Why don't the children hear anything, why is there no blood in the house or carport - defence #badenclay

Because it was a silent murder.

Byrne says girls would have been left alone for up to 40 minutes while Gerard "disposes unceremoniously" the body of his wife. #badenclay

Byrne says Crown case is Gerard got the body out of the back of the car, carried or dragged it through grass, mud. #badenclay

Byrne says Gerard climbs back up, through grass, mud, drives home. #badenclay

11:43am: The PowerPoint slide includes a series of questions and statements:

* How do you carry a deceased body down the steep embankment, at night, when police officers had trouble traversing the same area during daylight?

* How do you carry a deceased body over a muddy area without tracking mud back to the Captiva?

* If the deceased was dragged then there would be injuries on the body consistent with that.

* If the deceased was dragged then there would be evdience of that at the house or at Kholo Creek.

* How do you do what you are alleged to have done without leaving a crime scene indicative of being at Kholo Creek?

* A child waking up and discovering that their parents are not in the house for the period of tie, at least 40 minutes that they must have been gone.

Man, it's not exactly hard to pull a pair of XXXL trackies onto someones legs and put on some shows, without even properly doing up the laces! The top half was likely as she was that night. Not even wearing a bra? I doubt she'd wear a "built in bra" walking. Not exactly supportive!

I can't wait to see how the darling Mr Fuller connects all the dots of evidence for the Jury and all the Websleuthers going "I told you so!"

Byrne says do the jury think such a scenario is even possible, let alone one they are satisfied of beyond reasonable doubt. #badenclay

Byrne says jury has ventured down that ridge. #badenclay

Crown says he drives home afterwards. Do you think such a scenario is even possible - defence #badenclay
You have been to that site and ventured down the side of the bridge in daylight - defence #badenclay

Byrne tells jury they've "walked the walk", down muddy bank of Kholo Creek, to where body was found. "Is it even possible?" #badenclay

Defence asks why the leaf matter found on Allison #badenclay 's body wasn't found in car, if that's how body transported. @7NewsBrisbane

Bryne asks if plants are still in Allison's hair after body found why none in the car? @abcnews #badenclay

According to testimony last week there was plant matter found in the car.

And re vacuum cleaner...it wouldn't surprise if the car had been vacuumed out & the bag disposed of elsewhere.

The jury is being shown the photograph of the Kholo Creek bridge area. You can see areas of mud and grass. #badenclay

Byrne says Crown theory is that Allison's body was carried through grass, mud and down the embankment. #badenclay

Defence shows the court a photo of Kholo Creek bridge from the time Allison's body was found #badenclay
The area is overgrown, muddy #badenclay

Byrne says if the body was dragged or carried through the foliage, where are the leaves in the car? #badenclay

Byrne says only crepe myrtle in the car. It's very common in Brisbane. #badenclay

Kate Kyriacou @KateKyriacou · 7s

Byrne: How does all this movement go undetected by the three girls? #badenclay

Good grief, it's not like they're Security. I have seen, in person and on tv (in reports), kids sleeping through piercing alarms. (of course for every kid like that there's one like me who woke up for every sound, including but not limited to deer walking though the woods - we lived in the woods on a mountain lol.) But really it doesn't seem like a reliable standard to me.

So the jury walked down?

  • #373
Although I'm finding these excuses very disturbing, they were all inevitable. After all, what else can the defence say?? Most, if not all of these points, have been telegraphed by the defence during the trial. Still upsetting though.

11:46am: Mr Byrne said Mr Baden-Clay would have had to walk through long grass and mud, down a steep embankment, to dump his wife's body on the banks of Kholo Creek.

No traces of mud or grass were found in the Holden Captiva after it was seized by police on April 20, 2012.

"Ask yourselves the critical question ... do you think such a scenario is even possible?" Mr Byrne said.

Byrne says to bear in mind how police described it. One officer says he tried to touch down after being winched but mud was thick.#badenclay

One officer says the mud was at the top of his gum boots when he tried to stand. #badenclay

The defence are actually connecting some dots for the jury re how Allison came to be changed from pyjamas to walking clothes. Maybe some items of clothing didn't need to be changed, mainly just pyjama pants?

I was just about to ask that too - do we know if the clothing on her upper body was different to what she was wearing with the pj bottoms? Also Byrne mentioned a bra earlier - was Allison found wearing a bra? I thought there had been talk about a tank top with one of those built in shelf bras, but I don't recall a bra on it's own being mentioned (could be my bad memory though). Anyway whipping off loose pyjama pants and replacing them with very loose track pants isn't such a tall order.

A brief break #badenclay

I'm sure he could have dressed the body in a new outfit - but I wonder how believable an outfit it was. A lot of men would be totally floored by the challenge of locating the walking outfit in the bedroom in the first place, let alone making sure it was the kind of outfit that a woman would have selected.
