It's to protect the case on appeal. Oscar can't state he wasn't given every opportunity to assist his own defence, denied constitutional rights, etc, should he be convicted.

I'm not doubting his right to say he's tired. It was the way the judge wouldn't let him fudge around with the answer and demanded he answer it, which indicated to me she's aware of how he can drag out a response to a question.

Oooh .. neat little trick there by Nel .. he was quizzing OP on the muzzle flash and bang and said to OP did he hear them, and straight off OP said he didn't hear the muzzle flash, he saw it ... and immediately Nel said OP can't be that tired to have picked up on that .. and Nel said he was even going to note that OP was "not that tired then"!!

N: it is so improbable that you don't remember who picked you up....and that's because it never happened...

And Nel goes on to recap all the details OP does remember from the one time OP was nearly shot, except the crucial detail of person who could corroborate it...

Cant remember if he got shot at in his car in 2009 or 2010 and cant remember who he pulled over and called after.

I would report to the police such things so that the police will note to pay more attention in my area. I would hope that my neighbors would also even if not covered by insurance. The area I live, I believe more police drive bys if there was recent crime. It also puts it out to the neighbors to keep a heads up for the type of crime e.g. car break ins...

Oh, he's backtracking now since ma'lady gave him an out if he was too tired. Oh, so he's not too tired now and changes answer.
We did report to our local neighbourhood watch. We do that for statistics etc for our area, also they are more visible than the police. :)

Nel. this is a serious incident. if someone shoots you on the highway , you could die. . and you didn't report it to the police??

Nel picking his story to bits about being shot at on the highway and basically saying that OP is able to remember all the bits he wants to but conveniently forgets other bits (checkable bits relating to other witnesses .. who he phoned after the incident, etc) .. OP didn't report it to the police either .. so his story about being shot at cannot be verified.

O: I called the police out when there was an attempted burglary in my house but a docket wasn't opened..

N: One factor was you didn't trust police to do anything?

O sort of backtracking now, saying not because he doesn't trust police but because the burglary happened a full week before he had chance to report it?

2012 incident where OP said he was assaulted now.

O: Correct...it wasnt a public event

O explaining Mr B had taken Sam to an event and he was older than Sam, Sam told him he was manipulating her...

O: He couldn't keep his eyes off me...kept staring at me....

He confused a camera flash with gunfire? This guy is in the media all the time, photographed by dozens of photographers?

I'm pretty sure that is what Nel put to him .. that it was a camera flash .. and OP replied saying it definitely wasn't a camera flash, it was a muzzle flash and a bang .. so it wasn't OP who got the muzzle flash confused with a camera flash, it was actually Nel trying to confuse him! OP doesn't remember who he called later though, so there is no witness to the event, and he didn't report it to the police either .. so the whole incident cannot be verified.
