State Wants Evidence From Casey's Defense Team

I think that this evidence should have been requested by the prosecution several weeks ago when Macaluso first blatantly stated in court that the defense has evidence that Caylee was placed at the site on Suburban after Casey's initial arrest. Macaluso made that statement on purpose and it is part of the defense strategy as led by Andrea Lyon. Clearly Macaluso was baiting the prosecution. This begs the question: why? What was his purpose? This was not just an off-the-cuff remark. This was planned and rehearsed as part of the defense strategy. So what are they up to?

If you recall, Scott Peterson's attorney said he was innocent - but that was to the press and then during the trial. This situation is very different. We have Macaluso saying this in court and saying they have proof. That's pretty bold, IMO. I for one, can't wait to see what comes of this.

Wonder if it could even be possible that this is to put the heat on the defense regarding a possible plea offering that could be in the works?

Remember TP stated in postings a few nights ago about being able to talk more freely "in a couple weeks" or something to that effect? Wonder if he was "in the know" about a plea offer from the prosecution, but defense is moving slow on responding, so SA decided to turn up the heat by filing this motion (PUT UP OR SHUT UP)

Either way....I AM THRILLED.....wonder if Baez is starting to get another belly ache...

No offense taken. Wait a couple of weeks and you will hear and understand much more. I cannot go into details but you will see and then understand more. I will explain when the time comes.

Then again I think they know that defense has totally ... nothing.

Florida doesn't allow with holding evidence that is planned to use at trail. From either side. If defense has evidence that shows Casey is innocent, they should freely turn that evidence over. The "gotcha' game isn't allowed to be played here.

In the motion, it states that both sides signed some sort of evidence agreement. And then spells out the law, etc.

He said it in open court KNOWING it would be televised and reported upon. It was purely for the cameras, trying to sway public opinion. IMO

Unfortunately, he said it in open court, allowing the SA to challenge it. I'll bet Andrea L is kicking his @ss right now! heh

I know it shouldn't but reading about the prosecution's request made me chuckle. Mr Baez has been filing motions left and right. It is nice to see that someone else can too. Wonder if Mr Baez will file a counter motion?
 
Do you think the TES teamleader that they spoke with "some time ago" that informed them that "over one hundred people" searched the area that the body was ultimately found is JW?:crazy:Oh boy-this is gonna be good!!:clap:

Finally! Yes! :crazy: I had a feeling when the defense was screaming out Casey's innocence that this was going to come up. And to add to it, now that they pretty much put a gag in DC's mouth in the ZFG civil case will they now say that Cindy, George, Lee, or DC were the one to move the remains? I have always felt that the last straw for the defense was going to be to throw Cindy under the bus because she is the only other person who they could claim had a motive to kill Caylee and portray to be the so called "Nanny". Remember, the only person who claims they saw Casey and Caylee together before Caylee went missing was George. And we all know how their stories change to their convenience. Casey did claim the last time she saw Caylee was June 9th and it was not found out until later that it was June 15 father's day. Just my theory, I eagerly await what they have up their sleeve.
 
LOL, at the defense. Didn't I read months ago about the defense whining that the prosecution wasn't turning over the discovery fast enough? And weren't they asking for all kinds of bad things to be done to the prosecution because the defense thought they should have turned things over faster? Yet the prosecution has been turning things over regularly after the investigative parts are completed. We know because that is then made public. NOW we find out it is the defense who is not turning over discovery material! I think what should be done to the defense is everything they wanted done to the prosecution!

I don't know. The attorneys I know always work everything out in great detail prior to a court appearance - there is never ANYTHING that is said in court that is not planned, researched or strategized to the nth degree. Every appearance is completely scripted. No one on a team says anything without agreement from the team leader. I just don't know enough about Macaluso to know if he operates the same. But of the attorneys I've seen, and the court cases I've watched, the majority of trial attorneys operate in this manner. It will be interesting to see the defense response.
 
Didn't they send things off to be tested? Where is the reports?
 
LOVE it!!!!!!! I've been busy preparing for a trial of my own set to start in 3 weeks. So I haven't really had the time to keep up with this case. But I would LOVE to see Judge S set a hearing on this matter.
 
This is quite the news. I have long wondered if the laws of discovery pertained to the defense as well as the state. The defense must be in scampering mode about now.

If you watch the hearing, he raised his voice as he made his statement, and he turned and pointed at Casey. Clearly looked like practiced Showboating for the cameras to me! :)


The attorneys you know are probably much smarter than this team. :)
 
This is soooo good. Me thinks the def. team is going to squirm a bit and then try to close ranks even more.

Did we ever see the originals of the agreements that JB said both Padilla's signed? I think there is something stinky there too.
