Byrne says Gerard tried to call the police three times that morning. He tried an officer he knew at Indooroopilly, a 1300 number and 000.

I'm starting to wonder if Michael Byrne QC may be getting a bit too smart for his (and GBC's) own good? The more he prattles on, with every little point covered and explained, the more I get the impression that it is all starting to sound more and more like utter bullcrap. I wonder if the juror's are getting the same impression?

2:49pm: Mr Baden-Clay had fought with his long-time mistress Toni McHugh over the phone that afternoon.

Ms McHugh had demanded Mr Baden-Clay tell his wife that she was due to attend the same real estate conference as her the next day.

He did not warn his wife of the impending run-in that night.

"He did not mention it," Mr Byrne told the jury.

The prosecution has previously alleged Mr Baden-Clay killed his wife when faced with the dilemma of having his wife and his mistress come face-to-face for the first time.

I am too...a bit of science fiction thrown in for good measure...it must be hard to deal with that with a straight face...and cannot be easy if you have been advising your client not to do this as it will be to his detriment. But, all kudos to you...even I didn't think he was so keen on his own performance. I just hope he doesn't break out in a 'Tie me kangaroo down sport..' Whilst on the stand...or worse 'I am Mr Peg........'



I honestly think that Gerard has completely surprised Mr. Byrne when he said he would take the stand, and Mr. Byrne is buying time until he can spend time with his client and work out a line of questioning. Perhaps that is why they were late this morning.

On another matter - has it ever been mentioned in court that dear Alison was Miss Queensland? Something she earned herself, and not some claim to fame froma long dead ancestor?
