Finally, a defense witness that isn't scripted.

DT trying to raise reasonable doubt, but IMO it backfired big time. The car was NOT on Birchleaf, it was several streets away on Enchanted Oaks.

Not sure what those driveways are made out of in that subdivision, but when we had asphalt drives we'd park our cars across the end when they got resealed... it wasn't unusual, everyone in the neighborhood did it who had asphalt.

So with Gracie, we aren't to believe her because LE didn't show her a line-up of photos, but JY's.

Yet, we're to believe this little lady although LE took her to the house and THEN she said that was the house?

ok,
fran

PS....she said this was the only road out. How many houses and people live in the neighborhood? Could have been anyone. That time of morning, lots of people can be out.

WOW. My thought exactly. Bring back Gracie. jmo

I think I was enjoying the laughs too much because now I'm confused.

Birchleaf and Enchanted Oaks don't even intersect. I don't think she really saw a car at the Young residence.

So she saw the car in the Young house driveway, just not on Birchleaf???

  • #429
I think the DT brought her in hoping jury would forget PY testimony. jmo

Brilliant thought!! And I bet it worked! I was just telling dh about PY testimony via text, and I totally dropped that line of texting to tell him about Mrs. Hensley!!

Why? I am curious.

She's well-timed (in the line-up) and blunt. The judge likes her, the jury likes her, she is not attached to the case other than saying she saw a car/SUV that was odd. The pros can't get her to say it's his car. The defense doesn't have to get anything else out of her.

Speaking for myself only, I wouldn't put much weight on this testimony - partly because I'm not really sure what she actually said/where the car was. So it wouldn't be any more credible to me than Gracie's testimony, which I didn't find credible at all.

IF I were on the jury, for me anyway, this works for the prosecution. Shows LE was very thorough in their investigation. Talking to all the neighbors and being sure they weren't missing something relevant.

This little woman is a sweetheart and a good witness.

For the prosecution!

I am confused. Did she see it at Birchleaf or another address?

She saw a car in a driveway on Enchanted Oaks Dr. at 6:15 am, it was gray and had no one in it. Nothing close to what the other neighbor testified to, Cindy B said it was a van with 2 people in it on Birchleaf Dr. at 5:30 am.
What a joke.

Agree...............she did the best she could do.

She said Spivey took her to the Young home.

It will be up to the Jury to decide.

But, she was priceless ..

So did the DT tell her that house was the Young house? Or did LE? That's what I'm confused about. But with her spunk I don't doubt she saw a car parked strange that day, it just happened to be on the wrong street. Strange though that she says Enchanted Oaks is the only way out... clearly it's not from googlemaps.

Wouldn't the timing have been way off anyway???

Each defense witness is reiterating how nice Spivey and the others were, how nicely they've been treated, etc., etc.

She made it clear the gray suv she saw was in the front of Young's house, which is located in the Enchanted Oaks subdivision.

I think you are right--I was surprised there was no clean up of PY's testimony through redirect. They wanted Ms. Faye on before lunch for a distraction.
