I know you can't use them not testifying before the jury against a def.

Actually, I think you CAN use it them not talking to LE from Day 1. IF you couldn't they would NOT have allowed the pros during the first trial to emphasize the fact he hadn't talked in 1000 + days, until his murder trial.

I also believe the def NOT talking to LE also goes towards them keeping him in mind as a POI.

Please check your source and let us know. I'd like to know the answer to that.

iirc, in the first trial, the Judge issued a jury instruction that they could only use his refusal to talk to police to determine his credibility. They could not use it as evidence of guilt.

edited to add: there was much testimony from friends/family that JY was advised by the friends to lawyer up before he got back to Raleigh. That's why the Judge issued that instruction, imo.

He's doing a bang up Perry Mason style job with this case. You should have heard him, maybe you did, during the BC trial. I honestly thought I was going to have to quit watching because he drove me completely crazy. Had Boz, the other ADA not been so darn good, I probably would have quit watching and just read on here from day to day.
HC is the lead/senior ADA in the Wake County DA's office. I think JTF said the other day that he's 58.

Do you happen to know what case Boz is on right now? I hope it's an important one, as it seems he may be all CW has. :(

I have a strong feeling the jury has already been lost with this witness. It is important information HC is trying to get out of Mr. G but he's doing it in what seems to me in an unorganized, long and drawn out manner. I'm losing interest and I know how important this is.

The ABC trial feed's volume is too low. I noticed this during the other trial. WRAL has normal volume but the feed times out about every 12 min.

I have my WRAL volume up. IF I'm on this page and not the actual live feed, but listening, there's like a *ping* that happens, meaning there's that timer for 60 seconds and you need to click to continue. (it asks you)

Just roll your curser over the video feed every five minutes or so and it shouldn't do that or stop the feed to your computer.

Kathy something....I had her last name and lost it that quickly. Darn headache.

Thanks Fran, I know about the WRAL timeout ping. I just loathe it though. It makes me jump every time (not in a good way).

There were cameras at the gas station, they just were not working that am.

Wonder if he knew they were not working then? Had they been 'not working' for some time?

Kathy Taft and I believe David Saacks was taken off this case to work on that one.

Saacks is good.

Also a native yankee here. But I've probably been down here longer, becoming more accustomed to it now. I'd give anything for Frieda right now though. Man, wish I could listen to her in this case! She'd have a hayday with the swallowed wedding rings, I can hear her now. :floorlaugh:
