I wonder what the 'tampering experts' are going to be testifying to? What can the police have tampered with that alters him firing into the door killing the person behind it?

O: I can't say I intended to shoot.

Nel 'unfortunately I have to show you something...'

Bail app.....

Did court end with that cliffhanger or did Nel ask a question?

That was a disaster. Roux and OP not on the same page. Roux jumping up to try to redirect OP from his "accident" testimony but OP not getting it and continuing on. OP basically admitting his testimony is geared towards the "implications." This is why defense attorneys hate to put their clients on the stand. Roux must be dying.... MOO

Well glad we got that burning question out there... where was the fan plugged in :floorlaugh:

OP was too polite? to say.... how the heck would you know WHAT was plugged in to that extension lead BEFORE the Cops got there... and plugged in camera chargers etc... then perhaps just plugged something in that they tought was there before.

THAT is what the issue with Police contamination is all about... you can not actually rely on the photo detail once you KNOW somethings were changed.

I get your point; but OP seems to be saying you can't rely on his memory either, because he can't recall those details. He was so panicked. But at the same time he is emphatic that there has been tampering (depending on the meaning he says) and contamination?

What Nel got out of OP today was the admission of firing four shots at the closed door having heard movement behind the door and believing there was a human being behind the door. That admission makes OP good for the basic culpable homicide charge plus the three gun charges.

Next up on Nel's agenda: Pinning down the premeditation charge.

See IMO...the problem we have in this is the known facts that Hilton Botha and at least one other of the Police were booted off the case and their jobs.
Evidence was NOT secure. If this gives Masipa 'reasonable doubt' that the fans could have been moved because of other Police errors, then IMVHO it will be a travesty to getting Justice for Reeva.
I think we have a mixture of truth and what the defence would call 'clarification' to aid in a CH verdict.

No, Nel wouldn't do that. That was me! He read out OP's statement (but written by Roux I think) that OP ran towards the bathroom door and fired at it, while yelling to Reeva.

He pointed out Oscar's bail affi which clearly shows he intended to shoot the bathroom door. To which he stated he'd never denied it - only he had, about 2 minutes before.

It's crazy. My brain feels fried. Hubby thinks Oscar is trying for the insanity defence after all. ;) 'No I didn't just say what you clearly heard me say. I'm fighting for my life, baba. The fan was unplugged so of course I didn't intend to shoot anyone.' Gah!

I am sure there was some hint of something like blame in the 'John stood up to light a cig' in the boat thing too, but I can't be certain...

ETA:No, that was the sun's fault. I remember now.

And blaming his race loss on the winner's longer blades.

BIB - Then you cannot actually rely on his affidavit once you know some things were changed. Sorry. LOTS of things.

I think it's all about the intentional part. If Nel can show he's lying about the events just before and after there will be doubt that it was accidental.:twocents:

Contamination, disturbance and tampering. Said in testimony about 150 times today alone - exactly that phrase. ;)

Just back to hear...He found her phone on toilet floor and Pistorius says he tried to call-out but her phone: "had a password I couldn't access". Fascinating.

Yyyesss!!!! And why had she have taken the phone into this room???????????????

Does anyone seriously still entertain the idea that he is telling the truth?.

Im not sure what to think at the moment tbh, admittedly, it was not a very good day for OP on the stand! :)

  • #757
Has anyone kept a list of all the people OP's apportioned blame to so far? I kind of have half a one;

Darren - speeding, irresponsibility with a gun

Sam - stalking

Police - moving things, telling him he could wash his hands

Roux - he got his client's affidavit wrong

Reeva, she didn't bring in the fans & shut the patio door

I'm just not convinced OP shot RS on purpose. What the Prosecutor is trying to drag out in minutia explanation only took probably less than 5-20 seconds. OP is on his stumps, jumping out of bed in a waking stupor, grabs his gun. Shoots.... pow! pow! pow! pow! The rest and in a state of shock, OP quite possibly does not remember except as it came back in flashes of memory. The Prosecutor is asking for specific details of time. OP accepts responsibility for what he did. It's the degree he must be held accountable which is in question.

Now, this is the main reason I refuse to have a gun in my house. That and I'd most likely use it on myself when I'm in one of those deep black funks to which I'm prone.

Reeva, she didn't bring in the fans & shut the patio door

The careless contractors who left the ladders that OP could have put in his garage.
