I LOVE the mature, professional presentation of this witness!!!!


JM is SO getting across to the jury that the titles & education of the experts are important when establishing the baseline, THEN the relevancy & presentation under OATH is the CORE of the material!


HOWEVER, I'm "guessing" that JW et al. are going to attack Dr. D on her experience vs Dr. S & ALV COMBINED.......which will NOT be a DT win!, IMHO.

Really, Travis being afraid of JA is beyond the scope JW?
 
I finally got caught up with my work and finished my last conference call and am able to turn on HLN. I read about 10 pages, (you guys are fast, so it did not take that long), and I was so confused. I realized HLN is way behind you guys. LOL, the fog has lifted.
 
I'm trying to figure out exactly what JW can use in her cross? Really, what can she say? She'd do well to just pass the witness, but she won't. Bumbling DT
 
I am just floored. Did the DT go out of their way to find people completely inept to set up grounds for appeal? Could they later claim their witnesses were soooo bad and incompetent that they should be allowed an appeal? Please tell me they can't do that!

Eta: it just seems so unreal (and too convenient) that both their experts seemed to make outrageous errors in their tests/evaluations.

BBM: Here's hoping the Appellate Court says, "You dance with the one that ya brung!" :rocker:
 
If there are inconsistencies with JA and her accounts of things that makes it very difficult to properly evaluate. that is why other substantiating info is so important.

JM brings up the TA extremely afraid of JA re her stalking behavior. Discussing ALV disbelieving TA about that.

Asks DeMarte if that is useful info to have and whether ALV should have said she "disbeleived" it.

Does ALV's approach lend itself to her being able to discern TA's truthfulness in that email.

DeMarte it means the objective data (words) to subjective data (opinion about words and their veracity).
 
I hope that the jury is watching Jodi at least occasionally and that they notice how rude and childish she is acting during this witness' testimony.

this is one piece of objective evidence - you use it as a piece of data. . . .
whether or not this is something to be believed . . . approach make it better for eval.

what that does is chnge from objective to subjective data - something to read . . .

She was provided with notes and an audio recording of LaViolette's interview with Juan. She (LaViolette) stated she looked at records and spoke to Jodi as her 'process'. DeMarte points out that a huge chunk of an objective diagnosis would be testing.

She basically states having as many objective sources as possible is important so all the information isn't coming from Jodi directly. We're onto stalking now - DeMarte states there is no way anyone could possibly know if Travis was afraid or not - if it is a truthful statement. (Willmott's objections every .3298 seconds are driving me mad!) Reading into what's written changes something objective into something subjective.
 
As far as the defendant having materials there to work on, it is sometimes used in trial. (John Couey was given a coloring book and crayons) It is hoped that keeping them busy allows them to kind of disconnect during testimony that might be difficult for them. It is hoped that it will prevent them from fidgeting, prevent outbursts and help them to maintain control. They would have been coached to busy themselves if they begin to feel upset.

My guess is that this witness is upsetting JA
