The interpreter lady behind Dix is so cute. She is fighting the dreaded need for a nap.

I like watching her too, she's got a very calm looking face.

Someone asked if Nel could seek to preclude this witness. He can't. Dixon has been put forth as an expert witness and the court has accepted him as an expert. So Nel has to discredit his testimony - the witness isn't making that hard. Then its up to the judge (or jury) to determine how much weight to give the testimony rendered. My opinion is that much of his testimony won't be considered because of its inaccuracies, like the balcony light.

Could Nel have voire dired (sp?) this witness to show whether he is or is not an expert in those fields like is done here in the US? Could Nel have rejected Dixon as an expert? KWIM?

D says the two samples were a fingerprint match.

N: But you were aware there are other doors in the house?

D: As I said, I wasn't aware other doors could have been kicked...I did not take samples.

Does this man actually know the words 'YES' or 'NO'. He would make a good politician - they are trained in evading direct replies to questiions. Seems to come naturally to our Rog!

Witness disagrees with Col V's theory that it could have been from a stumble. Insists it must be from a kick, because of the force used.

D: There's not enough space...I would expect you would really have to kick hard, quite deliberately...

He was doing the same when OP was on the stand. I found that slightly amusing as he remembers lots of small detail in testimony.

D: Because it's in movement, no exact match possible...what I see is an outline....I am not certain at exactly what angle....I did the tests at what I consider to be approx angle. I could never replicate the tests.

Since we're discussing an appeal for ineffective counsel...just gotta throw it out there that I've seen an appeal rejected for the same reason when an attorney was literally sleeping in court. It was an American appeal so it may be different in SA. It's always mentioned as a possibility but it's very difficult to prove. Roux has a heckuva lot of experience. And if Oscar worked against advice, or didn't disclose details to his team, I believe it negates such a claim. Not that he still wouldn't try in the event of a conviction, but imo he's very unlikely to be successful.

So don't fret too much. :)

There are no voire dires or depositions in countries that follow UK procedural systems as SA does. (SA procedural rules are published online and resumed in Wikipedia)

Talking about sound tests of shots through door. Two Van Der someones with him and two ppl from shooting range.

N: Do you still have all those photos, in sequence you took them....I take it you have no objection to us seeing them too?

D: Milady, that is what I took...I have no objection to anyone seeing anything I took.
