"The state has a duty to review all of that evidence, and we've been diligent in doing that, but the volume has made it impossible to complete that by the February trial date," Sandoval said...”

“Prosecutors told the court they recently received a significant amount of new evidence and need additional time to review it. The defense expressed frustration with the delay but did not object, saying they understood the request.

The indictment also says that Brad also concealed a fully automatic firearm, a 7.62x39mm caliber select-fire rifle, that was not registered with the ATF or National Firearms registration or "classified as a relic or curio." Investigators believe that Brad did this to "impair its availability as evidence" in Suzanne's murder.

Suzanne's DNA was later identified on a motorized saw. Indictment documents allege that Brad tried to hide the saw from investigators.“

“… In the most damning accusation, Gilmore accuses Olmos Park Police Chief Fidel Villegas of giving Olmos Park Mayor Erin Harrison a private look at physical evidence in the case against Simpson.

“The only disclosure that has been given to defense regarding Villegas relates to Villegas’ incomprehensible decision to allow Olmos Park Mayor Erin Harrison a private review of all the physical evidence in OPPD’s possession, a calculation that may very well destroy the chain of custody for many items,” Gilmore wrote in his motion for discovery, outlining several other claims and civil actions against both Villegas and other investigators.

Gilmore says the chief did this even after the judge presiding over the Simpson case issued a gag order…

In a nutshell, prosecutors want to be able to use hearsay statements about Suzanne Simpson, saying they have records of prior family violence showing Brad Simpson’s “misconduct was done, at least in part, to procure the unavailability of the witness.”

The state has also subpoenaed Child Protective Services, under a rushed request, for any records of investigations into the Simpson family. The same prosecutors want record of Simpon’s hunting license and harvest tags.

The dispute continues over what information from the personnel file of the Olmos Park police chief, who led the investigation into Suzanne Simpson's presumed killing, will be turned over as evidence. The department head has been accused of letting the Olmos Park mayor peruse physical evidence in the murder case – a highly unusual and problematic accusation – and several lawsuits linked to his conduct.

Brad Simpson, the husband accused of killing his wife, has been set for trial several times. Delays in evidence processing by state prosecutors have pushed his face-to-face with justice back several times. Most recently, it was a dispute between his defense attorney and Bexar County Criminal District Attorney’s Office prosecutors

Simpson's attorney wants personnel files for Olmos Park Police Chief Fidel Villegas, including files from his tenure at the San Antonio Police Department, Floresville ISD Police Department, Windcrest Police Department, Olmo Park Police Department and Bexar County Sheriff's Office. However, the City of San Antonio has now asked the court to review the chief's SAPD personnel files in private to determine what, if any, information should be released to the defense as potentially exculpatory or impeachment evidence.

  • Brad Simpson was set to face trial before a jury this month, but the trial has been delayed for an unknown length of time due to the dispute over witness credibility and evidence.
  • A status update hearing on the case is scheduled for April 1.

In a motion filed last month, Simpson’s attorney alleges that Olmos Park Police Chief Fidel Villegas violated the gag order and allowed Olmos Park Mayor Erin Harrison to privately review physical evidence in the case.

The motion, which seeks personnel files, claims Villegas gave Harrison access to all physical evidence in the department’s possession after a judge had prohibited disclosure of evidence to non-parties.

The defense argues that the alleged action “destroys the chain of custody” for many items and could compromise the integrity of the case.

If evidence is found to be mishandled, it could be ruled inadmissible in court — a significant setback for prosecutors in a case that already faces challenges

Oh no! I see there is a hearing schedule for April 1.

Dumping a body in a high crime area…. Hmm. If it’s Suzanne’s remains, it smells like someone wanted to stage a random abduction and murder. Sound familiar? Suzanne Morphew’s body was found in an area of Colorado known as “The Boneyard”, where many bodies and bones were discovered over the years. Her body had been moved from elsewhere, too.

Waiting (im)patiently for updates on the identification of the Banderas remains.

This is an update on the forensics report - likely unrelated to this case, per their findings:

BANDERA COUNTY, Texas – The Bandera County Sheriff’s Office said it believes human remains discovered late last year belong to a 66-year-old woman.

The human remains were found around 6 p.m. on Oct. 17, 2025, off of Wharton’s Dock Road.
