Theory Thread - What happened at Pistorius' house on the night of Feb. 13, 2013?

Some weeks ago, I posted my suspicion that Reeva slept in the spare room that night. I found OP's insistence that, had Reeva gone down for a snack, he'd have known about it, quite telling - to me, he seemed to be seeking to emphasise that they were sharing a room at the time, ie., that Reeva was not in the spare room.

The other day, I was scanning Digital Spy and one of the posters there suggested that OP mentioned Reeva calling him to brush his teeth because he was seeking to establish that the toothbrush in the spare room wasn't hers. I thought this was quite a canny deduction.

So, I think they probably did go to bed at some point, albeit not together.

I've been thinking about the Ipads - Do we know whether any messages were recovered from them? Sam Taylor mentioned that OP was forever texting in bed, both from his handset and from his Ipad. I know he deleted his browsing history, but I'm wondering if it was possible to recover his chats. Also, what about Reeva's Ipad? What messages were recovered from that, if any? And, if the reports are true, where did the police find OP's flirtatious texts to Erin Steer?

Apologies for all the questions so late in the day, but I would have thought this evidence was key to establishing a timeline for that night.
Content

The only chats we saw were the WhatsApp messages recovered from Reeva's iPhone. No iMessage or SMS content, web browsing history or other usage was shown from this phone.

Nothing was shown from OP's iPhones.

We also saw OP's iPad browsing history for that evening. Sam Taylor says he used it at night but not that he messaged from it. WhatsApp doesn't naturally run on the iPad (it can be made to but it's an involved process to set up). iMessage does run on iPad.

It was stated that the web browsing history was similar on both iPads.

All data from the iPhones and iPads was extracted and given to the Defence and the Judge.

Usage

All phone usage times and durations (cell tower, GPRS, calls, SMS) were extracted from the detailed Vodacom billing.

I am preparing myself for that. And if he gets a 15 yr sentence, and does 8, I will live with that. I think the final 8 yrs is a probation? So if he messes up again he goes back and does the rest? I may have that wrong, but I think it works something like that.

In the case of murder

After how long can a person serving a sentence apply for parole?

The parole board has a wide discretion to grant parole, although the law puts limits in the case of more serious offences. Offenders sentenced to life imprisonment must serve 25 years before being eligible for parole, and even if they are released will remain on parole until they die. Offenders sentenced to more than two years (but less than life) in prison must serve half their sentence before being eligible for parole.

I have worked in IT Forensics and I can tell you that not everything you type is recorded in some cloud or drive.

Not everything is ready to be recovered after deletion.

The cops in SA may not have the funding of some international agencies or the determination to prosecute the hard targets.

OP and family had access to his devices and most likely the only things they couldn't control were the call registers from the telephone company and Whatsapp. (I think the scene was severely compromised by the OP clean up team.)

The Whatsappp only for 7 days are retained on the server which is where some of the damning evidence came from. (This is also not to say instant chat apps from other sources were used by Pistol P.)

It is well known that compromising tweets of OP were deleted from history.

"Booth said the issue of witnesses was not a relevant point because the judgment on the televising of the case made provision for witnesses being called in camera".

(This refers to a hearing or discussions with the judge in the privacy of his chambers (office rooms) or when spectators and jurors have been excluded from the court room)

Well that seems to take care of that problem.

Just wondering, is Vodacom the only sp in the area?

OP ported from MTN so that must be available in his area. Others are Cell C, Telkom and Virgin. Not sure about coverage and iPhone support at that time.

Thanks, 808. I'm definitely not tech-savvy and have only started using iMessage recently. However, if you've got an Ipad in your hand, it seems to be the most quick and natural way to communicate. So, I'd be very surprised if a hyperactive individual like OP wasn't using it or some other similar application - Snapchat seem to be quite popular, too.

Mr Fossil states that data from the ipads was extracted and given to the Judge, but I'm not clear if this includes iMessages from that night and/or previous nights, deleted or otherwise.

And, as you point out, we can't be sure that incriminating material hasn't been entirely expunged.

What is she thinking? She has already made her decision - we just don't know what it is yet... masipa.jpg

Oh yes! I only thought "What is he telling OMG, she had remanded him to brush his teeth??? How ridiculous!". - Now I understand! Cleverly OP!

Short clip of Professor James Grant, providing analysis of the forthcoming Oscar Pistorius verdict following a lengthy trial...

https://www.youtube.com/watch?v=wkVjFC3_SXU

Thank you for the link. The video was very heavily and badly edited and I wonder why. All along Professor Grant has slightly disagreed with other lawyers (on legal round table) over interpetations and possible outcomes, although recently he has been recorded as saying OP is in deep trouble.

She feels compassion ..............

I think intunitively she probably feels as most of us do BUT she has to try him under strict judicial rules and gut feelings can play no role. I think she will do just that and if there is any doubt he will be given the benefit of it.

I should add a word of caution. I mentioned a few posts back that Judge Masipa will know her decision by now. Of course, this may not be true. It is possible that on Thursday she says that she has not yet made her decision and that she needs more time. I sincerely hope this isn't the case.

I want him locked up before he hurts or kills again
