A few weeks ago, Just the Fax posted a picture of the side entrance to the hotel. I added people, how I thought the door would appear when open and dimensions to the image and concluded that there was never any doubt that Jason could easily reach one of the bushes from the door. From looking at all the rocks beside the curb, I fail to understand how anyone could conclude that a rock on the sidewalk was the same one kicked out of the propped door a couple of days earlier.

I remember reading that the bush was nowhere near the door, and when Galloway testified it was not only within reach, he also said a twig was strong enough to hold it, when placed near the latch/lock just like Jason said on the stand.

Now, we know and it is on record.
So, that is cleared up finally.!

Why would he do that? It's not like there wasn't evidence that she had stepped in the blood.

I think he cleaned CY so she would not get blood on him. The bathroom looks like she was shut up in there for a while, probably while he was changing and cleaning himself. Then he had to get her back to sleep so he washed her off before rocking her.

It was a bloody crime scene, but that doesn't mean all the blood went onto the killer! People are imagining a killer covered in blood and dripping all over the place, like in Carrie. High velocity spray, yes. Gallons dumped over the perp's head, no.

No idea, why take a child outside at nite in the back yard in the freezing cold?

Besides, I thought the theory was to drug her.

I am going by the amount of blood found on CY's feet from the bathroom pics.

I don't even want to know how much blood was in the bedroom where the murder took place, but I know how it was described.

That was enough for me.

BIG THANKS - to folster for the transcription on the jury instruction.

I wold read that to indicate - much like folks have said here - we defend and respect his right to consult an attorney and to NOT TALK.

However, when he testifies and answers all these questions (same ones that would have been asked by the police at the time of the murder and ongoing investigation) if it were that simple - what would have been the harm? Ergo..... I don't believe he is being truthful now.

I think that pretty much sums up my thoughts. Respect his right to lawyer up and not talk. But - if all the stuff he said on the stand was true - WHAT WOULD HAVE BEEN THE HARM???? If his testimony was the truth - why keep it a secret? That discounts his credibility as a witness and I don't believe his testimony is truthful or accurate.

We also know from gritguy that is unfair to ascribe his 100% silence to his attorneys instruction and that usually - an attorney would figure out how to keep pressure on the police and provide his client updates on the case without having to be questioned. And while the jury probably cannot consider that in their decision, I sure as heck can.

Thanks to all for the discussion on the finer points of interpreting "no talking" and how it CAN influence a jury's decision.

JY probably paid at least $5K for little Roger Smith's counsel. Possibly more. Heck for the low low low price of $1K I'd be willing to give the same advice JY claims he was told, to some potential perp. "Don't say nuttin' to no one, no how, not ever." That'll be $1,000 please.

So how would a stranger not track it through the house and why would a stranger care? If a stranger kills someone they don't usually take clean clothes with them. JY is the only one who would care about that. He said he was going to take a hit on the house as it was.

Yep, after he took 30+ hits on his wife, his next concern was the hit on the house. He probably blames his wife for trying to protect herself and live, thereby his having to escalate to beating her to death. And then, since she really pizzed him off, he needed to work out that rage, so he had to keep beating her head. In his warped mind it's probably Michelle's fault he would have to take a hit on the house in the first place.

otto, the point I think one side of the argument was trying to make was regarding JY actually admitting putting a twig in the door and the (coincidence) of an employee actually finding a rock wedged in the door the very night his wife is murdered/he leaves his room and returns without using a key at any door/CAMERAS unpuggled/moved/not seen re-entering hotel after smoke/missing shirt/etc.

Not the fact per se of the dna on the rock, if was the exact rock, if it is the one the employee says it is, etc.
The point being his 'excuse' for not needing his key was the twig he placed in the door... not a rock. Obviously he used something... probably not to wise to say he use a rock if he actually did. And what are the 'chances' of all these coincidences on the very night his wife is slaughtered?

The rocker/glider in CY's room was reclining and the music was on,which MF said was unusual.

My grade card on the trial so far: Pros C+ Defense B-

The state opened up strongly and began to lay out a very methodical case against JY.
They brought in witnesses to show the Youngs marriage was not happy, and that Jason was a bad husband.

Testimony from friends and family all painted the same picture, not pretty.

Now, we are in the heart of the case, the physical evidence, and I know we have a long way to go, but things aren't as good for the state as last week.

We also heard from the gas station attendant, and opinions have been formed as to whether to count/ discount her testimony. No comment.

Hotel employees all go in favor of the state, they are impartial.

Bathroom pics of CY show she may have been trying to clean her feet, and the clothes she had on still had blood on them.

Now, we covered the rock and the sheetrock.........not good or conclusive for the state.

Galloway testified to 2 things that could have broke the case open, the twig/bush door theory.

Phone calls showed JY made many, but more were dropped than connected, and showed he was on the route he was supposed to be.

The expert today, Jen Remy, could not connect JY to the crime scene, to the hotel, and the hair found in Michelle's hair was her own.

I couldn't call which way it would go, if the Jury got the case today.

I am interested in what you all think...

IMO he probably would have hit her at some point anyway. I don't really seeing him having too much trouble with her even if she was trying to loosen the grip around her neck, especially if he had gloves. If he didn't have gloves I could see how he might have hit her with something to subdue her. But then if he had a bat of some sort, or hit her with something else he brought along it would seem he thought he might need it. Or there is the possibility he hit her with something that was in his reach in the room, which could be anything. That might mean he hadn't planned to hit her with anything. JMO

Maybe it was from Michelle putting her to bed the first time.

SS testified that Michelle was having trouble getting her to sleep.

The rocker was on , but so was the treadmill.

Octobermoon tippy-toeing into the DNA part of the case......

IMO Any DNA of JY, MY, and or CY found anywhere inside/outside of the home proves nothing. They lived there. That includes the medicine dropper and water sprayer. JMO

Partial DNA on a rock by a door proves nothing. MOO

This isn't a case that will hinge on DNA.

(sneaking out before the 'maters start flying)

Possibly but not likely. That would mean she cleaned herself where? then got to where without getting bloody again? How would she have got in the bed?
Likely she would have been a huge mess IMO... my daughter didn't do that cleaning bit so well at that age.

One of the things I am going back over tonight is the reverse trace findings. (They were really dang thorough with this puppy.)

Does anyone find it odd that no evidence from Hillsville made it's way back to Raleigh?
