Actually, it came out a little differently in court.
Jason did not contact anyone about trying to collect the insurance money.

Here is what she said:
Jennifer sent notification to Jason Young advising him he was listed as the beneficiary on MY's policy.
She sent him a letter to sign and asked him to return it with a copy of MY's death certificate, which he did send back.
She then forwarded the claim form to Prudential who then informed her that they could not pay out to a beneficiary
if they are considered to be a possible or potential suspect.
The money was later paid to LF for CY.

So, it is not like Jason initiated the claim himself, which is what I think the Pros wants the Jury to believe.......

Again, they can not find a motive that sticks.

I need to find the link to David Saacks closing from JY Trial #1. I specifically remember he made a point to talk about JY's hand print on the sheetrock and how the blood splatter managed to not hit that print. Then he literally acted out how that would happen, showing him putting his left hand up and braced on the wall, and then bent over beating MY on the floor. I remember he said "think about that... blood spray going all over the wall...but none of it gets on the hand print. Now why would that happen and how could that happen? Because JY's hand was on the wall as the blood was spraying. Common sense."

VERY effective IMO. I remembered it.

Just THAT in itself is enough to convict. I mean, really. What OTHER plausible explanation could there be?

Except isn't the state's theory is he had gloves on, because if he did not have gloves on, then his hands would have scratches, right?

Because MY tried to pull the hands of her attacker off her neck.

Although, now there are no gloves in the hotel photo, which never made any sense to begin with.
Why would he take gloves in the hotel, when he didn't need them unless it was to keep the cigar
smoke off his hands?

BBM - I totally forgot about that. I agree with that statement.

But, regarding the gloves being in the hotel. I am not 100% certain they weren't. The picture in the hallway does look like he has something inside his folded newspaper, but I just can't tell. If you (JY) were by yourself at the hotel, why would you care if you got cigar smells on your hands? Nobody smokes with gloves, do they? That seems like it would be a little bulky. But I don't think he went out there to smoke anyways, so it's a moot point.

Seriously, frank, are you familiar with the neighborhood? How likely is it that anyone, other than someone familiar with the victim, would choose that house? And that there be no signs of forced entry? And no sign of any sort of struggle other than in the master bedroom?

No burglary, no robbery, no sexual assault. But a brutal, brutal beating, mainly to the face and head. That is a personal crime. An intimate crime. And certainly not a random crime, IMO.

Big difference in a theory and a proven fact.
Most use common sense when they consider why he had no scratches on his hands.

I think she was bashed over the head as she slept, and what ever feeble attempts she was able to make were just that, feeble and ineffectual. When one takes that hard a blow to the head, it's like being cold-cocked. MOO

Michelle had marks on her neck from her hands, and she somehow got her own hair in her hand..

If only the hair had belonged to the attacker.......

Why did the Pros allude to MY fighting for her life in the first trial?

They might not want to do that this time around, come to think of it.

Not when the defendant has a perfectly clean NTO.

I did not say there wasn't a struggle. I said, after having ones head bashed in, the type of *struggle* one is able to put forth would be *ineffectual* to say the least. Michelle was 5 months pregnant, and just over 120 lbs. She was bashed over the head with a weapon hard enough to knock her teeth from their sockets. I don't find it at all unreasonable for her to have never gotten in any sort of punch, scratch, wound to her attacker. The most she was able to do was reflex grabbing at her neck to get air. MOO But backed up by the viciousness of the attack upon her. The ME's testimony of the horrendous injuries she suffered. The first responder said "the amount of blood in that room was proof enough for him that she was deceased.'

Wow. If you are being serious that might be the most preposterous thing I've read. A rapist looking for an athletic brown haired woman just happens to know there is one at 5108 Birchleaf. Since he knows she lives there he's been following her but didn't notice she was 5 months pregnant? Breaks into the house, discovers that she is pregnant so he beats her to a bloody pulp, avulsing her teeth THROUGH her jaw. But he doesn't leave any trace of blood outside of the bedroom because even though he was in a maniacal rage (because she "ruined" his sexual fantasy) he had the presence of mind to leave the rest of the house spotless. But he also stole $500 from Jason Young's closet, thought enough to plant the Hush Puppy prints to frame old Jay, clean up the little girl, put on a CD for her and even give her a sleeping medicine! Then he turned on the hose just to run up their water bill. Oh and he also drives a light SUV...yeah, Okay

ETA: and just like Jay, this theory places blame for Michelle's murder...on Michelle. Why did she have to ruin the rapist's fantasy?

The defense wants gullible and/or stupid jurors to believe the killer had to be covered in cuts, scratches and bruises. Hopefully they will think outside the box and realize this poor woman was asleep when her husband slipped in at 2:30AM and slaughtered her. She could do nothing but attempt to pull his away his chocking hands and then use her hands as a shield, as he swung his weapon 30 times across her skull.

Everybody from the person cutting meat in the deli to the the maid at the hotel has disposable plastic gloves. There are boxes of these gloves on the maids carts and they would certainly be easily disposed of with little notice.

No great news that gloves were not spotted in the pictures or found. He tossed them.

And if you can find them you'll also find the missing pullover, the brown Orbitals, whatever he used to bash in her skull and a plethora of more evidence!

But on his way to the mountains I have no doubt he found a nice, remote location to dispose of all of it...
