trial day 42: the defense continues its case in chief #128

I feel bad for Travis Alexander - he was slaughtered. We see at least two pictures where it is clear that Travis Alexander is not a threat to Arias' life - so, why does she continue to butcher Travis Alexander? Arias is supposed to be afraid for her life - why doesn't she Arias use the time where Travis Alexander is incapacitated to flee and get help?

Thurston, I love how you think!!! :) That said..................

The bigger question is: Why did Jodi continue seeing Travis after (according to Jodi) they officially broke up a year earlier and there was 500 miles between them? Listen, if someone got raped the last thing they would do is walk through Central Park at 3AM in a mini-skirt and a luring eye, ya know? I would think there would be natural precaution in place so to avoid ever being a victim again.
Jodi didn't exercise that because obviously... it (abuse) never happened!

Personally I think Travis and Jodi's relationship was nothing but one elongated one-night-stand. They never told one another they loved each other.

But the more perplexing question is: How can Travis even WANT to see Jodi again after the: stalking, hacking accounts, anonymous John Doe email, unlawful home entry thru doggie dog, slashing tires, lying about "Steve" and being called a sociopath? Because my mind just won't bend enough to ever allow me to consider, Jodi was a welcomed guest that day.

LaViolette as a witness makes me angry - LaViolette seems unable, unwilling, and not interested in being a witness that answers The State's questions. LaViolette violated not only the sanctity of court - but knowingly made light of the severity of the crime when LaViolette said, "Mr. Martinez are you angry with me?" LaViolette knows better - LaViolette knew that she was being sarcastic and cocky. LaViolette has no reason to behave in an offensive manner - The State is doing their job. LaViolette goes out of her way to be difficult instead of answering the questions - in fact LaViolette stated that she performed testing as an undergraduate, then, goes on to say that she is unfamiliar with testing. It cannot be both - LaViolette treating the court in a hostile manner is off-putting, IMO.

I originally viewed her as the paid enemy who is doing nothing more than earning an immoral paycheck. But now?....I gotta say, I really don't think she was given the full background on her client. I think the DT cherry-picked parts of Jodi's relationship with Travis and fed it to ALV. For instance, I don't think she knew Travis had his and his girlfriends tires slashed nor do I think she knows another gun was found. Remember, witnesses aren't privy to hear testimony prior to taking the stand therefore, ALV hadn't heard previous witness testimony and probably NEVER saw Juan's 'technique' when prosecuting before. I think his style if you will, caught her completely off guard.

LaViolette states that she does understand DNA because she has read about it - but then goes on the say that she does not understand DNA. LaViolette putting on a "show" by throwing out comments such as "The FBI Profiles People - then they put that into a computer," is ridiculous. More so, it shows that LaViolette is not interested in the truth - LaViolette is only interested in giving answers "okayed" by the defense.

I've never seen defense witnesses behave so poorly in court.

I believe ALV is trying to save face. I believe the DT spoon fed her 'facts' on Jodi so ALV could come to no other conclusion other than Travis was an abuser either mentally, emotionally or physically. I think they didn't worry too much about the cross-exam because ALV probably could hold her own seeing she's a feisty dame!

If I were on the jury, I still would be upset that LaViolette purposely made a flippant comment - then smiled as her 'friends' jeered. There is no room for this when the reason everyone is in that courtroom is because a human being was slaughtered - we know that he was stabbed almost 30 times, his throat sliced, he was shot in the head. We do not know the possible torture Arias subjected Travis Alexander to before she butchered him - we know that Travis Alexander did not have much to eat on June 4 and missed an important business call at 7pm. It appears as though it is possible that Travis Alexander was Arias' prisoner - unable to freely do what he wanted on June 4th - then when Arias decided it was time, Arias slaughtered Travis Alexander.

Witnesses, courtroom observers, everyone in the court should behave in a way that is respectful to The Courtroom. LaViolette has gone out of her way to disrespect the court - and I find this type of courtroom demeanor to be rude.

I hope that no one in the jury feels badly for LaViolette - she chose to be part of this. Unlike Travis Alexander - perhaps The State should remind the jury daily the horrific damage Arias inflicted to Travis Alexander's body.

I'll end by saying and restating this: I didn't like ALV right out of the gate. I didn't like her attitude and honesty?...I was offended that she was defending a person who doesn't deserve any validation but.......I do have a modicum of pity for ALV now. I really think she was hoodwinked and I am hoping by the time Juan is through with her, she will openly and professionally admit, she might've gotten this (assessment) wrong

http://www.360mainstreet.com/article/1091/profile-of-an-fbi-profiler

"Profiling, she says, is not admissible in court as evidence “but when an offender is ultimately arrested, the profile created of him or her by a profiler is 80 percent accurate at a minimum even if it did not lead specifically to the arrest.”

80 percent accurate at a minimum is darn good for someone you have never even met, who is just a ghost to you moving through the world, and whose only reflection you can see is in the behavior prints he has left behind.

These guys are good! You could win a bundle in Las Vegas with those odds.

IMO

Well all is clear in the nasal area. I need to get back to sleep so I can watch Juan dismantle this obstinate witness.

Ok, so I was able to see testimony yesterday..what there was of it. I can't say how mad I was it was so late! Doesn't the DT know I only have a limited amount of time to watch live????? :floorlaugh:

Couple things come to mind though about the new defense motions. First, the product released by the Prosecution..wasn't that the FOI stuff, the parents video interrogation etc? I can't see how that would be the prosecutions fault. If its public its public. Nurmi/Wilmot need to be proactive in trying to change the rules not use it as a means to mistrail. Also, if we are to believe and take faith the jury is telling the truth (which I do) about not seeing/hearing/talking about the case, the only circus is continually bringing up the stuff being said in the media. Its almost like the DT is goading the jury to see what they are missing and comparing what they are missing to the Salem Witch Trials. Last I checked, Ms Arias and team have spent over a million dollars in making sure she has a defense. She IS getting a trial, nowhere near what a 'Witch Trial" would be as there isn't a trial. And it sure wasn't years of waiting to gather evidence and months in the courtroom. Again frivilous at best imho.

I am also a little confused on a few things. Its ok for JA to make faces and smile and all these little things like stare at the jury and the audience. Its ok for the witness to approach a member of the family etc. Its ok for the relatives of the accused to sit and talk, laugh and shake their head. But God Forbit someone on the Prosecution raise their voice or complain. The poor jury. Sounds like they can't do anything right. Any move and everyone on the DT is jumping around looking at the audience for secret signals. Its really bizarre actually.

In the end, I don't think the motions will go anywhere. However, I wish the judge, in open court would chastise the DT for continually making this a circus on their own accord. JA has admitted killing TA. Regardless of why she did it, she is guilty of doing so. I will admit there are times that JM gets a little loud, but the DT has pretty much stood at sidebar every ten minutes when it happens. Its not like they haven't said anything. And their own witnesses have a tendency to be a little snarky themselves. Lets counsel our witness on what to say and how much to say. Their own witnesses keep talking and talking and talking opening doors that should be left closed.

Last I checked we live in 2013...social media, texting, tweeting etc are the norm. Isn't it funny that the defense has no problem using the concept to their advantage but don't want the rest of the world to use it. If the witnesses are too scared to tell the truth, there is more to it than social media. Its not Joe Blow from the corner store up on the stand telling us this stuff. These are experts. Who have been part of other trials according to them. They are getting paid to do what they do. If it isn't popular..and by her own admission (ALV) domestic violence is finally something coming to the forefront with her help, then whats her beef? RS has a bigger beef probably but his testimony is over so there is no need to use him as a basis for anything.

Anyway, I just wanted to make those comments..sorry for the length. Unfortunately I don't have many to converse with about the trial. My dh will listen and make conversation but its definitely not his thing. Now that the NCAA tournament is over maybe...

The above is simply my opinion and nothing more.

That's not a bad estimate for "good" profilers. However, a good profiler will change their opinion as more information is revealed. While watching a lot of true crime shows, I've learned that profilers can be astoundingly accurate. JMO

Well :offtobed:

Requests for evidence by the media aren't handled by the prosecutor, IIRC.The one motion sounds like it was forced upon Nurmi and Wilmott by Jodi. JMO

Steely,

The Salem WitchCraft Trial analogy----that was NURMI who brought that up. In his motion to dismiss he says this trial is analogous to the Salem Trials. What a moron.

Well RE profilers and their accuracy. Maybe

But I for one would like to see outside agencies or references judging their accuracy, and not they themselves.
I've seen several on TV over the years get things very wrong.
I'm sure they have many successes too.

She turned me into a newt!

(I got better)

Nice video of TA.
Shows his humor and other things.

He even throws a good front kick at about 1:20.
I guess Jodi surprised him.

Will this trial EVER end??? I need to move on with my life!!! I need to learn to pull myself away from this trial. My house is a mess, and my children need me.:violin:

She is sooooo guilty and her smirking/eyeballing the jury is making me ill. :furious:

okay, I needed to get that out there.

They're running Dr. Drew now and I LOVE Janine Driver. She just said that ALV is NOT LIKEABLE. ALV is condescending and I forget the other word she used, but I agree 100% with her.

Janine Driver is wonderful, so smart and insightful, and one of two reasons I bother watching Dr. Drew (the other being the minute moments of Beth Karas). She was so anxious to speak her opinion of ALV she said she'd nearly bitten her nails off waiting for the chance to express them. lol

Really can't stand any of the HLN shows though. Repititious. Banal. Incendiary. Salacious. They won't let anyone speak for longer than 5-10 seconds, and even then the speaker is interrupted after 3 seconds.

Give me a show where Beth leads, with plenty of time given to her own impressions and observations, spiced up with Janine's as well, and then some reasonable opposition. A magical place where people are rarely interrupted and discussions, debates, analysis can actually acquire depth and real insight. Sigh. As it once was on CourtTV in days long, long ago and far far away (pre Turner).

A friend and roommate of Travis, name Zack, was contacted. He was asked if he saw Travis? He said no. He had to use Travis' KEYS to get into his bedroom. The door wad locked. Jodi in her FOG knew to LOCK HIS BEDROOM DOOR. I wonder if JM even knows this?

Yes, Juan asked the defendant about it during cross

Morning all, doctors apt this morning at 10:15.....first one in about 20 yrs.....prayers appreciated. Thinking court will have a late start just for me so I won't miss anything juanderful!!

LOL!

I agree. I started a new job 3 weeks ago and before that...unemployed and able to get things done.

Now.....I get home from work and get right to the trial (AZ 3 hours behind NY). No kids, but dinner is turning into a nightmare. Yesterday I put leftover Enchiladas in the microwave for my husband. Put it in for 45 MINUTES instead of 45 seconds...came back to the computer, and after a little bit thought, gee, why is the microwave still going???

I fed it to him anyway!!:what:

Hello all!

I have a lot to catch up on. Hate when my life stands in the way of dedicating myself to this full time. ;)

I had a sweet dream about JM. I woke up with a smile on my face. :blushing:

Ok back to reading posts!
