trial day 48: REBUTTAL #147

Lurker here.

I gotta say, I think Dr. D stole the show today, even upstaging JM. Her mentioning pedophilia during cross was the highlight of the day. It left JW speechless and without a response. wow.

Dr.D: "...for example the pedophilic behavior."
JW: "Okaay. (7 sec pause) ..and later on in your career...well..i think just..i guess..."

Dr. DeMarte sure hit one out of the park with the pedophilia dissertation during cross. Ms. Wilmott would be wise to recognize it for what it was - a shot across the bow. I said it yesterday well before JM completed his direct, the DT would be wise to ask a minimal number of focused questions of this professional and then sit down quickly. I can already tell, that isn't going to happen. I smile at the thought however, it is clear to me that Dr. DeMarte already has Ms. Wilmott's number, figured it out quite quickly as well.

Is Wilcott allowed to ask Dr.D about things JM has not asked Dr.D about? Is she limited to the topics JM brought up?

The terms sociopath and psychopath are often used interchangeably by the general public. Neither is a diagnosis in the DSM-IV.

Basically the difference in the sociopath and psychopath are in the difference of the believed or determined origin of the behavior.

An easy way to think of it:

nature = psychopath-behavior is a result of biology, genetics
vs.
nurture = sociopath-behavior is a result of environment, relationships

It is almost amusing how many young women consider themselves photographers because they have a digital camera and know how to use a few filters in photoshop.

The media has also called her "The Mormon Casey Anthony". She's no more a professional photographer than she is a Mormon.

No more a professional photographer than a Mormon...:floorlaugh:

On a serious note, I was really :D when Dr. DeMarte brought out Jodi's chameleon qualities such as dying her hair blond and buying a certain car to appear more like Darryl Brewer's ex-wife when she was with him or trying to dress and act more business like around Travis and becoming a Mormon because Travis was. Very interesting stuff that was.

Well, for the jury to hear antisocial personality disorder with violent features or psychopath disorder has a sinister sound and prejudicial reaction. The defense wants the jury to feel sorry for Arias to see her as the "victim" not the cold-hearted killer that she became.

My :twocents:

I understand what you're saying. Sort of.

This morning's fog is thicker than usual.:floorlaugh:

Did the judge rule that an Antisocial Personality Disorder diagnosis could not be testified to? If that's what she has, that's what she has. Weird.

Many days I am in a fog, I will never look at it the same....lol

Neither Psychopath or Sociopath are listed as a diagnosis in the DSM-IV, while Borderline Personality Disorder is.

That's true, but psychopath and sociopath fall under Antisocial Personality Disorder, which is listed in the DSM-IV.

There are millions of people globally who have BPD who have never committed any crime, let alone slaughtering someone. If JA does have APD, that should be revealed so as not to stigmatize others with BPD and also to explain more in depth why she slaughtered a human being. Just having BPD does not explain why, IMO.

Good point, and well stated, Nhic! I wholeheartedly agree! :rocker:

Maybe wishful thinking here, but keeping in mind how very crafty Mr. Martinez is, I think it is possible that this issue may have been held back from the direct examination. JM seems to thoroughly control the information to the jury for delivery at a more appropriate time, typically after the DT has committed to a line and then messed it up.

Apparently, since it was not mentioned in JM direct re-buttal case. It isn't weird because the connotation of Antisocial Personality Disorder has sinister Dexter "picture". Remember (uuuuugh) the Defense wants the jury have a picture of Arias as the helpless "victim" of the treacherous perpetrator Travis that she had to "defend" herself to the point of having to "slaughter" him. (oh so gross that I had to type it this way)

JM can only present evidence to "re butt" the evidence in the defense case in chief.

Does this make bit more sense? I hope Don't like it but this how trials are done.

Just my :twocents: on legal understanding. If the REAL attorney can verify if I am right or wrong please come forth after their morning coffee so they can think LOL

Am I the only one that thinks the defense's case was kind of weak? All they had were Jodi and the two "experts". Now Jodi is a proven liar and everything the two experts testified about is based on the word of a liar.

You are not alone in that view of a weak case. However, given the defendent and all her lies, playing at trying to outsmart Detective Flores, blabbing non stop on 48 Hours, multiple stories of what happened, and then the debacle of the experts, I can't see how they could have had anything but a Mt. Everest uphill battle from the beginning.

Completely agree she must have been a defense councils nightmare, she just could not shut up.

I am just now getting to see the morning session with Dr. DeMarte before I head out to work.

So...how do you think JW will be able to gain anything from cross? I can't see so far that she will be able to even throw in her own witnesse's credentials. She tried to throw out yesterday ALV had years of experience Dr. DeMarte did not.

And we still have no jury questions correct?

K

ok folks....don't all jump on me but Dr DeMarte seemed a little snarky to JW when cross began and they went through her CV. Seemed like the Dr's demeanor changed immediately. I think she needs to watch that. She seems like a real brainiac...you know, like Einstein!! JA did seem to me to very childlike over at the def table. Coloring maybe!!

Hi, I'm a long time lurker, first time poster, and hope I'm doing this right.

I started watching the trial when Juan started his cross of Jodi, and have been watching some of the prior testimony on youtube.
I'm so glad that finally we got to Juan's rebuttal. Watching Jodi has been a strange, unsettling, surreal experience.

Here's a link by SmoothOperator that I read several nights ago regarding the transformation that has been taking place with Jodi, and the unmasking of the evil that consumes her. This description is dead-on. Scroll down to post#765. ( trial day 43 thread 131 page 31).

Wow! Dr.Demarte is amazing! A breath of fresh air, as many have posted. So looking forward to court today!

Justice will be coming very soon for Travis Alexander and his family, and they are in my prayers.
Well gotta try to sleep some till later so i don't miss anything, lol.
I've really been learning a lot, as well as enjoying everyone's posts here, and I love Websleuths!

thank's,

Solitaryone.

Completely agree she must have been a defense councils nightmare, she just could not shut up.

And thank God she blabbed. This might have been a harder case without her "masked killers came and murdered Travis" lie.
