Cop Wins Appeal Against Conviction

A policeman has had a murder conviction, and a 10-year-sentence related to a shooting during a robbery, overturned by the Western Cape High Court, the Sunday Independent reported.

A full Bench found Jerome Earl King acted reasonably and was executing his duties, when a robber was shot dead during a break-in at the Bonteheuwel post office in 2007.

King and a colleague were dispatched to the scene. The two thieves refused to surrender despite King giving them a verbal warning and firing a warning shot. King fired two more shots, killing one of the robbers.

During his trial, King testified he had aimed in a slight upward direction, intending to fire warning shots.

Even so, in 2010, the court found him guilty of murder, ruling he deliberately aimed at the robber.

However, the recent appeal judgment overturned this ruling. Judge Patricia Goliath said: “It cannot... be found beyond reasonable doubt that he fired the second and third shot with the intention to kill the deceased”.

OK, I’m confused. I thought self-defense claim could only be used to defend persons, not property in SA?
Were the thieves armed? Did they attack the cop?

At least he gave a verbal warning .. and these were actual, real, armed robbers .. ones that he could actually see!

I enjoyed your response but you missed the point. It would not matter what Frank said on the stand or how he was ripped to pieces.....

OP would not have had to give evidence if Frank was a first hand witness..... I'm emphasising the theory that OP has been one of the States best witnesses and the Defence missed a chance to counter that...:-)

I just cannot for the life of me see how Frank could have helped OP's case enough to prevent OP from having to take the stand.
As we know,four independent witnesses heard 'REEVA' screaming just before she was shot.
How could Frank possibly counter this evidence ?

As OP has stated 'his life is on the line here'.
He had no choice but to take the stand IMO regardless of any other evidence from witnesses,whether it be Frank or other neighbours.
I don't think he would have taken the chance of his fate being decided by others.
He had to give his version IMO.
Unfortunately he's dug his own grave,so to speak lol.

The murder happened on - 14 Feb - Valentine's day! A day of love for most, and war (for some couples)
Verdict delivered on - 11 September - we all know what a catastrophic day that was!
I hope masipa and assessors discussed and mention the DATE and that it is no coincidence!

Meanwhile OP is having steaks at Tasha's......seriously???? Why don't you keep a low profile at least until the obsession with your case is over! No respect! He really must think all will be ok for him. Much like his first comments to cops when arrested " I will beat this.....I always win....". We shall see.....

Totally agree about the murder having taken place on 14 Feb was no wild coincidence .. but .. I do not believe that the 11 Sept has been deliberately chosen, I can't see what difference it would make which date the verdict was delivered, and I really do think that that is just the way it has panned out and what dates happen to be free in Masipa's diary, and when the courtroom itself was free to be booked for it.

Agree with your last para, it's just gob-smackingly astonishing the way he is carrying on!

Oscar Pistorius was recently at Tasha's the same restaurant chain of his gun charges...

Can the accused be any less self aware or possibly arrogant. What next, a tumblr with prayer nodules and watermelon zombie selfies ;)

I am a huge conspiracy sista' but even I have a hard time buying into this. :D

IMBW, but was he claiming self-defence at all? The way I read it, he's saying the shots were intended as warning shots. Or does that come under self-defence?

Quick question to the 'he locked Reeva in the toilet' theorists - why would he then break the door down?

As shown by the state's line of questioning, they didn't consider it plausible that an intruder would lock themselves in so I don't believe Pistorius would add that complication to the scene on the spot.

Is it possible Pistorius locked Steenkamp in, with the key but she then used the internal locking mechanism to keep the door locked after Pistorius tried to open it (perhaps once he'd got his legs on or armed himself)?

If we suppose that the door was never locked (no key in the door), then Reeva could have run in there, closed the door and held it shut from the inside (hence her position). He could have been beating on the door (and perhaps the bath panel etc) with the cricket bat (hence her screams). He's going to have to account for the state of the door, so he breaks out the panels and says he had to because it was locked. He fetched the key to back up his story. Does this work?

He may have had the gun on him already, or he may have gone to get it. She might have peeped out to see where he was, seen him coming back with the gun in hand, and slammed the door shut again.

Am going through the defence HOA. They hotly contest the placing of fans and how the police tampered with them.....but cannot explain why col van rens was never taken to task over it during their xexam

Ok so for 1 sec lets believe oscar, the fan was not in front of the balcony door, and was in fact where the duvet was. So is he saying he ran from bathroom to balcony WITHOUT tripping/bumping into the fan which was in FRONT of the bed and in his way to get to the balcony.....in PITCH dark wielding a gun??? Even if his version was true, he still would have been obstructed by the fan while on his way to the balcony! His bedroom is not a huge room, it's quite small!

So it cannot be reasonably possibly true.....

Hello again to all, cant believe how close we are now.
Sorry if already posted but there is a great video at this link of Alex Crawford having a walk around Oscar's now empty former house, his bedroom seem's much smaller than i previously thought it to be, makes his story seem even more ludicrous if that's possible.

Just because a country, Mozambique for example, does not have a formal extradition treaty with another country, South Africa, that does not mean that Mozambique would give OP safe harbor and allow a convicted murderer to roam its territories freely. Diplomatic exchanges between the two governments would have OP sitting in a Mozambique jail cell until he was expelled back to South Africa.

OP should really consider a more extreme country to flee to, North Korea would be ideal!
