Byrne says police had the SES conducting a shoulder to shoulder search on the grounds of the property. #badenclay

Byrne says the only thing they found was a black NAB pen. That's how carefully they searched. #badenclay

Byrne tells the jury not to look at media grabs, sensational headlines. Look at the evidence. #badenclay

Byrne is referring to the evidence of Sen Sgt Ewen Taylor, forensic co-ordinator. #badenclay

I've done more shoulder to shoulder searches as an SES volunteer than I care to remember over the last 20+ years and you always find things. Bits of wrappers, odd socks (not the we sleuths person of course!), the detritus of life. Wether it's kids, dogs or the weather that brings these things to rest in such places who knows. The line is forever stopping as each item is recorded. The complete absence of anything bar a pen is quite peculiar and outside my experience.

John Sharpe murdered his wife in her bed one night.. no body heard a thing.... his little daughter , Gracie, slept thru it.. . unfortunately for Gracie, she had to go off, too.. John told everyone his wife had left him with the baby, and gone off with another man.. to prop up the story ,he took Gracie with him when he bought a speargun.. that thing one uses to hunt sharks with ,and fired it thru Gracie's head one night...

Police eventually found his wifes body, and Gracies in the garbage dump near Frankston, Victoria..

John tried to put on a good display of appealing for his wife's return.. he even wrung a few tears out..

Byrne says it is equally critical that after Gerard violently killed his wife, he transported her body to Kholo Creek. #badenclay

Byrne says if the evidence doesn't prove that, the Crown case starts to collapse. #badenclay

Defence says prosecution case 'collapses' when you think about Gerard #badenclay supposedly disposing of his wife's body at Kholo Creek

Caroline Overington ‏@overingtonc 42s

But if they can't even prove how she died how can they prove murder? The case must collapse #badenclay

#badenclay defence says when you examine the evidence whether Gerard dumped Allison's body at Kholo Ck, the case collapses. @7NewsBrisbane

Defence says evidence about screams fell away when surprise witness Ms Apps came forward re daughter and cobweb. #badenclay @7NewsBrisbane

What Ms Apps' account provided was one explanation for one screaming incident. In fact it narrowed down the timeframe for some of the other incidents.

Allison seen by eldest daughter watching TV on the couch. Gerard told you the same thing - defence #badenclay

Byrne says the Crown case is that after he "somehow" caused her death, leaving no signs in the house, carport, he loads body. #badenclay

Byrne says he then takes her body to Kholo Creek and dumps her under the bridge. #badenclay

Byrne asks is that what the evidence shows? #badenclay

Byrne says we know Allison is seen by daughter on the couch watching TV. #badenclay

Byrne says somewhere between 9pm April 19 and when the body was found, we had a change from pyjamas to walking gear. #badenclay

Maybe he is going to leave the scratches until last. He will surely mention them.

10:58am: The jury has returned.

Mr Byrne has now turned his attention to the "complete absence" of a crime scene at the Baden-Clays' Brookfield home.

He said Mr Baden-Clay invited police to his Brookfield Road house on the morning he reported his wife missing on April 20, 2012.

He said Mr Baden-Clay gave police consent to search his house and his cars.

11:04am: Mr Byrne said the first police officers to arrive at the Baden-Clays' home found no sign of a struggle.

"No evidence of a violent killing," he said.

"Put all this into your melting pot when you come to consider the case."

11:09am: Mr Byrne has reminded the jury not to consider media headlines about the case when considering the forensic examination of the Baden-Clays' house.

"You don't look at the headlines, you don't look at 'blood found in car, wife killer nabbed'," Mr Byrne said.

He said Mr Baden-Clay was an accountant working as a real estate agent with no expertise in "sanitising a crime scene".
