#JosephDaniels - The jury sent two notes for this witness:

1. If multiple clothes were in the hamper would that impact the K-9 and the scent article?

2. Can an aerial map of the area around the Daniels' residence by provided?

Before the jury: Judge says if they show something on the screen for attorneys not to block the screen.
Re: overview map it will come up later in the case.
Re: first question judge asks witness if sample came from a hamper with other clothes, would it have made it more difficult for the dog to follow the scent?
Answer: to paraphrase, it shouldn't matter.
Dog will follow predominant scent.

Puts up an aerial map shows a triangle of streets. Witness points out where defendents house is and where pond/stone house is.

Now the jury hears Brent Morse's testimony that he heard 3-yr-old Noah say, "Joe dead. Joe dead. Joe dead" and Aunt Joyce said, "Yes, baby. Joe dead." Then she picked him up.

Pictures of the house. Appears to be a modular type. For so many people who are home all day, it doesn't look like anybody bothers to mow the front yard. Bed of a pickup on the property is full of trash. He was shown the latch on the interior upper part of the door by people in the house. A hutch blocks access to the front door of the house. Note to self: a really dangerous situation if a fire would occur in that home, especially given all the toys and stuff piled everywhere.

1. Did 3-yr-old Noah say "Joe dead" as a statement or question?

A: Question

2. Was the tractor trailer searched?

A: Eventually it was

These jurors are all over this! I love the jurisdictions that allow jury questions. It should be allowed everywhere. They have the task of the verdict, they should get to ask something the attorneys didn't cover (within allowable parameters).

Witness says Alex said nothing. Now testifying to what 3 year old said. Describes aunt as 'elderly woman'. Two guys who work together looked at each other after hearing what was said. Mom and dad were not in the room when statement made, had gone to look for an item of Joe's. Men proceeded to search property. Found open sewer system in front of the property which was full (ugh if you've ever smelled an open septic tank)

Defense: Witness arrived around 1:00. Conversation around 2-2:30. 8 people in the house. One person half in/half out of house. Lots of responders on scene, search coordinated at neighbors house to right. He had parked down the road. Noah didn't ask, just said the words. Didn't hear anyone else mention Joe being dead, thought is was a missing person.

Two jury questions: Jury steps out.
Did witness perceive words as a question or statement? He thought it was a question.
Was the tractor/trailer searched? Witness will be asked in front of jury if he knows.
Issue of pictures being shown to witness prior to being identified by witnesses. Judge agrees they should be authenticated first, then published to jury.
Short break for 15 minutes or so.

#JosephDaniels - Clarification: The jury hasn't been given these answers to their questions yet. The answers are what was said when judge/attys were discussing w/o jury present. Judge is going to tell them the first one was asked/answered under cross.

Jury also asks judge for a tour of the courthouse. Judge says, Absolutely. He will set it up. This is a brand new building - justice center. (photos: Home | Tennessee Administrative Office of the Courts)

Witness full name is William C Bailey
With fire department 13 years, emergency services for 31 years
Search and rescue team described for jury, includes Law Enforcement, Firement, EMS, park service, volunteers. Thermal imaging, tracking used, aerial devices, k-9's.
Blackwood got call 11:30ish request for help with missing possibly autistic young boy. Arrived Dixon county around 1:00 p.m. He came with Blackwood and they met up with Mr. Morse. Got their assignment and said a prayer. Went to defendant's resident. Identified picture of back porch of house, clasp on upper left corner of back door & hanging fly trap (classy, eh?), key to a master lock on mantel, masterlock on mantel, toys piled by back door, coffee table,

First worked on questionnaire outside, he stood in doorway with one foot inside the doorway holding the door open listening to what was going on inside. Heard young person say loudly 'Joe dead' three times and older woman say 'yes baby Joe dead'. Could only hear voices, not see. Mentally thought to himself the situation had just escalated. Asked other person standing outside if he heard that and that person had not. Mr. Daniels came up and witness asked Daniels what relation he was and asked him about the door latch. Dad says he found lock in the toybox. Dad says he thinks Joe found key, pushed coffee table to door and unlocked the padlock.

Witness asked what he thought upon hearing that. Attorneys argue. Testimony aligns with prosecutor opening statement
