Oldwage is correct in asking if State will call Dr. Carla. Nell is in truth attempting to testify in her behalf. Nel has to rephrase question.

Derman says 'if this is the case' (that dr K doesn't agree with what he said) then he 'would cede to her greater experience'.

Exactly! He wants to tell the court what she disagrees with, but he doesn't want to call her as a witness. Shame on Nel. Oldwage was right to object.

WD says he does feel qualified to comment on the psychological report.

WD: I am commenting on an interpretation of a test. Gives an example about concussions.

Nel asks question for a third time. Says WD doesn't want to answer.

Derman admits he wouldn’t give expert evidence in a family member's trial, but says OP isn’t one, he can still be objective.

Nel: I will argue that you are unable to be objective because you are his treating physician.

#OscarTrial Nel refers to Mr Derman. Oldwadge sits up - “Professor” Derman. Masipa says it was clearly a mistake. Things getting petty. BB

I think he's wrong. He's told the witness what Kotze's opinion is. Since when do counsel testify as to the opinion of witnesses whom they have not even decided to call ? If Nel is going to become a witness he must swear the oath.

The 70/71 refers to the diagnosis of specific anxiety disorder.

N: If it was 71, it wld have constitued a finding of what?

I could not understand D's answer. He tells Nel he answered the question 3 times. Nel says: 'No'. and tells him witnesses should not ask the questions.

Wonder why the psychologists and psychiatrists who wrote the report dont come in and testify? If the State wants to rely on the reports they should call the doctors who wrote them. And since Nel has indicated that the state psychiatrist disagrees, then it sounds like he's going to call her = otherwise he should not mention that.

He's cross examining minor. Oldwage opened this door having this guy comment on the report.

I think Nel is right to ask the question because when the Professor gave his evidence originally I remember thinking 70-71 that was pretty close to having an axiety disorder. He spoke with some conviction, I expected him to be an expert on the issue...he obviously isn't.

Ooooh Nel just schooled the witness...witness answers questions, he doesn't get to ask any questions.

Is it Scholtz or Koltz?

I'm not sure except it was the one Nel said was there seated beside him, Dr Carla... whatever!

What seems clear is that Nel is extremely reluctant to call them to testify.
