The accusation that TH tried to abduct the baby

This is a great question. The technology for cells is amazing. I wouldn't be surprised if you could even go a step and do much more with a ping from a cell.

Would listening in on a call interfere with TM's cell phone pings?

It wouldn't change which tower her phone pings to. Your phone pings to the nearest tower. It doesn't matter where the call originates.

The thing is, the person(s) listening in also calls in, so that means there are at least two points of origin for that one connection.

The court documents say Law Enforcement provided the information. If the info was obtained by a PI, the court documents would have to reflect that.

And if they don't, if they are incorrect, are they null and void?

I cant help wishing.as i am sure he does that he had gotten rid of his " pesty wife" a lot sooner. That way Kyron would be most probably be enjoying his summer vacation right now with his loving family.

JMO

It would seem rather unfair for Kyron to be stashed who knows where with who knows whom who knows how long when he should be enjoying his summer holidays, just to get rid of a pesky wife.

Right, but the signal travels from the nearest tower to her phone. Signals don't go directly from phone to phone, right? (maybe, I should look at the link to the spyware program again)

I don't believe that would be grounds to nulify them but may be grounds to have the issue revisited based upon the new / revised information.

My friend has an urban commute where her phone bounces towers four times in 20 miles. She can do "something' to make it stay on a tower so she doesn't drop calls all the time.

I've seen several individuals refer to KH taking Baby K as basically reversing what TMH was trying to do at the gym.
I'm not trying to hold myself up as an expert but I have served as a Guardian Ad Litem on a few cases that have involved one parent suspected of harming a child. In my state, in NC, when a restraining order is involved or domestic violence is suspected DSS or LE suggests to the non-offending parent that they separate from the offending parent.
While there is a CHOICE in this matter if one doesn't choose properly the child(ren) are removed and the non-offending parent is advised of this in no uncertain terms, either in open court, in front of a magistrate or by DSS privately.
We have no way of knowing if there is an open DSS investigation at the moment. There may very well be. KH may have been instructed by LE or other officials to remove the child and if that is the case then if TMH tried to remove her from the gym it could be violating something other than a restraining order and there are most certainly consequences to this for the offending parent whether there is an RO in place at the time or not.
I would be very surprised if a safety assessment by DSS had not been done in this situation, especially with a prior allegation that we know of. (There could have been many unsubstantiated ones we do not know of as well)

It does seem elaborate but stranger crimes have been committed.
I am still waiting for the other shoe to drop, I am sure more dirt will be thrown.

I just don't see how KH could cite information from a phantom PI as coming from LE in a court document.

Way to make yourself look iffy in LE eyes because they would naturally know they never said no such thing.

TY TY TY digitaldisciple for chiming in on this topic. I will absolutely cede to your expertise. You are 100% correct that if there has/had been a DSS investigation opened at that time and a safety plan put in place that would indeed change things.

We were simply debating whether Terri's attempt to find out if her husband and/or her child were at the gym and/or daycare therein could be considered an attempt at kidnapping or not.

Obviously we will not answer that until we have more facts, including but not limited to, Was Terri served wit RO or otherwise put on notice to stay away? Was there any sort of DSS involvement/investigation at that point in time? What was Terri's intent if/once she got the information that Baby K was at the facility?

ITA this is highly unlikely

I don't know how it works (and does so without the person aware their call has become a 3-way). I'm trying to figure out how an additional point of origin for the connection might interfere with 'pings'. I've been a-googling, but my usual Mad Skillz with the Google elude me here :(

I'm a total loss when it comes to the fineries of the law but if it's true what Kaine says that he was advised by LE to take the baby and get out of dodge while waiting for a RO, wouldn't that go quite some way towards showing he had good cause to remove the child, thus decreasing the similarity between what he did and what Terri might have done if the gym day care worker had called her as requested?

I don't think the gym clerk & the gym manager are out to frame Terri.

If the case ever goes to court experts will be called to testify and explain it I would bet.

No, but they did technically use incorrect terminology when they said she tried to "abduct" Baby K. And I don't think that was by accident either.

But the same could be argued by Terri in the reverse. My husband I are under sever strain, my stepson is missing, there is much suspicion that I had something to do with it. My husband is distant and acting cagey, as if he too suspects me. He and his exwife are spending a lot of time together. Desiree gives me the stink eye lately. I don't trust what influence she is having on my husband (once hers) Suddenly, he is not answering my calls (or I noticed he has taken too many of the baby items to just intend to be gone from the house for a gym visit) and he has our toddler with him. I notice the playpen, favorite toys whatever are missing. Suddenly I fear the worst, he is leaving me and taking my baby! I am not arguing the "with cause" we can all agree that even if Terri is 100% innocent, a baby's safety is on the line, lets err on the side of caution, and there is adeqaute cause.

In my mind without a RO, custody order, DSS Emergency Safety plan, or some notice to Terri, they are on equal footing as to what their motivations for having control/custody of the baby.

I would make the exact same argument for Kaine were the poles reversed. This kidnapping accusation is going to get no more weight by me than it would in any other custody/divorce matter.

THIS NOT TO SAY I FEEL HIM TAKING THE CHILD WAS UNJUSTIFIED. I am simply saying that I do not find it damning that Terri attempted to find out where he and/or the baby were on June 28th BEFORE she was served the RO and divorce papers. Why wouldn't she want to know where they were, particularly, if as I suspect, Kaine wasn't answering her calls.

One of the spy features most of those programs tout is the ability to trace the GPS location of your subject. I can't imagine, were Kaine completely innocent, that he wouldn't have handed that info over to LE if he had it at the outset.

A lot of that would depend on what she was told during the 911 custody call. We have no idea what she knew, was told, was warned against, etc.
