Mrs. Y being questioned now about family arriving back in town. They had been discussing Thanksgiving and her understand that J&M&C were coming. Previous discussion about Michelle's mom coming and she said she was shelfish with her time with J and family and she didn't want them to come. :(

Doesn't recall discussion about Xmas. Where? Her family would just celebrate Xmas in January sometime.

She talked to J thurs nite and she knew to expect him Friday. When he arrived at her house that day and he got out of car and jacket slung over shoulder and she went outside to meet him. He was there 1 hour or 1 1/2 or so before leaving. Over who was in car.

Getting ready to go, they added their suitcases to car. During time J at there house, he didn't take anything out of his own suitcase. At Mills River by 5, 1/2 hour from her home. She was in back seat with J. Laying head on her lap and he had his eyes closed. She told LE he had slept back.

Four phones in car, each person, she believes. At some point she understood that LE wanted to talk to LE. Made call for asking if on way. She called LE back, but doesn't exactly recall. They were given directions to LE, she doesn't recall. Remembers conversation they were on way to sheriffs dept. Confusion on LE knowing they were coming. Confusing time for them.

At some point she got on phone with sheriff's dept and told them they were not coming? She doesn't recall that. She denies she told LE that SHE would not talk to LE without an attorney. Went to sheriff's dept and she provided info, willingly. Not forced to go down. She encouraged J to go? Before spoke to????he said he would go on Monday with his attorney. She respected that and didn't recall attempting to persuade him to go that night. She doesn't recall trying to get him to go that night because he'd said he'd go on Monday.

When she went to sheriff's dept and asked about message she'd asked of Meredith. yes................left message...................she had received info from def that morning asking her to get a hold of M and she doesn't recall ever calling her previously. She had to be given phone # by J, yes........that was in response to his contact with her the morning of Nov 3, she got a message...........called and told Meredith what J had said. His records showed he'd made several attempts to call. He spoke to Gerald?

She doesn't recall if just message or believes he spoke briefly with coming there, etc.....not long conversation.......when she spoke to def Thurs nite had he mentioned anything about Coach purse? no, not that I recall..............when was anniv? Oct 10, doesn't know.......doesn't keep up with anniv like bdays. Now we're into early Nov......yes.

Def left message asking her to contact Meredith. M to go by house and pick up Coach papers. etc...............Shelly and Michelle had interrupted him when he was printing so he thought he'd turned them over on desk. Thought he'd put them in his brief case..........he called and asked if she'd been able to get hold of Meredith? yes, briefly and said he was on his way and can't wait to get home, etc.

By question about Meredith, she'd left message for M and told J when he called her back.

When she was talking to detectives 11/3 and 11/4, they told her it was important J call them to go over anything that could be missing from house. She told them he was asleep and he'd speak to them with attorney. She and J stayed in Raleigh, after funeral, for part of next week after Thursday funeral. Perhaps until Wednesday, waited for car release and their things that had been taken.

Her talking about relationship of J&M....she told LE their first year rocky. She told LE M had been depressed past few months because she'd had a miscarriage. Mrs Y could relate as she'd had miscarriage also. When waiting for LE to talk to her, LE asked her about Michelle MOney and she told them she'd never heard of her. She thought they'd looked at her xmas list because in car she had Michelles name and the word MONEY by it, as she'd asked for Money that Xmas.

First Fischer visit with C and J took her to Charlotte. Then visits took place at Holiday Inn Express. J not present. She and her hubby were there and friends......who's decision to not allow Fischer's alone with C. It was her and friends decision. Couldn't go to bathroom alone. Last visit at her home, the Fischers were told they needed to stand up for J. She said they asked about news articles and Meredith said she had some questions for J to answer and mom said she thought that fair. Def not present during that visit. She didn't recall if she told J about M's question, wanting to answer M's questions.

I'm going to get flamed for saying this. And I think JY is guilty.

BUT... From the testimony (and emails) thus far, I understand why JY had an issue with LF. She seems to be a loving mother but also a needy person. She overstepped her boundries constantly and was intrusive in their lives.

I don't believe this behavior was in any way malicious on the part of LF. However, her visits and expectations were excessive. Her own daughter had issues with LF spreading her own news (pregnancy, then later gender of the baby), and her daughter stated in that email that her mother just didn't seem to get it no matter how much she told her. Contacting her daughter's mother-in-law to relay an argument was not her place.

Telling false things to the media...I get the concern.

Completely understand their issues with LF. Now when it comes to MF, I don't understand why she would have been kept from C. for any reason. JY himself stated "thank god for Meredith", and talked about what a good head she had on her shoulders. JY had great respect for her.

Her memory is so much better for JY's atty.

I'm not sure it's intentional. She probably got a list of "talking points" for her direct, so she had time to think about her answers. She definitely didn't get that for cross!

That visit was when the Fischer's were cut off from C. That was when Fischers went to see lawyer. She understood that by giving up custody, J wouldn't have to answer questions (under oath, my words).

moment......................for pros disc......looks like pros going over notes?

With regard to def and 7:40 a.m. call, did she speak to him? no.......she was feeding her mother at that time. During their marriage, three years, was she aware of friction and conflict between LF and J? yes..............J would talk to her and they would discuss that. Source, J, he felt she spent too much time there and he didn't need her visits for so long. She knew child care for new baby being discussed. Having LF come and move in with them and take care of baby. Was that resolved? she believes still being discussed, not positive.

Had J expressed concerns about LF moving in with them? yes, he didn't want someone moving in with them. Does she recall speaking to LF the weekend of the wedding? yes, LF called her. she recalls LF saying Michelle was upset and calling and LF was upset and she (J's mom) became angry at J and she wanted to talk to him about it. She doesn't recall if LF had said they argued all the time but LF was concerned about this argument. Did she tell LF what J said about lack of sex in marriage. J had told her about it, but doesn't recall if she talked to LF about it.

pause....................

About Brevard, since custody order, she has had opportunity to visit C. not persuant to court order LF let her....yes, correct.

redirect by def......about returning home from Va, did she know about it prev? no...............but did know about him coming sometime to get it but not when. Hoped for Thanksgiving. She didn't know if he was spending the night etc, he had to talk to Michelle for overnight. He called and talked to hubby when she was taking care of her mom. Not unusual for J to change his plans.

Visitation that Fischers had with C and why not allowed alone. Couple of reasons, because LF was angry and accusing J, they had read those things and didn't know what they might say to C and put in her mind. Also she believed they might take C away.

Judge verifying her last remark. She thought they'd get in their car and drive away with her? yes...

Her memory is so much better for JY's atty.

I felt she was a reliable witness and was honest. I've been impressed and felt all the witnesses were honest in this case thus far.

With one notable exception...MM.

I asked at the end of the 6/20 thread but will post again here... Do you think we'll see Ryan Schaad take the stand as a defense witness? I don't buy PY's story that he told JLY to lawyer up before he even saw his daughter.

Alternatively, does the prosecution have the right to call rebuttle witnesses? Meaning, could they call him to the stand to dispute that statement?

Ryan and Shelly Schaad are in the courtromm so I believe Ryan will be testifying

Now we see where JLY gets that excessive blinking gene.

I noticed it, too. I matched her blinking, just to see how it felt, and actually got a bit tired! She also looked down and to her left... hmmmm

LF may have been overly in their lives, but JY's mom was too. Hour phone calls with your mom seem a bit excessive. The only difference is LF was there in person. In any case, thinking that LF and MF would kidnap CY is a bit excessive IMO. And, honestly, nothing justifies cutting CY's visit with LF and MF.

It seems clear to me that JY's mom did not want to include LF in their Thanksgiving get togethers. How truly sad that at that time of year you would exclude someone because you were selfish with your time with your son and his family.

I can tell you from personal experience that the media does NOT always get details correct or even quotes. So if something is wrong in the media, it's not necessarily because the person talking said it that way. And on WRAL, specifically, I have found numerous errors.

J's step dad on stand. Gerald M. They were married 7/14/95. He'd spent time with J up to that point and whole family.

He was in Brevard and got phone call at 7:40 from J. He said he was coming to house to get ????? and taking it home with him. Pat got call from LF and said Michelle was dead. They were both devastated because M was preg with grandson and J excited over it. He still hasn't got over it because part of J died that day. {imho, seems emotional} describing telling J that day........he told him...............J, M is dead. He just about went to the ground if he hadn't caught him! He doesn't know what other reaction, J started crying and broke out in tears and got him in house and had him sit down there and he was concerned about J. He was still crying when he left. About 1 1/2 hour later. Naming people who arrived.....who driving? discussion but he doesn't recall that much about that, he was concerned with J. He didn't go.

Def done.

Does he recall in 2/08 when SBI came to his house? yes, that's when they looked in J's bedroom. J was living somewhere else. They had to meet him on side of road with his mom and LE told him what they were looking for? he doesn't recall. He got on phone with J before LE talked to him? he told J not to speak to situation with LE unless he had an attorney. yes mam.........

Does he recall 5/07 speaking to agents in Raleigh? he doesn't remember that. Doesn't recall coming to Raleigh 2007. Astro, remembers going to Arden to lie detector test. He took lie detector. He said he'd stick with his family to the death.

State done.

New witness.

Heather Young, sister, younger than J.

grew up together in same house. Mom described him as imp, do you agree? yes....he would constantly tease her and everyone you knew. lot of fun to be around, people person, people drawn to him. he'd have you laughing in minutes. she went to college after him. She's a preschool teacher or something close. She has two children 08 and ?????

Smiling, talking about how much she liked Michelle when she met her. Did she notice friction between J&M? no but heard about it from mom. sex, etc......did she discuss with J about him having child, he told her on phone and she was surprised he was so excited. She thought of big kid having little kid. He was an awesome daddy. he told her he and M were getting married. M had to have C section ...............

Ahhh...........she's weeping talking about M having C and how incredible it was (to see J so excited)......j's eyes just lit up,,,,,,,still weeping talking about interaction of J&C..........did he tell you about boy? he did and he was excited. He said he and M had talked about having several kids.

Asked about learning about M.....{she's weeping, heartbreaking, she liked M} normal reaction, imo, she didn't believe it was true and had to make phone calls to verify and wanted to know why? how? etc.................she called her hubby.

When got to mom's house went through downstairs and she saw J and he was slumped back with blanket over him and he was pale and lots of tissues around him. You would have thought he was sick with flue. he looked awful. She put her arms around him and said how sorry she was...{weeping}....:(

sorry, gotta leave for a few, bbl, fran

It would appear the Young family were as involved in JLY & MY's *business/sex problems/etc., as much as LF was. JMO

I can't believe she would question MF's actions at the crime scene. I thought she did great. I am not sure I could have handled it that well.

  • #36
So on the way back from Brevard, they are thinking natural death...sure, that's why JY lawyered up so quick. Not.

That says it all - she never tried to ask JY about what happened to Michelle. And he never mentioned it. Cold.

Especially after herself had just said that at first everyone thought it was a natural death...obviously Meredith thought that as well.

Fran, you can't leave! How am I going to get a play by play from the trial?? :)

Selective hearing is always interesting to me. Guess she missed the part where the 911 operater was instructing Meredith of what to do.

No doubt, RC. Selective hearing and selective questioning. Both seem to be present here.
