Next issue for #badenclay defence: the leaves found on Allison's body. Do they link the 'murder' to the Baden-Clays' Brookfield home?

Prosecution says leaves link body with the Brookfield property and murder - defence #badenclay

Superficially attractive, falls away - defence #badenclay
These plant leaves aren't in the Captiva and no mud - defence #badenclay

Thanks Ali

From my non-accountant's reading of the accountant's report, it also seems that the family finances were in a serious and steady decline. At the time Allison went missing, the finances were the worst that they'd been on the graphs. And, there doesn't seem to have been anything presented through the trial to indicate that there was anything on the horizon that was going to improve their financial position - with the possible exception of a windfall from something like a large insurance payout.

In fact, had Fleggie's loan occurred, their financial situation would have been dire++++

Byrne again says the leaves were not in the Captiva. #badenclay

There is nothing unusual in any of this #badenclay

Except for the fact that Allison is dead.

Byrne says they might think premeditated murder is absurd on the evidence presented. #badenclay

Kate Kyriacou @KateKyriacou · 22s
Byrne says they might think spontaneous murder with a background of the Footy Show is just as unbelievable. #badenclay

Well Mr Byrne, sorry to have to point out the obvious, but lots of things that gbc has said and done in the past are unbelievable so why should one be surprised now?

Byrne is discussing the evidence of the botanist, who went to the creek, walked the streets and surveyed plants growing in area. #badenclay

Dr Gordon Guymer, botanist, accepted cat's claw creeper ranked 23 in Australia's worst weeds - defence #badenclay

One of the plants found in Allison's hair was Cat's Claw Creeper. Byrne says it is a pest found everywhere. #badenclay

Kate Kyriacou @KateKyriacou · 24s
Byrne says the Fishbone Fern was a mixture of fallen and fresh leaves, same with Cat's Claw Creeper. #badenclay

David Murray ‏@TheMurrayD 50s
He found cat's claw creeper leaves of different ages. Also a mix of old and fresh fishbone fern leaves - defence #badenclay

Sarah Elks ‏@sarahelks 52s
Defence suggests Allison's body was washed under Kholo Creek bridge by tides; leaves in hair could have been washed there also #badenclay

Dr Guymer accepted plants and leaves float down creeks - defence #badenclay

Byrne says he asked the botanist whether plants and leaves float down rivers. Botanist agreed. #badenclay

Byrne again says the leaves were not in the Captiva. #badenclay

They could have been vacuumed up and then the vacuum cleaner emptied before cops got it

Byrne says the botanist, Dr Gordon Guymer, didn't do a study on how much debris was moving up and down the creek. #badenclay

Neither did the defence - they used a "friend" to video it from a different MONTH and YEAR = CRAP

David Murray ‏@TheMurrayD 50s
Dr Guymer hadn't done a study of the creek flow - defence #badenclay

Sarah Elks ‏@sarahelks 52s
Defence's time lapse video of Kholo Creek 'provides reasonable basis for inferring' leaves were put in hair by the moving water #badenclay

And they never showed that they'd found those species of trees upstream where they could have found their way into the creek, nor did they show that the water could have even reached Allison's hair.

Defence says #badenclay not in personal financial strife. "Do the math." Personally he was up $500k in assets over liabilities.
if that was the truth and I don't believe it to be, Byrne forgets to mention that if Allison found out about Toni being on the scene again, gerard stood to lose a great deal of those assets to Allison in a divorce. I wish this guy would just keep it real.

I can't believe how much crap can be used in a summing up? The video show only movement on the day and time it was taken - they have used NO correct tidal information at all in that!

Sarah Elks ‏@sarahelks 48s
Defence says there was 'substantial movement of water' from substantial catchment through Kholo Creek. Could have moved leaves. #badenclay

"transient suicidal thoughts"? *Cross* Since when did ANY witness claim that she had that? Defence making crap up. No broken bones, no drowning, they said that. I see he was being careful to include the "reasonable" word everywhere, because he knows it's not legally "any"!

I still get so mad with the suicide theory given where she was found. Just ridiculous.

"And other means of death, such as toxicity, drowning, or falling from a height, cannot be excluded."

The experts did. They use the "cannot be excluded" because of them saying that it was so unlikely but the whole legal cannot say 100% unless they saw it happen bit.
