Most interesting thing to me this morning, Meredith's cell phone number written on the page for Southern VA/NC in the ATLAS. Knew he'd need it to call her to "rescue" C---- and find Michelle's body when he was on the road?

Now they're questioning the statements made by the gas station attendant and her id'ing of JY as the person she sold gas to that day.

She at first didn't give description of person. Only described clothing one time.

He's trying to impeach the gas station attendant's id'ing of JY. I doubt it's going to work.

The def attorney is questioning her testimony that she id'd JY but not the other customer in the store, (regular) that was there during the angry exchange between JY and the attendant.

He's questioning the transactions on the spread sheet, leading up to the $15 trans, 5:27 that am...........from 5 to 5:27, eight sep trans., per spread sheet attendant said at that time, if cash had to come in........8 transactions during that time. yes...........up to 5:40 a.m. five other transactions. Yes......tried to cooberate this regular customer and find out who he was. So far as to created flyers and asked if person saw the event on 11/2 to come forward. On store window, doesn't know where else. No cantact to LE was made. SBI set up video camera to try and id who the customer was. yes. The video camera was set up for 60 days, yest 11/07 to 1/07 ? LOL no one ever id'd. no sir, correct.

April 8th, '09, went up with other officer to interview attendant. At that time she said there may have been someone else that morning, paper delivery person, but she wasn't sure. Officer, witness doesn't remember specifics. LE contacted paper outlet and still unable to id the deliver person. Other than her stating it was the paper deliveryman.

Reciept from Va.,,,,,,,,,,,,,,,,amt of gas, 19.452 gal. yes sir......ex 65, receipt from amaaco in burlington. yes sir. What is amount? 18.441 gals.

Question by me! have they brought up mileage per gallon of JY's vehicle? :confused:

I am thinking an exhibit would have been most helpful here to tie all of this together.

I agree. I'm a visual learner. I tend to zone out while people are talking for a long time. An visual exhibit is always the most effective device for me personally. I'd love to see the prosecution bring out a timeline of JY's alleged actions on that night/morning.

Reviewing photo of child's bedroom......hutch of C's bedroom. You noticed adult Tylenol? yes, sir............red liquid, yes sir,............had red liquid tested.....medicine cup on top and sets on top of bottle. Medicine cap tested for fingerprints and prints did not match to JY. Didn't match to anyone for known fingerprints submitted? only dna on stopper, whatever, C's, yes sir.

Pam cough PD for children? Witness said he hasn't seen anything saying that. Water bottle, Aqua Fina? correct........

NOTE, IMHO, of course his prints weren't on those, he wore gloves, IMHO!


Collected crime scene info. Interviewed witness statements. Meredith Fishcer had inconsistancies. Yes, there were some.........you asked other witnesses in this case about inconsistancies, yes sir. Colleen, about inconsistancies, for Meredith yes sir.........:mad:

Inconsistant statement about key to Lexus. How she got her key out of the crime scene? yes, in photograph on hood of car. Car driven by Michelle. Ms Fischer said she left her keys on the counter but they later found out keys on Lexus were Meredith's. Bloody paw prints in the house, inconsistant statement of Ms Mosinger? yes sir..........showed her photos from crime scene and tell where bloody paw prints, yes sir. Obj, sustained!

One person interviewed was Meredith Fishcer, a few times. yes sir. both formerly and informerly. yes sir. One thing she indicated to you and det blackwell, a month before that happened Michelle Young and Mr. Young heard noises outside and while JY was out of town. Michelle was scared one night when JY was out of town and asked Meredith to come spend the night? don't recall.,,,,,,,,,,showing him documents, statement reports? 96 for id'ing, witness asked to read silently. ok........refresh recollection, that's det Blackwell's report, I don't recall that being said.

witness present for SBI interview of Meredith, yes sir. SBI headquarters. witness observing per closed circuit tv. Ms. fischer saying C coming out from bedroom she said C didn't have diaper on? yes.......pj bottoms but no diaper. not wet...........yes..........she said C would remove her pj bottoms and diaper and not put pj bottoms back on. yes sir........witness doesn't recall Meredith saying blood on wall was still wet.

efforts to id the regular customer? yes..........the witness clerk was not working there at that time. she wasn't asked to view video. too much video. Did you follow up with Winston/Salem journal. Agent ???????? did it, not me.

Asked about spread sheet and diff transactions, 8 diff trans, witness going through documents............8 from 3- 5:27 ..........5- 5:27...........other transactions listed were they cash or mix of cash and credit? mix of everything. you can tell gas and total price they paid is indication of mixture of purchases. 5:37 and 5:36 transactions, 15 and 20 respectively, only cash transactions and only fuel purchase during that time. Earlier there was but they didn't involve 15 worth. They were different amounts.

Regarding Meredith and car keys......photos of her keys on kitchen counter, yes..........ma'am..........that's all

Pros will publish exhibits.............after lunch and then proceed. Keep open mind, haven't heard it all..............follow instructions.................blah, blah.................see you at 2:15, 1 hour and 15 minutes.

Judge said evidence sufficient to take to jury. Do you have witnesses, yes sir. Publish exhibits and requests pros to put in order and make copies in lieu of having originals....

IIRCC, we discussed this here. This product is NOT tested as to it's 'effect' on children.

IMHO, then it's NOT for kids until the fda has done the proper testing, or the mfg has done the testing.

Everyone said JY IS a good dad. What 'good dad' does anyone here know, who would give a product that's only been tested and results noted for adults, and give it to their little ones?

I believe that's part of the pros closing job. I remember they did JUST THAT during the Peterson trial and when I went to the Runnion case trial, they did that as well.

When everything is put in perspective, AFTER all testimony has been given, and it's put into somewhat of an itemization, it's very compelling.

I believe almost every jury would definitely be AWAKE at the closing. They may even see something they thought insignificant during trial, the closing shows it's a BIG part of the puzzle of the crime.

Each juror needs what they call the 'hook.' hook = the one item of evidence, both direct or circumstantial, that there is NO OTHE REASON for that, except the def is GUILTY! Then all of the other circumstantial evidence presented by the pros all falls in to place and you have NUMEROUS circumstances that reiterate, there's no coincidence when it comes to murder.

I had an appointment this morning and was unable to see any of Spivey's testimony. I just want to give a huge :gthanks: to Fran and everyone else who posted details. I feel like I'm all caught up for now until I can watch the video tonight.

I agree with a master display at end. However, this witness needed an exhibit to tie in just what they talked about today. IMO. I thought PD stood for pediatric dosage. I could be wrong. In any case, that should not have been left in CY's room.

Again, fran, ITA - It has GOT to be delivered in their closing argument! Maybe they'll have neon signs or something -- a big brass band.

Even tho this trial has been relatively short and on topic, it has presented a lot of stuff to chew on. And, of course, it's not over -- where is the DT's investigator, today -- is he warming up their brass band??

The ADAs need a big fat out-of-the-park jamburger (thanks to WRAL's Tom Suiter, and apologies for mixing my sports metaphors) to score this one with all jurors. No doubts allowed. <sigh>

It worries me a little...

I still don't think the location of Meredith's keys will even be a factor to the jury. She was told, while on the phone with 911, to take Cassidy and go outside to sit in her car until someone arrived. She states, when she gets to the garage, that there's a fire truck outside. Therefore, no need to go sit in her car and she probably absently sets them down because she has her hands full holding Cassidy and talking on the phone.

If all the defense has is innuendo against Meredith, Jason should just save the state some money and go ahead and plead guilty.

If anyone missed it this morning, Barry Saunders' column in the N&O was pretty funny. It's about Michelle Money and her whining.

That's exactly what I was going to say, fran. The way I recalled it, 'this product was not tested for children', just as you said. Back in the day when my kids were little, *we* of my generation weren't as stringent on giving meds to kids. I remember my pediatrician always recommended St. Joseph's Aspirin for children'. my daughters are far more cautious with ANYTHING they give their kids. Absolutely NO *guessing* on the amount. Back in the day, my friends and I would just use a regular tea spoon to measure liquids, no droppers with ml's. etc. I can't see Michelle dispensing something to Cas that wasn't tested for children. Especially since the friend from the night before made no mention what so ever of Cas 'being sick' to begin with that I recall?

Nope -- even the sign is the same, which our Chad probably wrote so that he wouldn't get 10 million call & msgs....
