If somehow SP believed she and BR were in a relationship could rape charges against BR (if filed) be pled down to stat rape? Or is the age difference and the coercion just too great?
p.s. I hope she filmed him too.

This was kind of what I was alluding to but I didn’t want it to be misinterpreted as victim blaming. I think given the background of SP she most likely felt she was in a relationship with BR and IMO BR was able to use this to his advantage.
No restraints needed. He got to play the hero and she got the closest thing to “safety” as she could. Now whether he deliberatedly researched and applied grooming methods or if he just naturally fell into the role play ( ROBLOX anyone?) is yet to be determined. Obviously he made the step over the line between good and evil several times. I think there is some mental illness at play here.

I don’t think the age of consent is 14 in WI - have to look at the statutes but that would be rare IMO plus he is more than 4 years her senior as some states do allow consensual sex at 16 if within the 4 years ? I don’t remember where I read this maybe another case but the state and county the crime occurred in would prevail - IMO no way is this anything other than rape if proven - not sure of what degree but if visual injuries were present I don’t really want to go there - check the link posted upthread it details it out

Waiting for our VI Psychologists to chime in but we know SP was a vulnerable, suicidal, child that had been groomed and SA by adult male-- in a position of trust, allegedly for most of her life.

Out of all the people SP could confide in, I believe SP chose another adult male to confide in because she was groomed to do so.

I also believe BR preyed on this child while knowing it very likely that SP would thank him in the only way she had been taught.

This is so tragic. SP has been abused by every person she thought to be in a position of her trust. And that's excluding any female in her life.

Once arrested, Rogers admitted he asked her to email the video of the "full blown rape" and that once he had it, he drove to Tennessee to pick her up and bring her back, the affidavit says. Rogers admitted he tried to avoid any surveillance on toll roads and smashed her phone so it could not be traced.

The officers found the seven-minute video on his computer.

Maybe the whole MO link included a future plan of her coming out of hiding. Maybe they drove there and mailed the evidence to not only throw LE off track of where she was, but to set up a plan for him to return her to MO after RP's arrest so that she could present herself to the FBI in the same place that the mailing occurred. Maybe they had a pact that she would never disclose where she had been to protect BDR and keep him out of trouble, not realizing that LE had her social media accounts and could zero in on her location before they were ready. Maybe that was their plan to bring this to a conclusion.

One other thing, I’m confused bc LE said they discovered the video in her gmail but defense says now sent they sent a package, so which is true how they knew first? His defense attorney said this was how “presumably” LE found out about the video?

There are many new posts here it seems so I’m assuming there have been some developments today. Just wanted to mark this question in case it hadn’t been addressed.

IMO to gain her confidence so she would rely on him and him alone. He took 2 weeks to mail "something" to the FBI - we have yet to know what was in this package as we have not heard from them yet. Perhaps today we will have some answers?

This case is so horrible, I almost hate to read any more. How could this absolutely poor excuse for a man think it was okay to assault this young lady. She had already poured her heart out to him, he knew her father was sexually abusing her, and how could he even think to do this. Has he no respect for himself nor this young girl? It is beyond my imagination how sick this person must be to do this. How could he even prepare to have sex with her, knowing her father had already abused her. I'm not allowed to bring this case up to certain family of mine because it's so devastating for them to hear about.

But the sad fact is that abused and neglected kids are very vulnerable to additional abuse and/it exploitation.
ET, the survivor of another famous TN case is a prime example.

In fact people always bring up trafficking in missing cases but it is rarely true in my experience. Except in cases like this where the child has been abused or neglected or comes from other extreme dysfunction of some sort.

And it appears this child may have indeed been trafficked. For her "rescuer's" enjoyment.

Rogers sat quietly in court in jail clothes as Assistant U.S. Attorney Julie Pfluger conceded he may have initially had pure motives of helping the girl get away from danger. But Pfluger says Rogers lied to the FBI about the girl’s whereabouts and kept her in a closet of his mother’s Madison basement or in the trunk of his car.

Pfluger also says medical testing on the girl found injuries related to sexual activity not involving her father. The prosecutor says Rogers may also be charged with transporting the girl across state lines for sex.

A federal magistrate ruled there is probable cause to believe Rogers produced child and decided the 31-year-old Madison man remain jailed.

Tuesday’s court appearance was attended by Rogers’ mother and other loved ones.

Well... the latest news reaffirms the red flags that many of us saw, both in the original complaint and the doc released by BDR's defense attorney. JMOO I don't think anyone here was naive or missing information when they felt BDR was a "hero" or acted from good intentions. It's something I really like about WS - rarely do posters express an opinion without also explaining why they concluded as they did and this thread was no exception.

Now we have further information and can move on from there. I'm so sorry SLP had to pay such a high price in order to escape being raped by her father. I'm sorry she was preyed upon by a wolf in sheep's clothing.

But I'm glad she's now free from both. I hope SLP and her siblings receive excellent counseling and will be able to continue their lives feeling safe and loved.

Pfluger also said she was present for a sexual assault exam in Madison, where the nurse said there was recent sexual activity and it was "not possible these are from the father."

However, Rogers’ attorney said the “intent is highly relevant.”

The defense said the charges are “weak” and that this case is different from other child cases. Because of that, he argued Rogers should be released until trial, though said Rogers would agree to conditions such as location monitoring by GPS device, rules prohibiting his use or possession of computers or other devices that are connected to the internet, and rules restricting his contact with minors, among others.

“Bryan’s not going anywhere,” he said.

The judge did not agree, saying the lengths Rogers went through to hide the girl and what he was doing with the girl, as well as lying to law enforcement agents when first questioned showed “if he chose to flee, he could.”

One thing that seems amazing to me is how quickly SP took BR into her confidence. The e-mails released by BR's attorney were dated 12/27. In them, SP was pleading for BR's help and he was discussing her options (indicating that he was already aware of her situation.) To me they read as if they were correspondence between two people who are well acquainted -- however, it is said that SP & BR met on-line for the first time on Christmas Eve -- 12/24. It makes me wonder how he could have gained her confidence in a 3-day acquaintance -- which I suppose speaks to the level of her desperation -- but also makes me wonder how soon she first confided in him. That will probably come out in trial.

Hoping and praying for the best for SP, while knowing that it will be an uphill battle.
