What did the delivery guy testify to? Anything? I don't understand.

And that one of the defense witnesses talked about a white minivan in the neighborhood. Well, guess what he drives to deliver papers - a white minivan.

Oh, video back on but they are going to have 15 min break and come back and do charge conference. They met with judge last night and asks them to give any written requests. def already has written requests.

Each time the camera shows the courtroom, I get a knot in my throat for M & L F. I hope they do not feel as let down about the cross exam as some of us. Gosh, I just feel so badly for them anyhow and don't want them to come away from all of these years, and this trial, with a less than satisfactory feel for the way the State handled things.

I agree that BH did not press him hard enough. She chipped away a little but she did not really get under his skin. I wonder if she was afraid of alienating the jury. She certainly had a golden opportunity to break him down big time.

Also, I remember Cindy Beaver saying that the normal N&O carrier drove a car, so she thought the van must be a substitute. In truth, the same guy was delivering in her neighborhood in his van every morning for years, so surely she must have passed him many times on her way to work in the early morning hours. Casts doubt on her reliability and memory in general.

Where is Frieda Black when she's needed????? Damn. I can't believe she's already done. Unbelievable. She had him handed to her on a silver platter. :(

All I can say is that this ain't her first big round-up, and I can only ASSume there is a method to her madness. I would think she would at least throw his lies on the stand back at him. She had quite a list, methinks.

And I thought the N&O delivery man was a plus. It may wipe out that one juror's doubt...

Cindy B's testimony was diminished, but the N&O guy also never noticed that all the lights were on in the house, which was a very unusual occurrence. Net/Net? They may all cancel each other out.

I for one think that would have been interesting! He would have been like a pitbull with a bone. He most certainly wouldn't have given up after 55 min.

Agreed. As much as I don't think Boz's tactics are always professional, he would have torn into the defendant with a personal vengeance.

BZ is young (no pun intended) and unseasoned. But he'll learn when to use a softer touch and when not to. He's brilliant and that's not going away. And he's not afraid of confrontation, also a plus. And yes, he would have torn into JLY and not whiffed the ball to him.

I agree about the N&O man. Hopefully his short testimony will diminish the others' about that morning. Actually, the more I think about it that way the more of a positive I can see for the prosecution.

I think he's guilty, and will likely get a guilty verdict. There is a part of me that is nervous about that, knowing how unpredictable jurors are. There very well could be a hold out. I don't think it will be a quick/easy decision. I would be shocked if we have a verdict before the weekend.

I always think the prosecution has to weigh alienating juries by being overly aggresive with a witness . JY, IMO, appeared a little hostile, but so was BH. I believe she backed off because all of his answers went back to "no talking to LE or anyone". He seemed to have an answer for everything. But she can use any of this for the final closing remarks.

Charge hearing.

Evidence to support any other charge other than first degree?

Pros said no evidence of anything other than first degree. NOT second degree. Def agrees.

Judge says evidence whoever cause death of MY intended for her to die. This was an intentional killing, with malice. Judge feels no other charge other than first degree murder of Michelle Young.

Going over how jury statement will read....................

Judge going to run through how he will charge the jury. Any questions they (lawyers) have tell him.

We'll see how this is tomorrow during the ACTUAL. darn, I may have to leave in the middle of it! :mad:

If he is found not guilty, I hope he goes back to Transylvania County and crawls back under his rock for the rest of eternity.
