Defense: Mistake of fact is not a crime. Ross Harris believed Cooper was already at daycare. #HotCarDeath

Kilgore tells jury there is no motive bc #JustinRossHarris was already having extramarital affairs and getting away w/ it. #hotcardeath

Hard not to see that head isn't it? Wonder why he didn't say that?

Wonder why he said socks LOL. He even says the socks are the brightest object in the photo- when it's clearly the head. I agree why not use the right socks- wouldn't change how white his head is though.

LH testified she told Ross if she knew he'd had a physical affair she'd take their son and leave. With his escalation of his sexual behavior, that was going to happen sooner than later.

I'm not so convinced of that tbh. I think she was a lifer with Ross.

stopping yelling, Kilgore. MY EARS!

I don't think he knew what Leanna would actually do- I think he was tired of his lies and cheating and frankly plain lazy to keep it all up- much easier to be single and do whatever he wants no matter how many times your wife forgives you. Takes a lot of effort to explain and apologize and be forgiven.

IMO

The mock anger is terribly played, so forced.

Many thanks, once again, for WSers posting with minute-by-minute coverage of the court happenings. Your work is appreciated!

I'm so curious how long it will take the jury to deliberate....

I think it must have been exhausting physically and mentally to juggle all areas of RH life simultaneously...I think he had to choose which ball to let drop in an instant personally, as he said he was near breaking point. He chose the biggest life drain...

Kilgore's continue testimony:

Kilgore has been speaking now for nearly an hour. He was warned the jury that since the prosecution gets to speak to them twice during closing arguments -- and he only gets to speak once -- he is likely to take a long time.

He hammers again at the state's 3D laser scan of the SUV that showed the position of the car seat and of Cooper in the seat. "That scan was made for the purpose of showing you -- you -- what Ross might be able to see." But he points to details that were incorrect, such as the fact that the doll used to depict Cooper in the seat was wearing bright white socks on his feet -- socks that showed up very clearly in the state's image. In fact, Kilgore says, Cooper was wearing blue shoes.

Now the defense attorney returns to the testimony and investigative work of Cobb police Det. Phil Stoddard. He replays a video of Harris putting light bulbs into his car after lunch that day. Stoddard testified that Harris was "in there" within the frame of the vehicle and that Harris could easily have seen his son in the back.

"As you can see for yourself, he's not 'in there.' He doesn't have a clear view. Ross's head never goes below that roof line. So I think it's a very fair quetion to ask you this, When the detectives in this case take the stand and they swear to tell the truth, the whole truth and nothing but the truth, is it? Or are they going to tell the truth (that supports) their theory?"

I think if there wasn't so much LE or public focus on her actions, she'd still be with him. It appears her only resentment is what this has done to her character.

I think they will be done by Thursday.

Uh uh.

The jurors aren't blind. They've seen the proximity of the car-seat to Ross. Kilgore's asking the jury not to believe their own eyes for the sake of an inch or so.

The bottom line is, the seat is in your face there. Toddlers are not plastered flat against the seat. Forget the tiny "neon" sock, his blonde head is the big red flag that Cooper is right there.

As a juror, Kilgore's just flagged that for me.

Well I'm not either but IMO Ross believed her. JMO but he was enjoying his other life. He escalated if wifey finds out, leaves, ruins his reputation and puts him on the hook for 16 years of support...that's not good for Ross the Boss. But if Cooper tragically dies he's free

Thanks Mr Kilgore for showing the video Mr. Boring didn't get around to.

IMO it's clear he turned around he looked the second time he paused.

I agree. And I've said this before but even if he fit in the seat properly IMO he still would have been seen. I've said the same thing- he's a person not a pancake in that seat.

I think his anger about LE lying is genuine. Understandable. LE shouldn't lie.

Kilgore arguing the 5 minute phone call to LAA. Oh please, stop brushing over the real facts in this case.

  • #719
I don't think Ross hated Cooper. I think he hated being accountable to Leanna. Cooper was collateral damage IMO

I don't even think it was LH. I think he had never in his life had such sexual success with women and he had lost his mind because of it. people get addicted to 🤬🤬🤬🤬, sex, living dangerously, etc... It's a lot more exciting than being a dad, a husband, going to work everyday (though he doesn't seem to be doing much work) providing for the family.
I think he decided he wanted the single life, in a big city, with his playboy self.

Kilgore continues:

He reminds the jury of its early morning visit to the courthouse parking lot to view Harris's 2010 Hyundai Tucson, the vehicle in which Cooper died and, according to the prosecution, "the murder weapon."

He tells the jurors that they knew to look for the car seat when they went out to see the car.

"It's easy to see what you're looking for. In fact, it's impossible to miss what you're looking for. ... How do we know that Ross didn't see Cooper. Because he didn't freak out right there in the parking lot and pull him out of the car like he did at Akers Mill (when, according to Harris, he discovered Cooper was still in the vehicle).

"It's real clear that he didn't turn his head. It's real clear that he can't see something that's behind him."
