About the medicine:

Hearing about the type of mother MY was, I believe it is very unlikely she would give CY adult strength medicine or medicine that is just to get her to sleep as part of a routine. As a mother of a 7, 4, and 2 year old, I have been told several times about the dangers of adjusting the dosages of meds not intended for children and giving meds just to get them to sleep. MY seems to have parented similar to my friends and I, and that is just a big no-no.

OMG!

He's going to let it in under the 'excited utterance' rule?

Wow!

fran

That's surprising, I don't believe this is an excited utterance. Honestly, due to the time that had passed (a period of days, rather than minutes), I am not sure. I think perhaps, he is thinking that it may take days for a child to process what she saw enough to act out. I was thinking more state of mind exception. (To clarify, I think it should come in, I just wouldn't have used this exception to the hearsay rule). I also still think there's a confrontation issue.

Are there any restrictions to what she can testify to? NEVERMIND, Gritguy already answered this question!

I appreciate the updates, as I cannot watch the feed live. And I appreciate you all for putting up with my probing questions and commentary!

Potential GAME CHANGER.

(I am not saying this trial is a game.)

"Daddy brought them fruit snacks"

Hopefully this statement will be allowed.

And thank God that little girl is in the custody of her loving aunt! A Josh Powell situation will not occur here.

Those of us who've watched this case from the beginning, I think knew CY witnessed what happened that night. I have to admit, I've always been confused why they didn't approach that on the pros side.

I mean, from the first time I heard about it, the 911 call, original, 'daddy did it,' has been ingrained in my mind. 'bout time they use ALL the evidence.

just sayin'

I toally agree. I have vivid memories of some very bad stuff that happened when I was around 2 and a half as well. CY knows. jmo

Me too, Cortne. Extremely vivid memories. And also experience as to the conflicted *feelings/emotions* children have towards the actions, however violent, of their parents. Children are extremely confused by their sense of *security* in regards to violence they witness or experience themselves. On one hand there is the violence the see or experience, on the other hand, these are the only people they know who feed and shelter them.

CY also *allegedly* told a little boy classmate (at some point years later) that she had a secret to tell him but he couldn't tell anyone. And then she told him that "her daddy killed her mommy." Little boy went home and told his mom, which is how this secret got out.

Note: I said allegedly. It's what I heard. I don't know if it's true or not. It has not come up in testimony, it has not been mentioned in a courtroom. But if she did say such a thing, it implies that she at least knows what happened (possibly remembers some).

Could just as easily have been MY's family tell her that "secret".

I missed that part, unfortunately, of the forecast of the testimony.

Given the judge said the day care worker cannot testify for purposes of identity and his reservation on the the objection to statements, it's iffy.

If that comes in, then wow!

I don't think the tire tracks help the pros.

  • #377
If he lets that in, he has to let in 'daddy did it'.

Perhaps Michelle can be recalled to elaborate on CY's statements while she was on the phone with 911?

Don't think so.
MF was the witness to that and it apparently did not register with her at the time.

I corrected my post....it was "them" not "me"

--------------------------------------------------------------------------------

She said the mama doll had a boo-boo and was being spanked," Cummings said. "Cassidy did not try to identify the other doll."

On another occasion, the girl woke up from a nap and told her teacher, without being prompted: "Mommy had boo-boos all over. Mommy was on the bed with red stuff all over her, that she fell on the floor," Cummings said.

He said that she also talked about there being animals in a barn and her "daddy brought them fruit snacks."

On Meredith's redirect, it was brought up. She testifed that CY 'made reference to her father' when she asked CY 'what happened to mommy, did you see?'
