Right, and her testimony also does not jive with the other defense witness CIndy Beaver who says she saw a van with 2 people in it at 5:30 am. This witness has the address wrong, said it was a gray SUV with no one in it at 6:15 am. Not a credible witness !

Except that she adamantly stated it was NOT on Birchleaf, she saw the car on Enchanted Oaks drive. She was quite clear about that point. She's been living in that same neighborhood for 20+ years. She would know what street she was on. That is important, IMO.

Agree...............she did the best she could do.

She said Spivey took her to the Young home.

It will be up to the Jury to decide.

But, she was priceless ..

I agree,strange how age mellows some people out. Babies and elderly bring more smiles then anything next to our pets.
Cammy, I believe Spivey will be recalled to the witness stand by the DT. What say you?

Yes she was insistent on that. I feel IMHO that at that moment she became a PT witness.

Yeah I wish they had outlined her route...because when she said "Enchanted Oaks Dr" Klink repeated "Enchanted oaks subdivision" so it's sort of confusing what route she drove and where the car was.

I think there are a couple of other witnesses whose testimony was a bit more useful in the first trial. Hopefully the postal worker will testify soon.

I think the jury will be more focused on the fact that this lady saw a car parked in the driveway rather than what route was involved. The other witness' accounts will allign nicely.

If they had worked out a map for the jury of the route she took from her house leaving the neighborhood, and then shown where the SUV was related to that, it would have been much more clear. Maybe that's what BH had but it seemed like her display may have just shown birchleaf dr to show the orientation of the car related to the house.

Miss Hensley's testimony is in quotes... she clearly did NOT see the car on Birchleaf in front of the Young residence.

And yet everyone used the same argument AGAINST Gracie, that she couldn't possibly remember seeing him 5+ years ago.

You're right, but she was also quite adament that is was not Birchleaf drive. Since the Young's house was on Birchleaf, it tends to undermine her conviction. If the DT does not ask Spivey about it, well...

she did not state "the car was not on Birchleaf." I had no problem finding her credible or believing she saw a car in the Young driveway and I'm betting the jury will, as well.

I hope the defense recalls Spivey on some other issues as well.

Remember, Cindy Beaver will testify to a "soccer Mom type car" leaving the driveway......at 5:30 am,
and Mrs. Hemsley's testimony puts one there at 6:15. (depending if the Jury finds her credible/ reliable)

This is how I think the defense will go after the possibility of Michelle's Lexus,

(SILVER) being taken from the home, which ties in with one of the state's

theories and *search warrants that CY was taken from the home in Michelle's Lexus as well.

(Search warrant issued 7/24/06 for Michelle's car due to the clean condition CY was found in)

She has also been sick. I doubt she is able to drive anywhere now. Five years can certainly its toll on a elderly person.

If you did not enjoy sex, why in the heck would you go so far as to have a kid and marry a man? I think it is safe to say that something changed in MY's mind or body that she did not enjoy sex. Hormonal changes could be part of it. Or she could have developed good sense. I don't think this line of questioning hurts or hinders anything.

MY is not here to defend herself. Other people saying she "did not enjoy" sex are hearing this from someone other than Michelle herself. And if she, in fact, didn't enjoy sex with Jy (no less) we do not know Why bc Michelle herself isn't here to tell us. Could be how Jy treated her and not hormonal. We don't know.
