Dearest Jblfelines,:blowkiss:
Thank you very much for the info. I did not know that Geragos is representing that little girl.

Much Love and Respect,

He is a horrible attorney. I don't know why anyone with a choice would use him!

If they taunted the tiger, then the father of the boy who died should bide his time. When an amount is awarded to the survivors, Dad just step up and say "My name is spelled ___________ when you make out that check, but I'll still let you two boys pay your high priced lawyer out of YOUR pockets."

Hm, that makes the old shotgun wedding seem a bit tame. Sorry, I'll go to my room now. :slap:

If in fact they are proven to tormenting that animal, I feel they should be borught up on charges of negligent homicide in the death of Carlos, and not be awarded a single red cent

EXACTLY! That's what I think too bakerprune.
If they in anyway aggravated the tiger and caused her to attack the young man that died.......the brothers need to be severely punished for what they did.

Carlos Sousa, Jr.
"Sousa was born in Berkeley but spent most of his life in San Jose. He was a junior at Independence High School and was described by a relative as a "typical 17-year-old who liked to go to the movies and dancing and hang out with his friends.""

"He was supposed to start a job Wednesday, selling newspaper subscriptions door to door. He was also taking music and movie classes outside of his high school.

His home page on MySpace, which he last logged into on Christmas Day, says that he is Portuguese and Brazilian and that he wanted to be a DJ someday. It says he likes to hang out with his family, play basketball and party. It says he likes the late rappers Mac Dre and Tupac."

As far as ethnicity goes, the two brothers surname is common for Northern India (the continent) families. Sousa ... the same for Portuguese nationality which naturally relates to Brazil. I wouldn't have assumed any of the three were hispanic by seeing their names from the news articles or media...but, they are brown skinned.

I get the feeling that there are other factors in this case. Perhaps not everyone is in the country legally. Unfortunately, the Zoo will end up paying money, but I, like most of you, hope that its not an overly-large amount. There is no excuse for the animal to have been able to get out of its enclosure no matter what was happening at the time. For that, the zoo is responsible.

your ideas on which ones/one might not be here legally?

I agree baker and phil

If it is proven that these boys did in fact use a slingshot and torment/taunt this tigress then not only should they be charged with cruelty to animals and negligent homicide, but the Sousa family should file a wrongful death lawsuit against them. It is my opinion that it was their wrongful conduct that caused the death of Carlos, and by extension, Tatiana.

I realize that the zoo was at fault for not properly securing this exhibit, however, I feel that this animal would have never "broken out" if she were not being abused by these boys (I refuse to call them men). I just cringe when I think that they stand to profit from this incident.

IMO, this is akin to someone throwing rocks/sticks at your dog...who is fenced in...in your yard...and then the dog finally gets angry enough to scale the fence and go after/bite the person. Does anyone believe that the dog owner should be made to pay for the resulting injuries, medical bills, and/or pain and suffering that the rock thrower brought on themselves?

Self-accountability is sadly lacking in our lawsuit ridden, blame others for my bad choices, society. For once, I would like to see a judge laugh these people out of the courtroom. You play...you pay.

The problem i have with them being called boys rather than men suggests them being held less culpable (if they did taunt the tiger).

your thought about a dog owner: dogs should be restrained at all times to ensure they cannot attack even if they are provoked.

But what about how Fermi explained it?
What if the dog is in his own yard, is harmed by a brat and the dog jumps the fence to defend itself?

Yes, sorry, i missed the point. of course should someone taunt a dog on its own home ground they must take responsibility in any resulting harm to their personage.

i would go so far as to claim it wouldn't be a brat doing it. a torturer, more.

because in the instance of taunting an animal, it is torture for the creature.

however, the dog shouldn't be able to scale the fence to get out.

Floh,
As always, thanks for the explanation. I agree about the dog not being able to scale the fence also.

What a wonderful recovery your son has made! good for him and long may it continue. :)

Thank you, Floh. He is a miracle, that's for sure. The doctors don't like to use the "m word" because, as they explained it to me, medical science is a SCIENCE, which means they deal with measurable data. But they DO say there is no explanation for why my son can do the things he can do. So we are praising God and remembering to appreciate the people around us every day.

Heard that too. Pine cones and rocks and sticks(don't know what size).
Hope ALL zoos will put up cams so this doesn't happen again.
Also few more employee's at closing to check and recheck the goings on.

Oh, boy, do I ever agree about the cameras. They are needed to protect the zoo, the animals and the visitors. It's such a no-brainer that I wonder why cameras weren't in place already.

About the pine cones, rocks and sticks. I first heard that in the same report that mentioned the shoe in the moat area, and the plank across the moat..........has it actually been confirmed that these items WERE found?

This is OT but I was talking to a few posters earlier in this thread about cats in my area where I ride my bike. Lo and behold a lion came down in our area yesterday. Glad I wasn't on my bike :)

BE CAREFUL!!!

I guess Geragos is going for Civil cases now. Probably more money for him. He is also representing the family of the girl that died because the insurance company wouldn't approve her liver transplant in time.

He might as well try civil. Criminal defense wasn't working very well for him. OR his clients.

Yes, in the eyes of the law, the tiger being able to jump the fence just as the dog jumping the fence would make the "owner" liable. I don't have an issue with the zoo being accountable for the fact that the tiger COULD make the leap. The "responsibility" of the young men, in my eyes, would be more to the friend if the brothers were the provokers that "got their friend killed". That would make their liability to the deceased & his family. If the victim also taunted, then I'm not sure there would be any legal accountability or at least in my eyes. Now that is NOT saying "they got what they deserved" but if they were all three "instigators of the event", then it's just sad fate that one died but two survived.

Do we know that Souza wasn't also tormenting the animal? If harrassment of the tiger was what encouraged the tiger to escape, Carlos could well have been involved. In fact, he was hanging out with the brothers there - I'm hard-pressed to think that if they were hassling the tigers then he wasn't. Just my 2 cents.

If this is the case then of course Carlos's actions resulted in his own wrongful death.
