Jmo I think reports are shying away from using “rape” in relation to the video since he has not been convicted of it as yet...though they could still phrase it better.

This supports the affidavit that SLP did capture the video/photos.
He didn't know about them!
He didn't realize that he needed to get out of Dodge. Well, Madisonville actually :)
He may have known about the video and photos, as we don't actually know whether it was some hidden recording. We simply do not know how that all came about. Before the media got a hold of the affidavits and learned of the existence of a video and photos, but after RP was arrested, it was known in the "wild" (social media) that a video and photos were known to exist and were sent by SP to an individual. Tripping across such posts might shed some light.

Tennessee Age of Consent & Statutory Rape Laws

So if I’m reading this correctly, he can be charged with statuatory rape and rape by an authority figure?
Can he be charged w/incest if SP is not his biological daughter?

Another case . . . Jonesborough, Tenn. man charged in Sullivan County statutory rape case

I’ll answer my own question. Yes, this would qualify as statutory rape by an authority figure. This site does a great job of defining the age of consent laws in TN: Tennessee Rape and Sexual Assault Laws - FindLaw

Edit to add: Still uncertain about “incest” if she is not a biological child. I can see if she was legally adopted, it might qualify . . .

That's strange and annoying. The article refers to it as a "consensual sex" and then in the next paragraph says that she can't consent. WTF?
Well you could have a willing participant that legally cannot consent. For example, you could have a 16 year old willing have sex with a 26 year old but the law says you can't. So just because a person consents doesn't mean or lessen the fact that it is rape. Not every rape is a forced or even coerced situation but it is rape nonetheless.

I know, been sitting on that for a while, thinking about it. It is odd. Thought maybe there was a strange history w/that property.
It was likely a flipper who bought it from a long term owner, fixed it up and put it back on the market.

He certainly can be charged with incest under Tennessee law which covers adoptive relationships as part of that statute.

3/8/2005 Sold $50,000 -- $20 Public Record
4/30/2007 Sold $310,000 +520% $121 Public Record
8/21/2017 Sold $299,900 +5.2% $117
3/21/2018 Sold $230,000 -13.2% $90 Public Record
12/21/2018 Sold $260,000 -3.7% $102 Public Record

That could very well be the reason. There was lots of activity (on/off market) in between sales. And the ‘07 price was typical of the market around that time (overpriced).

You are wrong in your basic understanding of consent, coercion, and force. The laws are not arbitrary, the are based on research in human development, brain development, sociology, etc. A person who cannot give consent can never be a willing participant, and for good reason. Moo.

She can't legally consent, due to her age and he being an adult.

I don't think they need to tho, since he has been charged with rape.

@Jethro4WS is the one with all the lowdown and will correct me If I'm wrong, I hope. I don't know when they met but I believe they married in 2007.

I wouldn't get near this guy with a 10-ft pole!

MOO
I would, but then I'd be serving time.

“The search warrant indicates they found explicit video and photos of Randall Pruitt having sexual intercourse with his adoptive daughter in her bedroom.”
Has anyone seen the search warrant? Please tell me this lingo is not in there... Stomach churning.
It is because we know better, but it is not couched in mysterious terms that don't tell us anything. If they had said "molesting" or "sexual assault" or even "raping," there would be many questions wondering about the extent of the SA and what exactly occurred. We are left with little doubt of his actions.

Except that if the party is under the age of consent, then they are deemed incapable of consenting. It can't happen consensually. The language is bad, and I'm at a loss to understand why the article makes a point of using it.

I know, that's my point. Very annoying and misleading.

I, too, am glad to see the word rape used, but, how in the world can it still be alleged? I know people are presumed innocent until proven guilty, but that seems absurd to me. IMO
The pictures tell the story.
Legally, they have to say “alleged” until convicted in a court of law.

Looking at the Zillow information. The house was built in 2007. So I believe it was just the property sold in 2005, a house was built on it & sold in 2007, then the whole market crash and that’s the reason for the many price drops after. MOO

Who said the laws were arbitrary or that I believed them to be. I explicitly stated that it is rape. I have no idea where you get a different meaning.
