He said he did that knowing it wouldn't happen ... and he was hoping that that would be the trigger for her to move on and do other things," Mr Byrne said.

"He'll tell you that he did, following the September break-up [with Ms McHugh] and after contacting her in December ... did on two occasions have physical relations."

Mr Baden-Clay's last sexual encounter with Ms McHugh was in late January, early February 2012.

"He had recommenced his physical relationship with his wife," Mr Byrne said.

This is really quite hilarious this "tryst" thing. In another case on WS the husband tried to pass off his affair as being just your every day common ole "tryst".

His wife was found dead on the side of a country road too & the husband is awaiting trial.

2:44pm: Mr Byrne has turned to the night of April 19, 2012, when Mr Baden-Clay is accused of killing his wife.

"He'll say that night they both took their turns of saying goodnight to their children in their rooms ... " Mr Byrne said.

"He felt tired. He didn't feel terribly well. He went to bed about 10.30pm ...

"He can't remember doing anything with his phone but he will tell you the normal practice was for Allison to have his phone at night time.
