Trial Delayed until at least January

You're suggesting that the judge and all lawyers related to the case agreed that the two year said something crucial during the 911 call and therefore agreed that her voice would be muted in the recording. I have never heard that before. I've only heard sleuthers talking about hearing the child speaking and, in that jumbled up language of a two year old, believing that the 2 year old clearly said "daddy did it". I've been around enough 2 year olds, even bright ones, and usually mom is the best one to decipher what they are saying. What sounds like "I want juice" is really "I just pooped".

I could understand muting the child to protect her, but not because she said something critical to the investigation.

I thought you said you never heard "Daddy did it"???
Why would they mute and strike her utterances?
Rest assured the state obviously wanted the tape played in it's entirety.

I thought that Jason checked in shortly before midnight and picked up a newspaper at the front desk at 11:55 PM. Was he already at the hotel before 11:20?

Please refresh your recollection of the facts.
I say this because you and MyBelle are posting things that are factually incorrect.

He checked in at 10:49PM

Has anybody heard or read how many jurors have been selected yet? I have read nothing about this case at all since jury selection began again. Withdrawals.
Sure is good to see so many friendly faces on here.....looking forward to the trial. Sure hope the prosecution is ready this go 'round.

I heard the state has picked 12 as of Thursday PM. (used 3 of 6 strikes)
No word yet on how many the defense approved (if any) as of Friday PM.

Seriously: would you or anyone you know spend 25% more for gas than it cost?

Would you throw down a $20, pump only $15 and then not bother to get back your $5? Why only pump $15 worth of gas?

If you need to save a little $$ you would go back for that change on your $20, not leave $5 behind. If it only took $15 to fill the tank, then you still had plenty of gas in your tank...which makes one wonder why you would need to stop right then? (The purchaser didn't use the restroom, didn't buy anything else).

If the person was in a hurry to get back on the road at 5:30am, 30 - 60 seconds more to go pick up the $5 in change is not going to make that much of a difference.

No, that's someone who didn't want to be seen again, someone's who behavior was inconsistent with what an average person does. Now who would have been in such a state at 5:30am, who cursed out the gas station attendant, who was tall with light blonde hair, driving a white or light colored SUV, with sharp facial features?

Makes no sense, unless you explain he was in a hurry and didn't want to show his face another time to Gracie....that part makes sense.

How did you arrive at that conclusion!

I don't hear it. That is what I said. In response to your claim that the judge and lawyers came to a ruling that the child's voice should be removed from the recording, I asked for more information.

It's always the little things that make you go :waitasec:

JLY claims he went out to his car around midnight to smoke a cigar and read the sports scores in the USA Today. The USA Today paper at that point would be about 24 hrs old in terms of news. Hotels get their copies about 4 or 5 in the morning and the news is 'older' even by then because it's not real time.

The most current news and sports scores are found online or on TV, not in a newspaper at least 20 hrs old. Yet JLY claims he outside at midnight 'reading the paper to get the sports scores,' but that newspaper is not as current as what he would find on TV or on his own laptop connected to the Internet.

Not logical.

Factually incorrect? I asked when he arrived at the hotel, I did not state anything. Please reread my post: "Was he already at the hotel before 11:20?"

Some people really don't care much about the little money.

The witness's testimony desribed a short man. Jason is a tall man. That's a problem.

What makes no sense to me is that the prosecution put a witness on the stand that described her customer as the same height as she, and the prosecution expects people to believe that this was Jason.

Not logical.

It may seem logical to suggest that people would not read the newspaper at the end of the day because they could have read the newspaper earlier in the day or they could have read the news on the internet. Still, many people read the newspaper at the end of the day.

Why?
I suggest asking Ms Holt.
I am as puzzled as you are.

So supposedly the witness gave one statement to police at the time that she was interviewed, she completely contradicted herself during testimony, and the prosecution did nothing about this even though it placed the credibility of the witness in question? That doesn't sound quite right.

It seems to me that if the prosecution really had a statement from the witness that correctly described Jason, it would have been introduced as evidence.

How much would you remember with accuracy 5 years later?
No offense, but you seem to have forgotten many details of the case after only 6 months.

If I've done this right, this should be the original 911 call including CY in the background. The subsequent recordings of the 911 call released have CY's chattering in the background removed.

Thanks, Glee -- As has been said, and said, and said, the "Daddy did it" statement occurs 2 times in the recording in gracielee's link above.

At a point at the end of roughly the first third of the conversation, it can be heard just after when MF asks CY, "Do you know what happened? Did she fall?" That's where you hear her little voice say, "Daddy did it." The "it" is a little muffled, but it's plain as day.

Then it can be heard, a bit less distinct, when the 911 Op is ringing the WCSO. In the middle of the ring tones, you can hear "Daddy did it," one more time.

It is plain, it can be distinguished, and it is there. Twice. Period.

JLY did not even take the local newspaper.:noooo:
That, my dear, kills your argument.

Like many of us, he preferred to get his sports scores on the internet.
The same internet that was up an running in his room 5 minutes earlier.

JLY didn't say he was reading the newspaper. He said he was checking sports scores in the USA Today. Except that USA Today didn't have the latest sports scores because the paper he picked up from the front desk was already at least 20+ hrs old (being printed the night before) and the next edition of USA Today paper wasn't distributed until many hours later.

Why would JLY look up old sports scores when he could get the current ones on his laptop or by turning on the TV? And...he was home earlier so he could have seen sports scores then or heard them at any time on his drive to Hillsville or during his dinner @ Cracker Barrel.

I don't read yesterday's news for 'updated' scores. How many people would think that's the place to get them? :waitasec:

Doesn't hold water...

Actually, the USA Today paper he picked up at midnight was the Friday-weekend edition (assume just delivered to hotel). Never the less, the point of your argument is valid, as he was a confirmed internet addict. He blundered by specifically saying he wanted to check scores...defies logic.

Thanks for the clarification. He still wouldn't be getting the most recent updated scores...not as updated as those on the web or by turning on the TV. Bet the hotel had ESPN too. And who could read sports scores in the dark? Aren't those in fairly small print in the newspaper?
