In a murder case when my niece on the stand the PA put up photo's of her "boyfriend" handiwork on the wall behind the stand and they stayed there. The defense couldn't take the down.

When Juan put the picture up yesterday, I do not think the defense had a legitimate sustainable objection to showing the photo to that witness or displaying the photo without warning. I believe the only reason it became an issue is because of the audible and observable reactions in the gallery, which had the effect of causing some commotion in the court room.

If those reactions had not been heard or seen, I do not believe the judge would have sustained any objection and would have allowed Juan to present the picture for Lisa to comment on -- much like he showed the sexually explicit photos and autopsy pics to that other female witness and asked if Jodi had ever told her about those things she did.

After the picture was displayed initially -- Juan had already achieved what he intended to achieve IMO And that was to make a distinction between an acceptable way to end a relationship (Lisa sending a harsh email and distancing herself from Travis) as compared to Jodi's brutal slaughter of Travis to end their relationship. There was no need to keep the picture on display, especially considering how upsetting it was to Travis' family (he is their advocate and champion after all).

Question. does anyone maybe the lawyers on this thread could answer. why the court reporter does not go up to the sidebars to record the conversations? do those conversations need to be part of the record also? we see in other trials where the reporter goes up to the bench each time.

All of the proceedings in Maricopa County also are digitally recorded through the courtroom sound system. When they have a side bar, the microphones that feed the sound to the rest of the courtroom are muted. I'm guessing that the court reporter can still hear through her headphones. But, if not, there's still a digital record.

There's a sign at counsel table reminding you that the Judge can hear you, even in chambers, at all times. They never turn the sound system off while court is in session that I'm aware of.

Maybe but if he did I haven't read of it - both roommates gave statements to Flores available in the supplemental report as well as making a few online statements. Sex is not mentioned at all...and really he wasn't overly close with either roommate. Enrique had been living with him for six months and Zach just a couple of weeks iirc. FWIW
