Why isn't Nel objecting with saying "asked and answered" to half of this cross?

They don't do "asked and answered" in SA... obviously... else we'd have got this far on day 4

I think OW has established that the witness foolishly and deliberately put in her statement that she had seen 'someone in the bathroom walking' when she had not. It was just something her husband told her.

She did correct it though, the next day.

I don't think he has managed, despite many attempts, to discredit all her statements re time/noises shots though as a consequence. At least, the judge doesn't seem to be convinced.

I'm still v. interested in learning how OP will prove his toilet light was not working.

This is taking clutching at straws to a whole new level this stuff with the window, tiebacks and photo's, what utter buffon's.

It's normal since OP is paying him to defend his case and OW will be asking OP if there is anything OP thinks he's forgotten or that he should have asked that could help his case.

Yes - Nel & the witness are pointing out that lying in bed gives one a different view out of the window than if one is taking a photo from the other side of the bed, which is farther away from the balcony window.

OW: Curtain tie backs...where on the left pillow is it?

AS: It changes position. Sometimes wind moves it. It's a rope....not fixed to the wall.

OW: In ordinary course of events that curtain would obscure the view

AS: That angle of the camera, yes. But NOT when you are laying there.

Nel up, objects. Witness was not allowed to answer.

OW and witness in debate about if she could see through her window or not, and if camera was in a different position...for left curtain. Now onto the right curtain......omg.

the tieback isn't always in the same position unless the wind blows.

nel objects.. he says oldy has interrupted the witness in the middle of her answer.

right says Masipa that goes on the record, the witnesses continuing answer.

oldy is arguing with the witness as to how she sleeps in her own bed.

he says she had to move the curtain. she says, you mean the camera man had to. oh right, yes, ok.


reference to gunshots. you referred to them differently. in Afrikaans.

slai.. sly?? you assume to be gunshot. . in Afrikaans?? yes.

you then describe it differently. brai dfulki bloem. in my statement they sounded the same a floof. a kilader. its semantics, says Annette. as a lay witness. I agreed with this translation at the time.

AS: I would say that's a bit of semantics....there were three sets of sounds. I did not look so much at the descriptive words...

OW: You mean two sets of sounds?

AS: Yes, two sets of sounds.

Lunch, thank heavens but he has not finished with her....

Well...they may have one more issue to raise with witness after lunch adjournment. Will we, I wonder, bear physical witness to the dastardly tie-backs? (Cue favourite soap opera music here.) :biggrin:

Judge Masipa is impartial and stone faced, for hours, then suddenly she steps right in there, and brooks no mucking about ..
