In the case of unmarried parents, the mother's legal rights are far greater than the biological father's, as there is no issue has to whether or not she's the mother. Provided that he's challenged by a savy lawyer, Cruise will first have to submit to a paternity test to even present a claim to the courts. If he can't pass it, he's SOL. If he does, he'll still be fighting an uphill battle. Katie Holmes' father is an attorney and I suspect she can afford as good a lawyer as he can. Plus, the Scientologists won't want her airing their dirty laundry in public re her reasons for not allowing him custody, so he'll be told to shut up, sit down, and pay quietly pay child support.

If that's the case what an *sshole. He pulled the same chit with Nicole when it turned out to be that the baby she miscarried was really his.

I don't know if this is true. If the father is wealthy, he can claim all sorts of things about the mother and be awarded custody. It happened in the Manhattan case where the mother was a model, who got pregnant by her married lover. She had twins, which were eventually awarded to the father. It took time and mega-bucks on the mother's part to eventually get the girls back.

In the case of TC and KH, I can see it being joint custody as is the current situation with Nicole Kidman.

Somehow, though, I don't see Katie Holmes leaving Tom Cruise. At this point, she seems like a young, smitten school girl who will follow Tom to the ends of the earth. I just hope that changes with time.

I remember that case well. She accused him of molestation. I speak from very personal experience. These days you can't just accuse people of that willy nilly.

When my sis was going through her divorce 2 rs. ago she did the same thing and lost her kids (3). During the ordeal she said to me, "You know I will do anything to keep my kids, don't you? I said yeah and just blew her off because she tends to be very histrionic. That was 2 days before X-Mas. X-Mas eve she was supposed to go to church with me and backed out. Then next day (X-Mas) she told me she had gone to the police station and filed sexual molestation charges against not only the dad but the grandfather for molesting my niece.

Needless to say it backfired BIG time. Her ex sued her for Defamation of Character and she had to pay him and this month she goes to court because the grandfather is suing her for $50,000. They have lived in this community for over 45 yrs. and even though they are not guilty there is still a stigma from just being accused. Now grandpa is even scared to be alone (and doesn't) with his granddaughter. My 2 nephews live with their dad and I can't even have a relationship with them because if I go the house she feels I'm betraying her for consorting with the "enemy". Him and his family never did anything to me or to her for that matter. My niece is 1 week with her and 1 week with dad. Back and forth back and forth. The 2 boys do not see her or talk to her. They are 11 and 15. Sad man.

Sorry to rant but it's serious chit.

It all depends on how good your lawyer is and how much you can afford to pay them and how much you're willing to have come out in court. In Holmes' case, her father could simply do it pro bono, and I suspect Cruise is more leery of dirty laundry being aired than she is, as he's older and has more of it. Scientology is a cult, and when you get into court and start discussing the "religion" and its tenets, its hard for it NOT to look like what it is, and the high-ups in the Church know it.

I agree. The Scientologists would not want TC to go to court.

The Scientology attorneys can handle it and it would be done sealed. There's no reason to believe any of it would become public. The "Church" of Scientology has managed to keep most of its dealings private. This would be no different. Katie's child would be involved, so there would be no reason to publicly embarass its father.

I promised myself I would keep quiet on the Scientology thing from now on but here I go again.
I will however keep it short and to the point.

First, keep in mind Tom has access to Scientology money and lawyers as well as his own... not much competing with that- the "church" is LOADED!

Second, The Scientologists are not scared of anyone.. they intimidate and threaten (this includes the likes of the Federal Goverment) and have successfully beaten lawsuits no one, including the high powered lawyers that go against them, ever thought they could. I seriously doubt they will be scared of Katie Holmes.

OK- I'm shutting up again about Scientology.

Well, the Church is used to intimidating non-celebrities. And non-celebrities stupid enough to have bought into their horse hockey to begin with. And considerably poorer from doing so. It would be interesting to see them trying to go head-to-head with someone as savvy re PR and with far more positive national/international "face time" than themselves and a decent bank roll.

He can't get the child unless she either agrees to let him have it...or she is proven to be an unfit mother.

At best he will only get shared custody. He won't get to keep the child full time unless she agrees.

If they were married before the baby was born..then he would have legal rights to the child whether it was biologically his or not. If they are not married and she does not put his name on the birth certificate, then she can keep him away from the baby as long as it is NOT his biological child.

I doubt he is smart enough to even know what he is seeing in the sonogram.
