Oldwage claimed that the toilet room light wasn't working on that night.

But didn't OP say he saw that light on, which was what scared him?

AS: My recollection that evening was that both sets of lights were on. The windows on the right were brighter because one was open. The window on the left was not open.

OW saying this is critical, showing pic of toilet window, checking that is the one she means had a light on.

OW: Are you sure about that?

AS: Correct.

OW: Wonderful. Milady, is this an opportune moment for a tea adjournment?

Of course after the door panel was out light would shine through to the toilet room, right?

Why?? Her testimony must match her witness statement or the defense would be all over her, right?? I'm asking to clarify for my own sake, not to be argumentative. TIA

We're now up to five witnesses that all heard variations - not drastically different - of the same events. Five.

All seemingly intelligent, professional types I hasten to add - with five independent witness statements. I just cannot swallow all of them being in collusion.

I wonder how OW is going to 'prove' the light was not working that night? A true electric fault or just a missing/broken bulb? The latter two options are easy to arrange quickly if OP had wanted to.

The time line is critical in this case. But every time (no pun intended) you think there is testimony pining a time down.. it goes all pear shaped and vague..... these people are just messing with our heads :banghead:

I have no idea what Oldwage meant when he said the toilet room light wasn't working.

He could have meant it was merely switched 'off', or he could have meant that it didn't have a lightbulb in the socket.

Mrs. Stipp said she saw light in the toilet room window. I can envision a scenario whereby that might be possible. If the light from the bathroom was shining into the toilet room, it might appear that a light was on in the toilet room.

When she was asked about the discrepancy in the amount of shots she heard, she said, "yes, I must have missed one." How can she know that? Obviously it's common knowledge now that it was four shots, and perhaps this is in line with her original statement. But how can she know whether or not she missed a gunshot or if it was the door she was hearing?

I don't think OW's attempts to imply witness misremembered being able to see out of her own window, or was somehow asleep when she saw out of it, have been very successful really.

Some might even say they were a little comical....

I think he had just told her beforehand there were four shots.

The defense is focusing on everything BUT the important part of these testimonies, for painfully obvious reasons. Every single ear witness has heard a female screaming. Not shouting words - screaming. It has been described as blood-curdling, life-threating, fearful... and the majority of them have also been able to separate out a man's voice during the same time as the female screams. The screams stopped with the last bangs, which every single person has said were gunshots.

Just because Mrs. Stipp isn't 100% sure if she gets out of bed at the middle of the bed or closer to the top, I am not going to automatically assume she is not a credible witness.

He is coming at her hard with nit picking details and she is holding her position.

That's OK... if she admits to the likelihood of missing one and only hearing 3 at 3:17... it will make it easier on the defense once it's established that the gun shots were the first set of "3" bangs
