Just now on Sky the legal adviser of the day by coincidence has the same Glock. He explained exactly what must have happened, i.e. Fresco passed the pistol to OP not only one up but with the magazine still in it. OP, who obviously did hear Fresco tell him it was one up, emptied the chamber in order to test the feel of the trigger, but as he didn't check to see if the magazine was in it when he pressed the trigger another bullet had been chambered so it fired.

The guy was also adamant that it is impossible for the Glock to go off without pressing the trigger unless being hit, dropped or caught up none of which is claimed by OP.
Jaysus, its actually bloody scary how close someone came to loosing their life in that restaurant. Quite frankly, if I was the owner of that place, I would have banned the lot of them and called the police...maybe, just maybe Reeva would be alive today. (lol, and nooo, im not blaming the restaurant owners for her death, im just saying!)

a client who states in court from the stand that ones legal chaps have stuffed you around. I just don't know I cant see a happy ending to this.

He appeared very flat in his objections today

I have no doubt that the Police errors in this case are going to make a difference to Judgement and Sentencing, it's just a question of what difference. IMHO

Why would "police errors" affect sentencing?

Just referring to the narrative that Roux will be using later in the trial. It's as if OP is quite aware of this and is using some already to invalidate Nel's suggestions.

He did tell us today that there will be people testifying that he has never yelled at anyone or something similar to that

(For anyone reading my other post about the Glock I have been mixing Darren up with Fresco so where I say Fresco I mean Darren.. in the other post)

Okay. I understood that still to mean she was scared of him sometimes, in that his reactions (behaviour?) scared her sometimes. I can understand someone being overwhelmed by feelings for someone else, but not that 'scared of you' and 'scared by my feelings for you' mean the same thing at all.

IMO, any argument they'd had could have turned into Reeva threatening to break things off or just turned into him going ballistic. It may have had to do with something on her phone, that she was still using her phone while he was trying to sleep, that he tripped over her G**D*** jeans on the floor for the 97th time.....

Anything.

It's my belief she ran into the bathroom, already had her phone in hand, or grabbed it on the way, and locked herself in to get away from his raging....she may have been thinking who to call for help (it's hard to think when the dude you thought you knew has turned into a maniac on the other side of the door), or maybe she really thought he'd cool down in a few minutes.

Then he shot through the door. :twocents:

And in this scenario, she likely would have slammed the toilet door.

I'm sure the slammed door did happen, it just doesn't make sense in OP's "versions". He's made a big mistake in introducing this detail.

I missed that but another time he stated unequivocally she was not scared of him. I posted it at the time. There was no qualifying or explanation - just a flat denial.

I think he got confused for a minute because there is another instance where uses the word where it does sound like she's saying she's scared of falling for him and being with him because of his publicity and, presumably, the harassment she had begun to receive. And I think he realized Nel was talking about something else which is why he changed his answer accordingly because that does sound like what she was saying in that moment, that she was scared of his behavior toward her sometimes.

Roux has stated they heard crying but not screaming. The day after Oscar testified he'd never screamed like that before in his life.

Roux said something the other day about those who the state never called only being witness to crying IIRC.

I am not too sure Nel is correct about the Duvet. I am sure I remember someone saying that it was moved, possibly the photographer, to check there was no evidence on the sheet. Does anyone else remember?

iirc The photographer said he noticed what looked like blood spots on it when he was first taking pics of the scene so he then spread it open and found more spots. I'm pretty sure he had said the duvet was already on the floor when he first saw it.

I don't understand. Do think Reeva went into the bathroom, opened the bathroom window and went into the toilet knowing an intruder was in there or not realising one was in there, or did an intruder come in there after she was already in the loo after having opened the window ?

I have not heard OP say he shouted "burglar in the bathroom, get out of my house", or "Reeva call the police there is a burglar in the bathroom", so how would Reeva know the intruder OP was shouting about was in the bathroom so as to render her unable to phone the police or call out to OP for fear of being heard, as she heard OP getting nearer shouting for her to call the police.

And had she known a burglar was in the bathroom, according to some, ready to shoot an occupier at first sight, then why would she be standing near the door and not crouched in the corner behind the toilet, or to the left of the toilet pressed against the left wall and a much more auto protect position than standing free in front of a door.

Curiously according to SA crime statistics surprisingly few people are killed during house break-ins and of those some are the thieves.

again, checking op version of events:

rs was in the bathroom... then slams the door to go in the toilet... he calls/screams 'get out of my house' etc etc, she is hiding in the toilet... she clearly knows no intruder is in the bathroom, she has just been in that very room... so it would be safe to use the phone to call or text for help. but she didn't.

it has occurred to me that his story includes part fact/part fiction - in whatever ratio... and sometimes these get jumbled/muddled under the now less-controlled atmosphere of cross examination

and it is possible that op chasing down the corridor screaming 'get out of my house' and reeva 'slamming' the toilet door closed are two of the facts.

Why would Nel need to measure a wire that is of an obvious length to the naked eye? But I am sure they did and it is in the forensics report that was put in to evidence; otherwise OP would not have answered with all of his conspiracy theory nonsense that his experts will be proving. And he would not have admitted that with the fan where it is he could not get out on to the balcony to yell help, help, help.

It now appears definite and essential that the DT bring testimony and evidence that the police rearranged the crime scene. Sorry folks, but for me the fairy tale has completely gotten out of hand. Someone please tell me how wrong I am and how the DT is going to pull off this new added miracle. Please, tell me.
