This is a mess.

ALV is playing the role of 'Vinnie Barbarino' from "Welcome Back Kotter"

I hate to admit it but JM is not getting traction on his x-exam.
I think he's getting some traction but no where near as much as it could if ALV wasn't being so difficult. However this has all taken so long because she's being awkard and as always he's not letting her get away with it. Once she learns to play nice and not pull on her chain, he'll start doing his proper cross.

Today, Martinez, in regards to the restaurant incidents he stated something about Mesa being pretty big, etc. However, I thought previously regarding the reason that Jodi went outside of Mesa to rent a car he hinted that was Mesa was fairly small and too many would people would recognize her. I saw Jodi react when he said this today. Did he contradict himself? I hope that I am wrong. :please:

She went outside of Yreka (Northern California) Not Mesa. Mesa is in Arizona.

Mesa is big. Yreka is a very small town. That is where Jodi is from and that is where she went outside to rent the car.

FGS what now? THIS is what we have to look forward to each and every time Juan is up. Are they allowed to object and have sidebars during the rebuttal phase? Please someone tell me they don't.

I don't get why JM can't ask simple questions.

Example:

Ma'am - isn't it true that the only in person interviews you relied on in this case were those of JA?

And Ma'am - isn't it true that you have no independent coroboration of JA's version of events?

And Ma'am - if JA or JA's diaries are your sole source of a version of events or a story, you depend on JA telling you the truth?

And Ma'am if JA lied about a story or made up a tale about what happened wouldn't your conclusion be based on a lie?

He did ask all of those.

While it's EASY for all of us to sit here and come to the conclusion that AV is NOT testifying to the TRUTH and that she has NO clue what she is talking about and contradicting herself, the REAL question is "Is the Jury buying this?" Is the Jury SO burnt out at this point with this Witness that they are't paying enough attention to all of these minute details, are they catching all the contradictions in AL's testimony? Are they reading into this as much as WE ARE? I am worried that this Cross is expecting too much out of the Jury as far as reading between the lines and coming to the conclusion that we are all because we have access to much more of the trial than the Jurors do. I hope you all understand what I am trying to say....I am just worried that Mr. Martinez is isn't coming across well to the JURY.

I bet they LOVE him. Can you imagine the difference between 6 tedious days of Nurmi or Willmot vs. the electricity of Juan, jumping headfirst into it, full on.

I bet they much prefer Juan. JMO

It's a shame Mr Martinez can't pull out the autopsy pictures to show LaV her client's handiwork...wonder how she woul interpret them?

I'm sure that ALV's opinion would be that it was suicide.

ALV knows what she's doing too. Feigned confusion is probably the best approach with JM.

While it may be true ALV may be intentionally taking this approach, an expert witness needs to come across as self-assured and confident (to make a strong impact on the jury), and her overthinking every question, trying sooo hard not to trip up, and feigning confusion gives the opposite impression.
