see my post to johunt. I agree they're both first degree. But proof of 1st degree premeditated murder is way different than proof of felony murder. That's why I think the State is backing up the premeditated charge with felony murder in case they can't get the jury behind them on premeditation ahead of time (gas cans, stolen gun, etc.)

It was interesting hearing the NG guest (can't remember her name) say that Jodi showed up at the dinner that night late and then took off unexpectedly early.. Confirms what we have all believed, that alibi was the only purpose of the RB trip.

OK WS'rs give me your thoughts......This has been REALLY bugging me..
To begin...
Two photos of TA in the shower

The shower seems to be ON as there is obvious water running over his face

Looks to me as if the shower has been turned OFF.
I see residue water on the floor but really nothing to speak of on his body.
TA's body looks dryer than i would expect if the shower were on.
I do not see running water in that pic.

With that said...
Who turned the shower off?

TA is sitting..... Could he reach that high to turn it off from that position?
Or....
Did she turn it off and create the perfect opportunity to better aim at stabbing him directly in the heart?

1 min 10 secs between shots #1 & #2.
the next shot, is the ceiling @ 5:31:14 - 44 seconds later

This is when he defends himself thus the camera takes to the floor

I really believe THE ONE intentional place she planned to stab him was...

In his heart.

Jodi went to extremely meticulous measures to carry out TA's killing...
The way SHE wanted it to be remembered.

And how does Jodi preserve treasured moments?
With photography.

Jodi intentionally had TA pose in a specific way....

With his hands over his heart ..


THAT was the very first shower photo

And THAT means pre-meditation.

Travis was shot in the face while seated in the shower, but he flinched to his left, which caused the bullet to enter above is right eyebrow and travel across and down his frontal lobe to lodge in his cheek.

There is no way a slight girl like Jodi would attempt to stab a seated guy in the shower, especially one who was a wrestler and had been working out. He would have disarmed her quickly, and his vital organs were protected. She thought that she could just shoot him and it would be over in a flash.

She did not count on the shot knocking him over but not killing him immediately. When he groaned and stumbled to his knees (on all fours) she was horrified that he was not dead, and then terrified that the gun jammed.

That's when she went for the knife. By the time she returned with the knife, knowing that she had passed the "point of no return" and HAD to complete the original plan, he had pulled himself up over the sink. Notice the wet (blood + water) stains at the edge of the sink, while he was coughing up blood as it drained through his sinuses, and was spurting onto the dry sink.

That is when Jodi started stabbing him. As he turned around she plunged the knife into his chest and he grabbed at the blade, but she was poking and stabbing him in a panic as he pushed past her towards the hallway to the bedroom. Like a woodpecker she kept stabbing his back until he fell at the threshold to the bedroom where she finally made him stop by ripping his throat open, whereupon he collapsed.

During the melee, the camera was kicked around, as well as the shell casing from the bullet, where it landed on a pool of blood.

I have had migraines since I was 12, I am now 42. The only thing that helps, when I get a terrible one, is Fiorinal. I try to take Exedrine or BC first, but if it persists...I take Fiorinal.

I just had one recently, it was behind my right eye and lasted for days! I feel so sorry for people that suffer from them. My son just turned 12 and I am praying he doesn't start getting them

ahh yes! Fiorinal! I got Fioricet by accident once... oh em gee...
The
"green pills" as I used to call them.


I use a lavender scented "bag" that is microwavable now... and 200mg caffeine pill. Or 2 excedrin during the aura... If I catch it soon enough...
keeps ME UP ALL NIGHT but not up and in severe pain!
Migraines are not fun.

I'm watching the re-run of NG - She just said that Juan Martinez has sent a woman to death penalty in the past and she believes he will do it this time. Let us pray that happens...

Has anybody watched that YouTube of DV expert LaViolette talking about Snow White being a DV victim? I found I couldn't sit through it and I can't really explain why. She's not arrogant and condescending like some other witness we've seen (today). She can be quite funny. But I found myself fast-forwarding trying to hear something interesting. IDK. I was hoping others had some thoughts.

Oh you're in for a treat if you didn't see the earlier airing. She has a guest that was a friend of Travis', and who has nothing nice to say about Jodi at all.

Then I think one of the charges should be second degree murder here is the Statute for that:

I have just spent the last hour and a half talking about this case with my mother. Ladies and Gents.....if there are people on the jury like her, this will not turn out good. She just can't fathom JA pulling off this murder (her dragging TA down the hall mostly) OMG I wanted to drag her!
I finally just had to get off of the phone :furious:

It's not easy talking about it with other people sometimes. I try and talk about it with my husband sometimes and he's like "He should've known. If a chick hides in your closet when you are out on a date with another chick, that b**** is going to KILL YOU!"

and he thinks Juan Martinez is annoying...and he thinks I have a crush on him. :blushing: psh...whatever...

Did you hear her getting cuffed? You couldn't see it but could hear the click. I think that was all for today but more is coming I'm sure.

I read the minute entries. The defense didn't withdraw the letters. They withdrew the objection to the State's motion to preclude them. They did that because they couldn't get an expert to give a sufficient opinion based on the copies they had. For ethical reasons, they let Jodi give it a go unrepresented so they didn't have to take a position that was not supported by the expert, who was unwilling to give an opinion based on copies. When she was unsuccessful, they immediately came back in as counsel. Nurmi has since stated, in open court, that an expert concluded that at least some of the letters are not forgeries. To me, this means that the expert's opinion would not be admissible based solely on the quality of the copies vis-à-vis evidentiary requirements for handwriting samples. YMMV. I think AZlawyer's post is totally consistent with that

Considering that the "originals" were conveniently destroyed, they were not available to check for the age of the paper, the age of the ink, and any of Travis' fingerprints or DNA on the paper or saliva on the (supposedly sealed) envelope in which they might have been delivered several years after his death, to unknown sources.
