That's wrong.

The prosecution asks for a conviction. The defense asks for an acquittal. A hung jury occurs when the jury does not agree with either party. Neither the prosecution nor the defense wanted that result, and neither would have seen that as the jury "agreeing" with them but rather the hung jury being better than a result against them.

So the jury did not agree with either party. Individuals in within the jury varied of course.

The jury is required to provide the presumption of innocence.

"Acquittal" isn't an option on the ballot.

blood spatter analysis is no longer allowed in NC due to the corruption of the lab staff doing past blood spatter analysis in other cases, including this one.

Unfortunately the law and constitution do not agree with your opinion...

I totally understand where you're coming from on this. We live in a great country that works to keep us free, and that is because we have a good Constitution, with emphasis in individual rights. We should want nothing less.

OTOH, there's the human side. I would like to think that there are MANY people who, IF they're innocent of a crime committed against their loved one, would honor the vows they took on their wedding day. Love, honor, cherish, till death do us part. With that in mind, should someone cut short the life of your beloved spouse, they would do everything humanly possible to catch the person(s) responsible.

I must be old fashioned. I raised 6 children and had the good fortune of being a SAHM the majority of the time. My family came before me. Of course, many don't feel that way, I realize. But it's just incomprehensible to me, that someone would have such low regard for their spouse, they'd rather let a killer go loose, just because they're afraid. Afraid of being accused when they're innocent.

Usually those that are TRULY innocent, don't fear being accused because they know they did nothing wrong. All they want is whoever harmed their loved one, to pay.

CY's DNA was found on the medicine dropper in her bedroom and on the water spiggot outside the home.

I heard about it on the medicine dropper......not the home spiggot.

The only spiggot I heard was at the Hampton Inn.

Not true. The jury is given instructions and they are required to abide by those instructions.

There are no "rights to mankind" in our constitution. Jason invoked his constitutional right to silence. I respect his decision and so must the jury.

So you are saying if a juror believes that his refusal to help LE in any form is a sign of guilt, they rule against him, that they have to tell anyone that they thought this and was one of the reasons they voted to convict him. They have to do no such thing. A juror can make up their own mind, regardless of instructions to abide by this or that rule of law. When do they have to say this was ONE of their own personal reasons? Who will know if they do not?

Klinkosum started asking this witness a question about something she did previously,
and the Pros jumped up, and the Jury has been excused.

I've read the theories that Jason showered in the back yard in the middle of the night in November, but is the prosecution suggesting that the child also did this? For what reason? I think it's quite likely the child played with the hose in warm weather ... but I really don't think tying a child to a hose in the backyard does anything to convict Jaosn of murder.

I am very frustrated with all this back and forth arguing about what the last jury did... we are in a new trial.

perhaps we will be able to get one of our verified lawyers down here to have a q and a thread....

(will work on that for you all)...

can we please stop the back and forth bickering?

Unfortunately, we have had far too many people convicted of crimes they did not commit. If I were truly innocent, I sure would take my lawyer's advice no matter how much I wanted to talk.

Hi I am new to WS been reading alot of catchup, You all sound like you know what you are talking about, so hopefully you don't roll eyes at me haha..My question is when does LE think JY got back to the Hampton Inn that morning, I also read a worker at the HI found the rock holding open the door, what time was that..Thanks for any info..
