Also, I wouldn't look for Howard to be receiving any strawberry pretzel salad this year from Brevard.

I thought it was an excellent cross... as a newbie to the case it was like watching two different people:twocents:

I hope the defense recalls Spivey on some other issues as well. Remember, Cindy Beaver will testify to a "soccer Mom type car" leaving the driveway......at 5:30 am,and Mrs. Hemsley's testimony puts one there at 6:15. (depending if the Jury finds her credible/ reliable)This is how I think the defense will go after the possibility of Michelle's Lexus, (SILVER) being taken from the home, which ties in with one of the state's theories and search warrants that CY was taken from the home in Michelle's Lexus as well.

Problem with these two witnesses, their testimonies contradict each other at every turn ! Cindy Beaver (who didn't even report this, her boss did a week later) says it was a van with 2 people in it at 5:30 am, Mrs. Hensley says it was a gray SUV with no one in it at 6:15 on Enchanted Oaks Dr. !! Sorry, neither one is a credible witness !

she did not state "the car was not on Birchleaf." I had no problem finding her credible or believing she saw a car in the Young driveway and I'm betting the jury will, as well.

I'm still confused by this witness, but there are a couple of others from the first trial whose testimony was very clear. I remember a postal worker along with a newspaper delivery person or two. Hopefully they will come up soon.

Wasn't it testified at one time that Michelle's keys were found on hood of a car? Memory is bad on this one, may have been at last trial.

I totally agree. PY was completely different than yesterday. I was wondering how she did on the cross during the first trial.

I have lived in my subdivision for 8 yrs & dont know all the street names, but I know where people live.....

Yes, I think the defense is laying it all out now in an order the jury will have no trouble following.

Yes, and the one thing Mrs. Hensley said it was a gray car.

Gray being close to silver.

Heads-up, I may have changed my mind on the previous witness.

I looked up her address and Birchleaf (not Enchanted Oak Dr) is in fact the way out of the neighborhood for her. When she said "its the only way out" she was talking about Birchleaf, and that route takes her right past the Young house.

What good would it have done? All witnesses can be asked leading questions on cross exam. That's the benefit of asking the Judge to allow them to be treated as a hostile witness, that you get to lead them with your questions.

I sure wish they had narrowed the TOD some.

Mrs. Hensley was brought in now for a distraction from the
unbelievable/untruthful testimony given by Jasons' mother. On this board Mrs. Hensley just got 5+ pages of posts !! So, it worked here, hope it didn't work as well for the jury.

This is my first retrial, so I am waiting for that big impeachment moment or the charging of a hostile witness.

Had HC declared her hostile , I see what you mean.

She would still have passed the Young house, but her reference to "the only way out" makes it seem like she is talking about the straight shot out to Penny on Birchleaf. Hmmm...
