She agrees with Nel that she has said his anxiety disorder was worsening, and that someone with that, possessing guns makes him'a dangerous person'.

V: Yes.

  • #522
I need to revise what I posted earlier. I don't believe her testimony will hold much weight at all considering that.

OP is under a psychologist's care too (the lady who keeps stroking him and cradling his head in court) and I have to wonder why she didn't testify instead. She at least has established a rapport - but I guess that could well work against the defence once Nel asked her why she was stroking his face in court. ;)

Surely it couldn't, she barely knows the guy.

Nel is about to ask for Oscar to be committed.
Largest backfire in trial history!

  • #524
Wow, she considers he's a dangerous person and dangerous with a gun, and his anxiety is getting worse.

  • #525
Oh oh!

  • #526
Nel now talking about people with PTS and general anx disorders get referred for observation.

V: There can be no harm in that, then the court gets a chance to see...

N: There is really no choice, the court has to refer the person....

And Roux up, to prove OP should not, in no way, be admitted to an institution...

Oh my god, she only met OP last week!!!!

She's been following the trial and on the 5th of May she interview sister, brother, Uncle and coach. And on the 6th of May she re-interviewed Pistorius!

I'm actually amazed, this is beyond rushed. What is going on in this defense team...

I can't believe this is all Advocate Roux's doing. The Pistorius Channel 199 legal roundtable just wondered who was really pulling the strings of the team, they thought about Oldwage or Pistorius lawyer Brian Webber or even a media strategy (I wondered about Pistorius' Uncle Arnold) because they felt the defense line-up and prepping of their witnesses did not seem at all professional.

  • #528
It sounds like she only did interviews & not forensic evaluation & testing

  • #529
Roux is going to quote Nel into submission, from the law books....

  • #530
None of his witnesses do him any favours at all. Next we'll be hearing he's criminally insane???

  • #531
Roux: That's not in section 78.It's definitely not.

Nel: He's arguing on an application I haven't even brought yet.

  • #532
WAAAAAAAAT??????? To quote Will.i.am :-P

  • #533
are we back??? yes indeedy, Nel a bit late, got his clock to blame.

now. you examined P .. did you follow the trial at all? did you follow his evidence..??

Vos. not every moment. not a great deal of it, no.

Nel. do you think the situation he finds himself would increase his anxiety? put it this way, I am not doing too well, my case is not going well. wouldn't I be anxious??

Vos.. I did hear that, that he said he was fighting for his life. he didn't say that to me in my two interviews,.. 2 d May and another date in May.. those dates of interview are my days with Mr P. I interviewd other people after those dates.

Nel. your first involvement, 2nd may??

vos.. correct. the rest of the people mrs Binge. 2nd may. I refer to my file if I may. ( paper shuffling ) . ( heavy breathing ) .. 5th May.. all of the others.. sister , manager, brother, coach, friend. 7th may, Mr P again.

Nel. ok. ok. Dr.. what is the purpose of your appearance to this court? ?

Vos. to bring psychiatric factors which may be relevant to the court, for the purpose of conviction or

Nel. these factors you feel may have been a matter of his capacity to act rightly and wrongly??

Vos. yes.

Nel. the fact that you made a finding of general anxiety disorder, you say this is relevant to the fact of the matter??

Vos. it MAY be relevant. I am not privy to that. it MAY be relevant..

Nel. you also said, he is suffering from a general anxiety and it has worsened..??

Vos, yes, it is increasing in intensity. ( she said for sentencing purposes. not conviction, my mistake) ..

Nel. that would make him a dangerous person, wouldn't it?? / his increasing intensity?

Vos. yes.

Nel. and if he has access to a gun that would make him more dangerous??

Vos, yes.

Nel. referring to PTSD.. people who suffer from this ,they say they are affected in their perception of right and wrong.. nel is a general anxiety disorder??

Vos, yes, they fall under that category. generalised, .

Nel. and these people are usually held under observation??

Vos. well. it does the court no harm to have a second opinion in this..

ooo my feed has GORN!.. its back.

Nel. well the court doesn't have the option. if his defence is his mental impairment, the court is obliged to hold him under observation ..

Vos... no. its Roux, he is arguing this. arguing forcefully now. is a person UNABLE to make the right decision due to mental impairment?? . judge is paying acute attention.

Roux.. an act of commission or omission. done under mental defect.. not criminally responsible. if it appears to the court, the court could find they are not capable .. there is two prongs here, mental illness, mental defect, making incapable of distinguishing....

Nel. I haven't made the statement as to this as yet..

Nel. having dealt with 77 78 and 79 for many years.. its not just incapable, its the diminishment of capacity. to not be so responsible, the court is bound to take this under advisement. I will oh god, my phone, milady I will never forgive myself, I am so sorry. I am embarrassment. Judge. don't let it happen again.

The eyes of the entire defence team are on Nel.

That would make sense. This strategy really defies the decades of experience and reputation Roux has cultivated. I'm gobsmacked by all of this, on top of double taps, 'emotional' witnesses and inference of a head shot first, etc.

  • #536
N: I asked the doc if PTSD...

Nel begging judge for forgiveness for phone going off so nicely, Judge lets him off. But tells him not to promise it won't happen again 'as it might'.

  • #537
This is JUST wild!!

  • #538
OP must be beside himself right now....

  • #539
roux is up big time here. this is massive for op.

that his anxiety is SPECIFIC to South Africa!!... that's such a bucketful of bulls**t that even my dog has the snuffles over it.

Isn't it ..

.. if he really *is* that paranoid about living in South Africa, then I'm surprised he hasn't just upped and left and come to live in Britain like many other South Africans have (I know quite a few people from SA now living in GB) He's got a bezzie mate who lives in South London (Croydon) .. Martin Rooney (Croydon Harriers) .. so it's not like he wouldn't know anyone here (Martin was over in SA staying with him only days before the shooting, apparently .. he, OP and Reeva watched films together in the evening .. Reeva made reference to it in one of her tweets saying she had enjoyed it so much and that she and OP were going to kidnap him because they like his company and having him over and didn't want him to go back).

I can't work out how to link to the tweet but this is Reeva's twitter feed and it's 9th Feb https://twitter.com/reevasteenkamp

I really do not believe OP was *that* fearful of living in SA, it's all just an excuse to pretend he didn't intentionally kill Reeva.
