Facilitation does not carry death, only life

If jury rejects those, will consider facilitation, means u helped but didn't intend to share in crime fruits

Criminal responsibility: if shared in fruits and helped, doesn't matter who did killing, still can be convicted

Break for lunch. Going to read the law after lunch then closing arguments.

FWIW, reading the law is boring and can take forever!

Judge Baumgartner seems to agree. ;)

Thank you, Prairie.

Now that the sides have rested, my head is reeling with things the jury wasn't told, and wondering how much the ADAs can say in their closings...

e.g., Unless I missed it, the ME never told them that she found evidence of a chemical, like bleach, in Channon's mouth or ...below.

Without that or Vanessa's testimony, how far can TK or Price take it in closing? :sheesh:

Yes Muffet, so many things... like GT, and Boyd barely mentioned either, wth.

Death still on table if jury deems him criminally responsible for any of murder counts

Lesser charges: robbed vics of personal belongings using force/weapon

Especially agg kidnapping - used force/weapon to deprive of freedom and caused serious bodily injury

Basic charges: 1st degree murder - premeditated, meaning decision made to kill, doesn't require long plot

Felony murder - vics killed while suspects carrying out either robbery, kidnapping, rape

Only those counts carry death as potential punishment
Even if they're crazy enough to have doubt about the rape, it's gonna be hard to say he didn't rob them, considering he was wearing and giving away their things.

His prints on the trash bags and "explanation" about his gun being used in the murders have to convict him of the murders themselves.

But Muffet (or anyone) pros can't bring up stuff in closing that wasn't introduced already, can they? Sorry I know, I need Trial 101 :blushing:

Darn it is just so hard for a jury to agree on the death penalty. I with they had something in between life and death like live on death row in a small cell 24 hours a day all alone for the rest of your life, that would be easier for a jury to agree on.

I don't think they can.

I thought they showed that he was wearing Chris' tennis shoes and gave the clothes to Daphne...?

ETA: same for the prints and his interrogation...

...with the only TV show being Nancy Grace harping and screeching in their ears. :D

Now that would be a living hell. LOL

It would be for my husband, (Laughing) he hates Nancy Grace. I can handle her once a week.

Oh I meant about some of the other stuff that wasn't introduced, ie if the bleach on her shirt was mentioned eg, then can she go there (re bleach elsewhere)? And lots of things that may be disallowed in closing because they were never admitted.

IMO

There won't be doubt about the rape of Channon. There won't be doubt about her murder.

There may be doubt about the rape and murder of Newsom, but they may get this one on that.

There may be doubt about the murder of Newsom, but I think the prosecution may have done enough to get him this time, at least on something...unlike Cobbins.

This point in a trial is always scary but I really the defense has done enough for Channon and all they can for Newsome. I think it may be enough for conviction, however they may not go all the way to death.

Well you might have close to your wish... if he is given DP like I think he will, he will first spend years on death row.
