Surely losing your 3 year old to a "predator" is every parents absolute worst nightmare?

I would think anything anyone said or published about me would be a pin prick in comparison to the pain of losing my baby in such horrific circumstances but then, my last name isn't McCann.

I think that is a mischaracterization of what she said. She means that while the pain of losing maddie is horrible being accused in the media has amplified that. I am sure it has to be horrendous to be accused of hurting your child when you did not and only hope for their safe return.

This really has nothing to do with the case though. It is just something to throw mud on the family and has nothing to do with what happened that awful night.

No one would be saying anything about this testimony if the McCanns weren't determined to extract $$$$$$ from Amaral.

Let's not lose focus here.

This thread is about the libel case and the "new" information it is revealing.

Trish is saying the McCanns were ok until the book came out. 100x the pain was caused by the book, than by losing Madeleine. That is what she said in a court of law so it can't be minimised, undone, dismissed as "misheard" or "misunderstood".

Which makes me wonder, why were they so OK beforehand?

This is why litigious folk should really think hard before suing left, right and centre. Things are said in witness boxes that cannot be unsaid.

Kate and Gerry will not enter that witness box, no matter what. They are allergic to being examined.

Earlier, Gerry McCann had arrived at the court in a bid to give evidence against the disgraced police chief, but later expressed his disappointment that he was not able to take part in the proceedings.
'Disappointed,' McCann told reporters as he left the courthouse, 'but you know, we'll keep going.'
It is not clear why he was not able to give evidence.

I would think that the testimony of the plaintiffs would tend to be essential in most libel cases as the plaintiff is the best person to have first hand knowledge of their own suffering.

It's Portugese law, apparently, which has recently changed.

I don't understand it either, except to say that a libel case is very different to a criminal case.

Their quest for $ is what's going to undo them in the end.

Suing every man and his dog is just fine, but it goes both ways. If you take someone to court, you have to be prepared for the defence.

How on earth can they claim they were "damaged" when the good people of the UK gave them millions and millions of pounds?

Interesting to note, Gerry stayed at home UNTIL he found out there was no chance he would be called.

Then he flew over to Portugal like superman, with his humungous suitcase of "proof", only to be turned away, glamorously poncing about the steps of the courthouse with his lawyers.

Perhaps if you'd put your name on the witness list in the first place, Gerry....?

I think you read just a part of the quote.
The court was adjourned "last week" when he was there. The court was not adjourned later while he was sitting there listening to his sister give evidence.

Mr McCann was left frustrated after flying to Portugal last week, when proceedings were adjourned because one of the defendant's lawyers could not be present.

Arriving at the Palace of Justice in Lisbon this morning, Mr McCann said he was not sure what would happen 'after last week'.

'We are here to listen to the judge and hopefully be heard,' he told reporters.

The court is in session, he's there, they're hearing testimonials but he's still not sure that he can be heard

A libel trial in which neither the defendant or the plaintiffs testify would hardly be even worth the trouble imo.

Some countries don't even have the legal concept of "libel".

In fact Portugal has a very touchy history in regards to freedom of speech, as they laboured under dictatorship and extreme censorship for most of the 20th Century.

I would suggest that this case is entirely new in Portugal, using laws that have been largely untested...perhaps not even written that well in the first place.

Apparently they can be sued because it is going on right now. It did not vanish. They had to have found cause to allow the suit.

Kate instructed not to go, goes anyway, speaks on steps to the press.

Gerry far too busy to go, apparently, which boggles my mind...what is more important? Couldn't he reschedule?

Then the judge has "personal issues", followed by Amaral's lawyer. Court sessions cancelled, ditto witnesses.

Then Gerry turns up with a trunkload of "evidence" again a pap run on the court house steps.

He had been too busy to go, SY had told them not to go...suddenly he turns up at the last minute, just when he's found out he probably wont be able to testify.
