strangest charge I have ever seen...however I do have every faith in this Jury

If Rafferty encouraged McClintic to kill Tori, he is guilty.

If jury satisfied, beyond reasonable doubt Rafferty committed the murder OR helped McClintic, he's guilty, even if they can't decide which.

Correct me if I'm wrong but I thought if you aided and abetted in a kidnapping and the result was murder, whether or not you actually committed the actual crime, it was first degree?

How can that be? We must be missing a lot of what the Judge is saying.

Second comment was not necessary unless you are trying to stir up a negative reaction ... just saying MOO

There is video at several locations (school, HD) where you do not see TS in the backseat, thus collaborating TLM's statement. Also BA did not see TS which would also leave me to believe that she was hidden (I did not see it rain but I see the puddle).

Funny, my husband said the same thing ... He said that if a women friend asked for a ride with a child he would not of questioned it would never even crossed his mind that it might be a kidnapping

The problem with that is that the defence has argued that MR thought TLM grabbed Victoria as part of a drug debt. I doubt a good husband would go along with taking a child under those circumstances.

bbm JMO the "wild card" here is how much, and what parts, of TLM's statements will the jurors believe. We'll know soon. JMO

This is exactly what I have thought for the last few days... too much is going to be about how much they believe TLM. She's not a great witness ... sadly - she comes with way too much baggage so to speak.

However, where the whole kiddnapping breaks down for me is that he was waiting up the street in the parking lot. Why parked way up there if he didn't know it was a kiddnapping... whether it was for sexual purposes or drug related... dosen't matter - it still equals kiddnapping - which in turn = 1st degree murder.... that's where I fell off the fence onto the guilty side 2 weeks ago.

I thought so too and that's why I'm really upset that they threw in 2nd and manslaughter.

Isn't that what the CROWN said. That it's first degree? What the heck is going on?

Let's be nice to each other and stop arguing. The nerves are blank and we are all excited, nervous and worried.

How about a deep breath? Let's hold each others hands and send our wishes and energies to the jury so they hopefully make the decision we're longing for

It seems like judeg is speeding lots of time explaining the steps...IMo as tweeter has slowed down....I hope you realizes I am posting live twiiter feed these are not my opinions ....so cannot answer LEGAL QUESTIONS SORRY ..I never seen a decison tree ever ...sorry Carrie ....

Accused can be charged with certain crimes and tried, it doesn't mean they will be convicted of them jme
