada Nancy should have been able to get a job. She would no longer be broke since she would be receiving child support. If Nancy moved to the same location as Krista, she would be within, I believe Krista said (?), an hour and a half of the US? Surely they could have worked out terms (since this was a starting point) to meet somewhere in the middle, if he hadn't killed her instead...............

its an hour and a half driving from Oakville just to the Border of the US

Can't believe the Pros is done with Ms. Stubbs. Trenkle :D Guess Kurtz realized she got the best of him during the depositions and was too much of a kitten to mess with her again :D

maybe you had a bad agreement?

Depends on the definition of "bad". We had no attorneys, very moderate child support (never requested an increase in 14 years), no alimony, etc... However, we had a very good relationship, talked frequently about our daughter, co-parented from different states, and generally made the best of a difficult situation. Did I make a smart decision financially? No. Did I make a smart decision for the long haul and the benefit of my child? IMO, yes.

I think the best information of the trial is going to be blanked out...the computer stuff

Child support is *very* formulaic. I think he made something like $130K/year. I challenge you to use the rosen.com child support calculator and come up with a figure that comes close to $2100/month for 2 kids. Remember that he probably is paying their health insurance also.

Nancy was taking the children back to Canada, national health insurance.

8 years for alimony?!!? How long were they married? The rule of thumb is half of the years of the marriage...anything more than that is abnormal and extremely aggressive.

Sounds like he pretty much was on the hook for everything.

I never heard of the life insurance stipulation in a divorce before where she had to be the beneficiary.

A. S's. attitude toward the defense is at best tolerable. I like her.

What about alimony? What about full travel expenses for himself or both kids and her if he didn't go to Canada?

I don't see how you see the initial first draft as fair. It wasn't.

It was a first draft, what about that don't you understand? Negotiations begin. Nowhere does it say this is the be all and end all.

So if she was getting $275/hour, I can see why she put this crazy proposal together to keep the negotiating going and make more money for herself.

correct

This is just how it works. Pretty normal.

I don't see 2100 as unreasonable for child support...frankly, if my 2 kids were to leave the country and be cared for 24/7 by someone else and I paid that person 2100 per month to do so, I am pretty sure I would be ahead financially (in other words...they cost me more than that to have under my own roof and support on a daily basis)

Because Nancy gave up her job & her business to move with Brad, hadn't been able to work in a number of years, the alimony would be given for a period of time, allowing her time to establish herself in the working world once again. That's how it is done when it comes to SAHM's. The rest of the property was a 50/50 distribution. Hardly seems unfair and greedy IMO. Most times that I'm aware of, the child support is far more considering the amount of money Brad earns. :) Judge Judy often times claims it's at least 25% of the salary. And that would be the minimum.

BBM

This is what I was responding to. I know it's a first draft, that's why I specifically stated the first draft was unfair.

I have...reason being that if he died early she would have a means to provide for the children.

Yes, and it's sad. IMO nobody wins but the divorce lawyers.

The point being - this aggressive first draft is not congruent with a woman who simply wants to move on quickly. Think about it - how do you present this to a man like BC who supposedly is "all about the money" and expect it to get signed without creating a shitstorm? She was fully within her rights to push back with Ms. Stubbs and say "let's just present him with a great offer so I can get the heck out of here." Many, MANY women do that...not NC.

I think having him pay for private school until they were both 18 and having to have her as sole beneficiary for his life insurance is pretty insane, but that's just me.
