This is confusing. These are either legal definitions - or they aren't. From everything I'm reading (journal papers) - the jury is out. The psych community wants this to be a legal definition, but I don't see (yet) where that has been formally established.

So it's basically an opinion of this mental health expert, but the DT is going to (imv) try to present it as legal fact - an equivalent to the definition of manslaughter vs. murder 1. I can't find anything that says this is true... still looking.


No witness should be allowed to give an opinion on an issue of ultimate fact -- such as whether a murder was premeditated or not, as that is the exclusive province of the jury. The judge will not allow such opinions from experts or anyone else in front of the jury.

Likewise, experts are not permitted to opine about the truthfulness of a witness for the same reason.

He didn't lose his license. It's set to expire in June of this year, but I'm assuming he'll renew it. I didn't hear his testimony about his reason for moving, but having lived in both NJ and AZ I would be really, really surprised if expert compensation or hourly rates in private practice would be higher in AZ than they are in NJ.

No, he said the payment rate in AZ was much lower than in NJ.

I understand now why Arias' testimony was so weird. "I think I did some thing to provoke Travis" is going to turn into, I'm just SO guilt ridden because I was a battered woman.
All of her words and actions on the stand now make sense to me - she was just trying to reinforce the testimony she knew was coming. How cunning and evil.

Samuels really emphasized that PTSD is the cause of Jodi's flat affect, and not the fact that she's a cold, self-absorbed narcissist who doesn't give a hoot about anyone but herself.

No, Wilmott asked why it took so long to complete the move of his practice, as he said he took 13 yrs to make the final move. And he said it took so long because the pay rate in AZ was much less than NJ.

What bothered me is he had to read some of the explanations. Any of us could have done that. I would think a doctor would have been the appropriate person to have interviewed her. This man specializes in sexual cases and I'll bet Nurmi has him on speed dial. jmo

Ms. Arias has referred to this expert as a "hottie biscotti" !!!! Don't ya think she was giving him her new cell number....no not phone...her cell number for future visits.

On February 7, 2002, I got home from work to find my 27 year old daughter had died. She had BPD and had been hospitalized 5 times in the last 15 months for overdoses of prescribed medication. The mental health counselors thought it was just fine to give her 3 month supplies of heavy duty meds. I had spent the last 12 years trying to keep her alive long enough for her to realize that her life had not passed her by and that she could still go back and finish college.

Anyhow, for the next year, year and a half, I would relive finding her, rolling her over, feeling how cold she was, her precious kitty was just going crazy. When police and ambulance arrived, I was asked a lot of questions....I know they had to. I worked about 25 minutes away and I would just blank out driving to or from work. When I relived it, I went through all the physical reactions too. Heart pounding, hyperventilating, etc. After two years I finally threw in the towel and got help from a therapist. MY PTSD made me relive the nightmare, not forget it!

In between selling his soul for dental work, he's been sniffing spray starch. Looks about 180 degrees the opposite of "flat affect" in this interview. Guess it comes and goes...:rolleyes:

JM cited some case law iirc maybe 401,402,403. I don't know what those are.

I am also confused.
