Trial By Ambush

So are we thinking that the Anthonys are actively scheming with "baez" in order for something like one of the following to help get casey off:

-Defense brings up protestors GA assaulted/GA threw a dude through a window a long time ago = he can't control his temper = they imply he killed Caylee or something to that effect - he pleads the 5th and they magically have reasonable doubt?

-Since Cindy has found out a way to magically erase her past statements, she'll continue with the "I was traumatized/on meds" excuse and then she'll have leeway to say any number of things to support a GA=reasonable doubt plan AND she'll be able to cover for various aspects of Casey's lies, etc like saying she put the dryer sheets in the car, etc?

HAve to say I don't see any of this working, but it instills a strong desire to see the Anthonys brought to justice. They have seriously crossed the line and we don't know the half of what they'll do, it's only the beginning. I hope they are BANNED from the courtroom until their testimony is over.

Also have to say I did not understand one iota of what the last witness was trying to say. Utterly nonsensical to me. Couldn't tell what he was getting at.

Don't think GA taking the 5th would help at all-KC said too much when she was a "witness" and she'd have to be the one to undo it.

As far as trial by ambush, not sure I liked HHJP's approach that all roads end at the federal courtroom's doorstep. I think they end only at the legislature's doorstep. Thank goodness AndreaL is no longer there, because, like HHJS, while HHJP does not seem keen to reinvent the wheel, he does seem to be okay with giving the federal court the blueprint to do it. My opinion is that the "wheel" patent belongs to the state capital.

Someone correct me if that is not what HHJP meant.

If as "sleuthers" we could come up with everything the defense could possibly try to ambush the State with, maybe we could "thwart" this whole tactic.

For me today, Cindy, lying, but explaining it with "It was so long ago", "I was traumatized, " " I was on meds" is going to be a GIVEN that the defense must assume when questioning her. The defense needs to be prepared for this (George and Lee, too).

BBM in red - How could someone be traumatized over a stinky pizza?

What medicine makes you lie for years?

I'm being facetious. CA's testimony is laughable and it may end up putting her in a little cage just like her daughter.

CA could recite page number along with line numbers during her Morgan testimony but she can't remember putting dryer sheets in a death mobile. Pulease!

IMO

I don't think the defense has any real obligation to inform the prosecution of any changes to CA's testimony. CA is among other things a prosecution witness. But as we saw today JA is not a stupid man. And every reasonable observer around here has known that CA would start playing these little testimony games. If we expect it, JA expects it, and the SA's are preparred to deal with it.

And c'mon JA knows perfectly well how it looks to the jury when the defendants mother suddenly starts "remembering" little details that favor the defense. CA playing her games does not hurt his case. Instead it just makes CA look manipulative like she is, and adds to the juries impressions of guilt for KC.

Do you think SA will limit CA and GA's testimony? Just ask them questions about the 911 calls, tow yard, etc. Not going into great detail and not asking what their opinions are? Get them in, get them out. Defense would then be limited on what they could ask, also, correct?

When it was convenient to pretend the trunk wasn't in need of an aromatic intervention: she didn't spray. When an explanation for a high concentration of chemicals is needed: she did. Of course she scrubbed, sprayed and manicured that trunk, that's the way she rolls.

Just tell the truth, Cindy. Remember Caylee and honor her memory.

I was wondering something about the ambush myself, from another angle though, from the side of the prosecution. There is still so much evidence that we haven't seen, or at least that we've all listed many times and quite thoroughly in other threads. Do we assume that these items will not be taken into the trial at all? Such as Mallory and Mark's depositions? Or does the State still have time for a last and final doc dump?

Baez did try on Friday! He tried to put in a chart that he updated with Dr. Furtons "addendum" to what he previously stated in that report...that is what got JA's ire up...he took Baez at his word but Baez' word is not his bond...you can clearly see the animosity between the two...JA is very passionate for upholding the law and Baez, well....he makes a mockery out of the justice system which shows he is an unethical attorney and that will catch up with him too...he might not be an attorney long after this trial is said and done...JMHO

I totally see the DT continuing to attempt to ambush the trial. I understand JA's frustration, he is completely prepared from those reports and depositions and makes sure every point is addressed. Later this will assist the Jury to not have a gaping hole that the DT brings up..that would leave them unable to have the clarity they need to make their decision. And that's what I believe the DT is counting on... so they are definately preparing for an ambush. The Judge has experience and he does research and can weed the crap out but with the Jury that may not be something they can do, especially as a team. This is why I see JA taking each occurrence aggressively and putting it on the record.

HHJP: (paraphased) "I wouldn't want to get caught doing anything you're not suppose to be doing." Now a trial is so much different as the judge reminded JB the other day, "by the time of the trial I will have read all the depositions...." Hidden message, "don't get caught......."

I agree that they will ignore HHJP's warnings and continue to try to ambush. They are going to try to throw as many Aha! moments in as they can in hopes of shocking the jurors better senses.

I'm not sure what "3 years worth of evidence" has to do with it. It only takes one small piece of information, one hidden issue of discovery that wasn't shared.

As we saw on Friday, (which wasn't the first time Baez made this attempt), Baez was once again testing Judge Perry and the State on this very issue.

And that therein lies the frustration. If it is a huge No No...once again the defense (and therefore the A's) are breaking the rules and getting away with it. Correct? Will this continue?

The most frustrating aspect of this case for me is the lying and contempt of court by the A's and no one stopping it. No one! Was is everyone afraid of?! This is about a little baby girl.

IMO, HHJP knows the SA has this in the bag, so, he is giving the DT more wiggle room to avoid problems from them down the road.

BBM - Should Cindy attempt this same lie during the trial, I believe Linda and Jeff will 'elaborate' on it in greater depth than they did during the Hearing.

Such as, "Mrs. Anthony, you are aware, are you not, that dryer sheets were also found in the garbage bag at the tow yard, some of them laced with weed, correct? Did you also climb the fence and place those dryer sheets in the bag?"

For those who are concerned that Cindy is "being allowed to lie" for Casey, please don't worry. The State is just letting out some more rope, but rest assured, they have a tight grasp on the other end. ;)

No, her next lie will be.. "Well I noticed the car was smelling right before June 15th, you know, before father's day, you know, before Caylee ever went missing, you know, so I put all those dryer sheets in the car, you know. KC must have thrown them in the garbage bag later, you know". :loser:
