He may have known about the video and photos, as we don't actually know whether it was some hidden recording. We simply do not know how that all came about. Before the media got a hold of the affidavits and learned of the existence of a video and photos, but after RP was arrested, it was known in the "wild" (social media) that a video and photos were known to exist and were sent by SP to an individual. Tripping across such posts might shed some light.

So if I’m reading this correctly, he can be charged with statuatory rape and rape by an authority figure?

I’ll answer my own question. Yes, this would qualify as statutory rape by an authority figure. This site does a great job of defining the age of consent laws in TN: Tennessee Rape and Sexual Assault Laws - FindLaw

Edit to add: Still uncertain about “incest” if she is not a biological child. I can see if she was legally adopted, it might qualify . . .

Well you could have a willing participant that legally cannot consent. For example, you could have a 16 year old willing have sex with a 26 year old but the law says you can't. So just because a person consents doesn't mean or lessen the fact that it is rape. Not every rape is a forced or even coerced situation but it is rape nonetheless.

He certainly can be charged with incest under Tennessee law which covers adoptive relationships as part of that statute.

Interesting case in TN from 2016 that wrapped up in 2018 with dismissal:

In 2016, A 28 year old truck driver was arrested and charged with the statutory rape of a 16 year old girl. (She was impregnated by him.)

I suspect this was dropped when she turned 18 and didn't want to cooperate.

That could very well be the reason. There was lots of activity (on/off market) in between sales. And the ‘07 price was typical of the market around that time (overpriced).

You are wrong in your basic understanding of consent, coercion, and force. The laws are not arbitrary, the are based on research in human development, brain development, sociology, etc. A person who cannot give consent can never be a willing participant, and for good reason. Moo.

It is because we know better, but it is not couched in mysterious terms that don't tell us anything. If they had said "molesting" or "sexual assault" or even "raping," there would be many questions wondering about the extent of the SA and what exactly occurred. We are left with little doubt of his actions.

Except that if the party is under the age of consent, then they are deemed incapable of consenting. It can't happen consensually. The language is bad, and I'm at a loss to understand why the article makes a point of using it.

I, too, am glad to see the word rape used, but, how in the world can it still be alleged? I know people are presumed innocent until proven guilty, but that seems absurd to me. IMO
The pictures tell the story.

Legally, they have to say “alleged” until convicted in a court of law.

Looking at the Zillow information. The house was built in 2007. So I believe it was just the property sold in 2005, a house was built on it & sold in 2007, then the whole market crash and that’s the reason for the many price drops after. MOO
